RESOLUTION NO. 386
A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY TO VACATE THAT CERTAIN EASEMENT
FOR LIGHT AND AIR ALONG FONTANA STREET.
WHEREAS, there previously was dedicated to the County of Los
Angeles an easement for light and air over a portion of Tract No.
10689, said easement creating, in effect, a set -back line of 20 feet
from Fontana Street; and
WHEREAS, the Planning Commission of the City of Downey, by action
duly taken, has granted an exception to the owner of Lot 28 in said tract
to build to within 15 feet of said property line;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The City Council of the City of Downey hereby declares
its intention to vacate an easement for light and air over the hereinafter
described property within the City of Downey. Said easement so proposed
to be vacated is shown on that certain drawing No. 1 -2 -18 on file in the
office of the City Clerk of said city, and reference hereby is made to
said drawing for the location of said easement to be vacated and the extent
thereof.
Said easement to be vacated more particularly is described as that
certain easement for light and air over the following described land located
in the City of Downey, County of Los Angeles, State of California, to wit:
The Northeast 20 feet of Lot 28 of Tract No. 10689 as
recorded in Map Book 172, page 39 of the Official
Records of Los Angeles County.
SECTION 2. Said vacation is proposed to be made pursuant to the pro-
visions of Sections 50430 through 50 445 of the Government Code of the State
of California.
SECTION 3. All persons interested in the proposed vacation may be
heard at that said hearing to be held pursuant to Section 50438 of said Code,
on March 10, 1958, at eight o'clock A.M. in the Council Chambers in the City
Hall of said city located at 8425 Second Street, Downey, California.
SECTION 4. The City Clerk shall cause this resolution to be published
in the `Downey Live Wire," a newspaper of general circulation published and
printed within the city. Said resolution shall be published for at least
two successive weeks prior to the hearing.
SECTION 5. The Director of Public Works hereby is directed to post
copies of this resolution along the line of the easement proposed to be
vacated, in the manner provided by Section 50441 of said Code.
SECTION 6. The City Clerk shall certify to the adoption of this reso-
lution.
APPROVED AND ADOPTED this 10th day of February, 1959.

10th day of February, 1959, by the following vote of the Council, to wit:
