RESOLUTION NO, 7/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DETERMINING THAT THE CONSTRUCTION OF CERTAIN SANITARY SEWERS IS NECESSARY AS A HEALTH MEASURE IN NADA STREET AND OTHER STREETS AND RIGHTS OF WAY IN THE CITY OF DOWNEY WHEREAS, the City Council carefully has considered all mat- ters relating to the proposed construction of sanitary sewers and 1 appurtenances in: Nada Street between the easterly line of Old River School Road and the westerly boundary of Tract 12408; A right of way in and along Otto Street (a private street) etween Lexington and Gallatin Road and a point 480 feet westerly of the easterly line of said Lexington and Gallatin Road; A right of way between the easterly line of Lexington and Gallatin Road and the westerly line of the cul de sac of Otto Street (a public street) lying immediately easterly of Lexington and Gallatin Road; Otto Street (a public street) between the right of way easterly of Lexington and Gallatin Road and a point 120 feet east of the center line of Lexington and Gallatin Road; A right of way lying in and along south LaReina Avenue (a private street) between the 2enter line of Stewart and Gray Road and a point 285 feet - north of the northerly line of Stewart and Gray Road; and WHEREAS, pursuant to Section 2808 of the Streets and High- ways Code, the institution of improvement proceedings has been recommended by the Health Officer of the County of Los Angeles acting as the Health Officer of said city, as necessary as a health measure, and such recommendation has been given in writing and spread upon the minutes of the City Council; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That it hereby is found and determined, in accordance with the provisions of Section 2808 of the Streets and Highways Code of the State of California relating to the exemption of proceedings for the construction of sanitary sewers from the -1- 52S provisions of the Special Assessment Investigation, Limitation and Majority Protest Aet of 1931, that the necessity exists for the institution of proceedings in accordance with said Section 2808 that the construction of said sanitary sewers is necessary as a health measure.
