HomeMy WebLinkAboutResolution No. 365 5 RESOLUTION NO. ;3‘.5* A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ABANDONING THE PROCEEDINGS OF THE VERDURA AVENUE ET AL IMPROVEMENT DISTRICT NO. 5 -M. WHEREAS, the Downey City Council has held a hearing upon an investigation report encompassing the construction of sanitary sewers in Verdura and Earnshaw Avenues between Century Boulevard and Acland Street; as well as Century '•■, Boulevard between Earnshaw and Verdura Avenues, and known as Downey improve- ment District No. 5 -M, and WHEREAS, there were no written protests filed with the City Clerk, and WHEREAS, the City Council of the City of Downey has determined that the proposed work is feasible and the public health, convenience, and necessity require the construction of the improvements, and WHEREAS, the benefitted property owners within the area proposed to be assessed for sanitary sewers desire additional improvements in the form of curbs, gutters, and street paving, and WHEREAS, it is more economical to conduct one proceeding for the con - struction of these sanitary sewers and street improvements, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The proceedings instituted under the provisions of the Municipal Improvement Act of 1913 as ordered by Resolution No. 73 are hereby abandoned. SECTION 2. The City Clerk shall certify to the adoption of this resolu- tion and shall transmit a certified copy thereof to Mr. John A. Lambie, Los Angeles County Engineer.
