HomeMy WebLinkAboutResolution No. 307 424 RESOLUTION NO. e 7 A RESOLUTION OF TIE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY REQUIRE THE ,., ACQUISITION OF AN EASEMENT OVER CERTAIN PROPERTY FOR DRAINAGE PURPOSES THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines, and declares that the public interest and necessity require the ac quisition of a permanent easement in, on, over, and under the here- ! inafter described real property for drainage purposes, and to locate, relocate, construct, reconstruct, maintain, operate, renew, enlarge, remove or replace a line or lines, pipes, drainage struc- tures, culverts, and all facilities and appurtenances necessary or incidental to a drainage system. That the location of the land for said easement has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council hereby finds, determines, and declares that, in order to acquire said easement and use the ' same for said purposes, the public interest, convenience, and neces- sity require the acquisition of an easement by the City of Downey in and to that certain real property hereinafter described, and the City Council hereby declares it is the intention of the City of Downey to acquire, in its name, an easement in, on, over, and under said hereinafter described real property by condemnation, in accord- ance with the provisions of the Code of Civil Procedure and the Con- stitution of the State of California authorizing the exercise of the rights of eminent domain. SECTION 3. That said real property, the acquisition of an easement in, on, over, and under, which is required by the public interest, convenience, and necessity for the purposes set forth in Sections 1 and 2 hereof, is described as follows: That certain real property in the City of Downey, County 4E5 of Los Angeles, State of California, more particularly de- scribed as: The southeasterly two feet of that certain parcel of land in Rancho Santa Gertrudes, as shown on map recorded in Book 1, Pages 156", 157, and 158, of Patents, in the office of the Recorder of the County of Los Angeles, described in deed to Clyde W. Erwin, et ux, recorded as document No. 642, on November 6, 1930, in Book 10454, Page 63 of Official Records in the office of said recorder. SECTION 4. That the City Attorney of the City of Downey and Burke, Williams. & Sorensen hereby are authorized, empowered, and directed to prepare, institute, and prosecute, in the name of the City of Downey, such proceedings, in the proper court having juris- diction thereof, as. are necessary for the condemnation of the ease- ment in, on, over, and under said real property described in Section 3 of this resolution. SECTION 5. The City Clerk shall certify to the adoption of this resolution.
