HomeMy WebLinkAboutResolution No. 303 419 RESOLUTION NO. 62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ERING THE VACATION OF A PORTION. OF CORD AVENUE, SAID PORTION LYING WESTERLY OF DOWNEY AND SANFORD BRIDGE ROAD. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: WHEREAS, by Resolution No. 280 of the City Council of the City of Downey, , adopted the 28th day of July, 1958, the City Council declared its intention to vacate a certain portion of Cord Avenue, said portion lying westerly of Downey and Sanford Bridge Road, and setting a hearing, thereon, for the hour of 8:00 A.M. on the 23rd day of September, 1958; and WHEREAS, the public hearing on said intended vacation duly was held and a full and fair hearing was had thereon. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council finds from all the evidence submitted at said hearing that the portion of Cord Avenue hereinafter described is un- necessary for present or prospective street purposes, and it hereby is ordered vacated. Said area so vacated is described as follows: That portion of Cord Avenue, in the City of Downey,.. County of Los Angeles, State of California, as shown on and.dedi- cated by map of Tract No. 16334, recorded in Book 430, page 18, of Maps, in the office of the Recorder of said county, and that portion of Cord Avenue in said City, as shown on and dedicated by map of Tract No. 16346, recorded in Boo 431, page 29 of said Maps, within the following described boundaries: r1 Commencing at the intersection of the southwesterly line of the northeasterly 10 feet of said Tract No. 16334, with a line parallel with the southeasterly line of said last mentioned tract and which is tangent to that certain 15 foot radius curve in the southeasterly boundary of Lot 1 of said Tract No. 16334; thence southwesterly along said parallel line 17,00 feet to the true point of beginning; thence con- tinuing southwesterly along said parallel line to said cer- tain 15 foot radius curve; thence northerly along the easterly boundary of said Lot 1 and the easterly boundary of Lot 9, said Tract No. 16346, to a point in said easterly boundary distant northerly thereon 15.00 feet from the southwesterly line of said Tract No. 16346; thence southerly in a direct line to a point in the southwesterly line of the northeasterly 10 feet of said Tract No. 16334 distant southeasterly thereon 17.00 feet from the easterly boundary of said Lot 1; thence southeasterly along said southwesterly line to a point 'distant northwesterly thereon 39.34 feet from the southeasterly line of said Tract No. 16334; thence southerly in a direct line to true point of beginning. SECTION 2. Pursuant to the authority of Section 8330 and 8331 of the Streets and Highways Code of the State of California, the City Council hereby determines that the public convenience and necessity require the reservation of an easement for public utility purposes and appurtenant structures in, on, 01" over, under, along, and across that portLoa of Cord Avenue herein described in Section 1. SECTION 3.
