HomeMy WebLinkAboutResolution No. 276 38'2 RESOLUTION NO. 276 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING ADMINISTRATIVE PROCEDURES RELATIVE TO ZONE EXCEPTIONS. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the following procedures in addition to those set forth in Chapter 1 of Article IX of the Downey Municipal Code, shall govern the •---, Planning Commission and the City Council relative to the administration of applications and appeals concerning zone exceptions: 1. After the public hearing and the discussion of the. Planning Commission, if a Commissioner moves for approval, the conditions of approval shall be formulated and written down by the staff and read into the minutes. The Chairman may call a five minute recess for this purpose. At the end of the recess the meeting will be called to order and the staff will read into the minutes the conditions of approval. (a) The Commission shall approve or disapprove the Zone Exception. 2. If the Exception is approved the fol &owing day a form letter shall be sent to the applicant and at least one person in opposition by certified mail stating only that the Planning Commission has approved the Zone Ex- ception. 3. The 15 day appeal period shall start the day the applicant signs for the certified notice. 4. Upon return of the receipt the Planning Department shall transmit a memo to the City Clerk stating the appeal period dates. 5. All appeals shall be filed in person with the City Clerk and accompanied by a deposit fee of $50.00 (fifty dollars) for 1 original and 5 copies of a transcript of the public hearing and /or cost of advertising a public hearing before the City: Council. Fees deposited are not returnable if advertising or a public hearing are required. (a) Transcript of more than 5 pages shall require an additional charge of 10 dollars per page above the first 5 pages. I (b) Only one appeal charge shall be made per case. 6. The City Clerk shall notify the Planning Department of all appeals as they are filed by duplicate copies. 7. If, with the conclusion of the appeal period, an appeal has been received, the City Clerk shall present the appeals to the City Council at their next regularly scheduled meeting. 8. The City Council will then proceed to process the case by any of the fol- lowing: ' (a) Taking final action. (b) Scheduling a public hearing. (c) Requesting transcripts. (d) Returning the matter to the Planning Commission. (1) Notice of any action taken shall be transmitted in writing by the City Clerk to the Department of Planning. SECTION 2. The City Clerk shall certify t• the adoption of this resolution.
