HomeMy WebLinkAboutResolution No. 275 380 RESOLUTION NO. 275 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING ADMINISTRATIVE PROCEDURES RELATIVE TO ZONE CHANGES. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the following procedures in addition to those set forth in Chapter 1 of Article II of the Downey Municipal Code, shall govern the Planning Commission and the City Council relative to the administration •1 of applications and appeals concerning zone changes: 1. At the time of public hearing the Planning Department shall have (a) A resolution in duplicate ready for approval, less the conditions to be required. 2. After the public hearing and the discussion of the Planning Commission, if a Commissioner moves for approval, the conditions of approval shall be formulated and written down by the staff and read into the minutes. The Chairman may calla five minute recess for this purpose. At the end of the recess the meeting will be clled to order and the staff will read into the minutes the conditions of approval. 3. If the conditions are approved they shall be placed in the resolution. The tentative resolution and the conditions will then be approved as a resolution by the Planning Commission and the resolution shall be sub- mitted to the Commission for its adoption. 4. If the resolution is adopted, the following day a form letter shall be sent to the applicant and at least one person in opposition by certified .mail stating only that the Planning Commission has approved the resolu- ticin ( by number) . 5. The 15 day appeal period shall start the day the applicant signs for the certified notice. 6. Upon return of the receipt the Planning Department shall transmit the resolution and appeal period date to the City Clerk. 7. The City Clerk shall hold the resolution for the 15 day appeal period. 8. All appeals shall be filed in person with the City Clerk and accompanied by a deposit fee of $50.00 (fifty dollars) for 1 original and 5 copies of c o advertising public t of the public hearing and/or oft f adver i in a u li atransc i rp p g / g p hearing before the City Council,, Fees deposited are not returnable if advertising or a public hearing is required. (a) Transcript of more than 5 pages shall require an additional charge of 10 dollars per page above the first 5 pages. (b) Only one appeal charge shall be made per case. 9. The City Clerk shall notify the Planning Department of all appeals as they are filed by duplicate copies. 10. If, with the conclusion of the appeal period, an appeal has been received, the City Clerk shall present the Planning Commission resolution and the appeal to the City Council at its next regularly scheduled meeting. 11. The City Council will then proceed to process the case by any of the following: (a) Taking final action. (b) Scheduling a public hearing. (c) Requesting transcripts. (d) Returning the matter to the Planning Commission: (1) Notice of any action taken shall be transmitted in writing by the City Clerk to the Department of Planning. 12. If no appeal is filed the City Clerk shall prepare an Ordinance and schedule it for the City "Council's next regular meeting. SECTION 2. The City Clerk shall certify to the -doption of this resolution. APPROVED AND ADOPTED AND this / day of ,1958.
