A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE PURCHASE OF CERTAIN PROPERTY FROM THE
DOWNEY CITY SCHOOL DISTRICT.
WHEREAS, the Downey City School District is authorized by Education Code,
Article 3.5, Section 18661, to sell real property which is not needed for
classroom purposes to another public agency, and
r( WHEREAS, the Board of Trustees does hereby find that the property described
below which is owned by the District is not now and will not at the time of
delivery - of title or possession be needed by the District for classroom build-
ings,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the following described property be sold to the City of Downey:
That block of land bounded on the south by Second Street;
on the east by Brookshire Road; on the west by Dolan Street
and on the north by the center line of Third Street, vacated.
The subject property is legally described as all of Block 16,
and the southerly 30 feet of Block 17 of the Tract of the Downey
Land Association, in the County of Los Angeles, as per map re-
corded in Book 2, page 434 of Miscellaneous Records of said
County, excepting the following described parcel which is being
retained by the School District for Administrative purposes to
wit:
Beginning at a point in the northwesterly line of Brookshire
Avenue (60 feet wide) distant northeasterly thereon 224.00 feet
from the northeasterly line of Second Street (60 feet wide);
r thence South 32 °47 West 224.00 feet; thence along said
northeasterly line of Second Street North 57 ° 14'40" West 157.00
feet; thence North 46045'20" East 175.00 feet; thence South
76 East 52.39 feet; thence North 46 °45'20" East 38.28
feet to a line that is parallel with said Second Street and
which passes through the point of beginning; thence South 57
14'40" East 56.00 feet to the point of beginning.
Subject to all covenants, conditions, restrictions, reservations, rights, rights-
of -way, and easement of record.
SECTION 2. This property is to be sold under the following conditions:
Item 1. The City of Downey shall dedicate the southerly half of Third
Street, vacated, and the District shall dedicate the northerly
half of Third Street, vacated, for public street, Such dedica-
tion is to be completed by January 1, 1959.
The City will remove the fence, gate and barricade across the west
end of Third Street, vacated.
Item 2. The present rental lease between the District and the City is to
be cancelled as of July 1, 1958, by mutual consent and agreement.
,,.. Item 3. The District is to be permitted to occupy those rooms and buildings
which it occupies at the date of completion of escrow until they are
no longer needed by the District, provided that such use will termi-
nate by January 1, 1960. In consideration of the entire rental is
paid in advance and if premises are vacated prior to Janury 1, 1960,
a refund will be made upon a monthly basis of 1 /17th of total rental.
Item 4. That the District continue to use, after January 1,1960, if neces-
sary, the warehouse- garage -shop building and utility yard until such
time as the City buys its own utility and storage yard property, and
further that the City agrees to sell to this District for District
shops and utility yards not less than one acre at City cost, and
further that the City allow reasonable extension (not less than six
months) of occupation of the present warehouse- garage -shop and yard
until the District is able to construct its own buildings on the new
site.

Item 5. The District will provide its own custodial services to its
offices. The City is to provide utilities and maintenance.
Item 6. That an escrow be entered by both parties and that such costs
be shared equally. The District will pay for title insurance.
Item 7. For this property the City will pay the Downey City School District
the sum of two hundred eighteen thousand, seven hundred - eighty -seven
dollars, and forty -two cents ($218,787.42) upon the completion of
escrow.
SECTION 3. The City Clerk shall certify to the adoption of this resolution.
