RESOLUTION NO. 252
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
RESCINDING RESOLUTION NO. 237.
WHEREAS, the City Council of the City of Downey on May 12, 1958 adopted
Resolution No. 237 whereby permission was given to the Stonewood Shopping
Center and its customers to use with access rights vested in the City in con
nection with said Shopping: Center; and
WHEREAS, after due consideration, a public hearing pertaining to said
access rights was held by the City Council on June 2nd, 1958; and
WHEREAS, it is the desire of the City Council to obtain reports from
various members of its staff and to consider fully the evidence presented
at said hearing; and
WHEREAS, it is the desire of the City Council to rescind said Resolution
No. 237 so that the entire matter of said access rights may be considered anew;
and
WHEREAS, the rescissions of such resolution is to be without predjudice
to the rights of any persons concerned with said access rights and without
predjudice to the rights of the City Council to take such action as it may
deem advisable relative to such access rights.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. Resolution No. 237 of the City Council of the City of Downey
hereby is rescinded.
SECTION 2. The City Clerk shall certify to the adoption of this resolution.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
REDETERMINING PROCEEDINGS UNDER THE MUNICIPAL IMPROVEMENT
ACT OF 1913 FOR THE ACQUISITION OF NECESSARY RIGHTS OF WAY
AND THE CONSTRUCTION OF CURB, GUTTER AND PAVEMENT IN SMALL -
WOOD AVENUE AND OTHER RIGHTS OF ItAYS.
WHEREAS, the City Council of the City of Downey on April 22, 1957, adopted
Resolution No. 74 instituting proceedings under provisions of Division 12, Streets
and Highways Code and directing preparation df a debt limit report for the acquisi-
tion of necessary rights of way and the improvement of Smallwood Avenue and other
rights of way be construction of curb, gutter and pavement, to be known as Downey
Improvement No. 4 -M ;and
Division 4 of the Streets and Highway WHEREAS ivi
� g y Code of the State of California
(known as the Debt Limit Act) requires in Section 2824 that the report be completed
and filed within one year after the date of directing preparation of the report,
and the period of one year has expired; and
WHEREAS, the County Engineer has been appointed City Engineer of the City
of Downey and will thus provide certain acts, services and forms in these pro -
ceedings; and
WHEREAS; the County of Los Angeles must be compensated by the City of Downey
for these acts, services and forms provided by its County Engineer in these pro -
ceedings; and
WHEREAS, the City of Downey will be reimbursed in whole or in part forthis
compensation from the improvement fund to be established for this improvement; and
WHEREAS, the present intent of the City Council is to redetermine proceedings
under the Municipal Improvement Act of 1913 and order iiebt limit report; now,
r--� therefore,
THE CITY COUNCIL OF THE CITY OF DOWNEY RESOLVES THAT:
1. The public interest requires the acquisition of r GS of way, and the
improvement by construction of curb, gutter and pavement in Smallwood Avenue and
other rights of way, within the district as shown, in general, on map attached
hereto.
2. The district of lands proposed to be specially assessp d to pay the cost
of said improvement shall include in general the area within the boundary of dis-
trict as indicated on said map.
3. The City proposes to pay no money toward the total cost of the improvement
from any source other than ppecial assessments upon benefited property.
4. This project shall be known as Downey Improvement No. 4 -M, Smallwood Avenue
and other rights of way.
5. The aforementioned Resolution No. 74 adopted April 22n, 1957, is hereby
rescinded.
6. The City Engineer is instructed to procure the required information and
prepare a written report upon said improvement in accordance with the provisions
of Division 4, Streets and Highway Code.

7. The City Engineer is hereby instructed to provide all necessary resolutions,
reports, plans, specifications, estimates, maps, notifications, proposal forms,
contract forms, bond forms and any other acts, services or forms necessary to com-
plete this project in accordance with the provisions of Division 12, Streets and
Highways Code, under which the proceedings are to be conducted.
8. The City of Downey will reimburse t he County of Los Angeles for all costs
incurred by'the County Engineer on this project in accordance with the General
Service Agreement.

9. The City Clerk is directed to forward one certified copy of this
reso,ion to the C Engineer.
