HomeMy WebLinkAboutResolution No. 232 ' ,` 316 RESOLUTION NO. ; A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FOR THE CONSTRUCTION OF A STREET LIGHTING SYSTEM IN STOAKES AVENUE AND OTHER RIGHTS OF WAY. (Downey Improvement No. 2) AREAS, the report, prepared pursuant to Division 4 of the Streets and Highways Code (Special Assessment Investigation, Limitation and Majority Protest Act of 1931), covering the proposed construction of a street lighting system in Stoakes Avenue and other rights of way is on file in the office of the Clerk of the City Council of the City of Downey and may be examined at said office. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY RESOLVES: SECTION 1. That the public interest, convenience and necessity require, and that it is the intention of the City Council to order, the following work to be done and improvement made to -wit: First: The Construction of a street lighting system to consist of 75 street lighting standards together with cables,. conduits, lamps, wires and other appli- ances, appurtenances and work incidental thereto, all of which is necessary for the effective operation thereof, in PAGEANT STREET i . between the northwesterly terminus of said PAGEANT STREET And BROCK AVENUE; and in SANTA GERTRUDES ROAD between the northwesterly line of BROCK AVENUE and the centerline of DOWNEY AVENUE; and in ALLENGROVE AVENUE r1 Between the northwesterly line of Lot 10, Tract No. 16548, as shown on map recorded .... in Book 422, Pages 23 and 24 of Maps and BROCK AVENUE; and in GALLATIN SCHOOL HOUSE ROAD between the southeasterly line of Lot 9, Tract No. 16287, as shown on map recorded in Book 373, Pages 1 and 2 of Maps and the centerline of LEXINGTON AND GALLATIN ROAD; and in THE FIRST ALLEY SOUTHEASTERLY OF PARAMOUNT BOULEVARD between $$LLATIN SCHOOL HOUSE ROAD and the northeasterly line of Lot 10, above mentioned Tract No. 16287; and in PARROT AVENUE between GALLATIN SCHOOL HOUSE ROAD and the northeasterly line of Lot 18, above mentioned Tract No. 16287 and in BROCK AVENUE between GALLATIN SCHOOL HOUSE ROAD and the northeasterly line of PAGEANT STREET; and in ORIZABA AVENUE between GALLATIN SCHOOL HOUSE ROAD and the northeasterly terminus of sail ORIZABA AVENUE; and in • LA REINA AVENUE between the southwesterly line of GALLATIN SCHOOL HOUSE ROAD and SANTA GERTRUDES ROAD; and in } „ a ,.. Tyl DOWNEY AVENUE in and adjacent to the intersections hereof with GALLATIN SCHOOL HOUSE ROAD and SANTA GERTRUDES ROAD; and in VISTA DEL RIO AVENUE between the northeasterly line of SANTA GERTRUDES ROAD and a line parallel with and approximately 150 feet northeasterly, measured at right angeles, from the northeasterly line of said SANTA GERTRUDES ROAD; and in r.” STAMPS AVENUE between GALLATIN SCHOOL HOUSE ROAD and a line parallel with and approximately 50 feet southwesterly, measured at right angles, from the southwesterly line of GALLATIN SCHOOL HOUSE ROAD; and in STOAKES AVENUE between a line parallel with and approximately 30 feet southwesterly, measured at right angles, from the southwesterly line of GALLATIN SCHOOL HOUSE ROAD and the northeasterly line of Lot 1, Tract No. 16098, as shown on map recorded in Book 364, Pages 19 and 20 of Maps; and in { MEL DAR AVENUE . between GALLATIN SCHOOL HOUSE ROAD and the northeasterly line of Lot 24, above- mentioned Tract No. 16098; and in * ZANAR AVENUE between GALLATIN SCHOOL HOUSE ROAD and the northeasterly line of Lot 49, abovementioned Tract No. 16098; and in LEXINGTON AND GALLATIN ROAD r"1 between the centerline of GALLATIN SCHOOL HOUSE ROAD and the northeasterly line of Lot 70, abovementioned Tract No. 16098. Second: The restoring of street surface and concrete work where such work is required by the construction of the standards and conduits. All of said work shall be performed in the streets and between the limits, hereinbefore designated, except where the plans indicate that sa.d work shall be omitted. THAT SUCH WORD OR IMPROVEMENT, IT IS ESTIMATED, WILL COST THE SUM OF FORTY- FOUR THOMANN SEVEN HUNDRED TWENTY DOLLARS ($44,720). SECTION 2. That all the work and improvements aforesaid shall be done and performed as shown on and in ac cordance with the plans and specifications therefore, filed in the office of the City Council in the City Hall in the City of Downey on the f day of .,1958. Reference is hereby made to said plans and specifications for a full and detailed description of said proposed work or improvemeAt,an d said plans and specifications shall govern for all details of the proposed work or improvement and are made a part thereof. SECTION 3. That the said contemplated work or improvement, in the opinion of the City Council is of inore than local or ordinary public benefit and the Council hereby makes the expense of said work or improvement chargeable upon a district, which district the Council hereby declares to be the district benefited by the work or improvment and to be assessed to pay the cost and expense thereof. A map of the district, indicating by a boundary line the extent of the ter- ritory included in the proposed district approved by the Council on the 0.27' day of 5/74-t0 1958 is on file in the office of the Council. Reference 1 is hereby made to the map for a full and complete description of the assessment district and the map shall govern for all details as to the extent of the assess- ment district. itudsoirs SECTION 4. That serial bonds shall be issued in accordance with Division 7, Streets and Highway Code, to represent each assessment of fifty dollars ($50.00) or more remaining unpaid for thirty.(30) days after the date of the recording of the warrant. The serial bonds shall extend over a period ending nine (9) Years from the second day of January next succeeding the next October fifteenth following their date, and shall bear interest at the rate of six (6) per cent per annum on all sums unpaid, until the whole of the principal and interest is paid. The principal sum shall become due and payable in equal annual payments on the 15th day of each November succeeding the October 15th following their date until fully paid. The first interest payment shall be payable on the 15th day of May next succeeding the April 15th or the 15th day of November next succeeding the October 15th, as the case may be, next following the date of the bonds. The following interest payments shall each be for six months interest and shall be payable on each fifteenth day of May and November, the last interest payment coming due 45 days before the last annual payment of the principal. SECTION 5. That the proc eedings for the aforesaid work or improvement shall be under and in accordance with Division 7, Streets and Highway Code. SECTION 6. The streets hereinbefore referred to are public streets in the City of Downey. SECTION 7. That it is the opinion of the City Council that the public interest will not be served by allowing the property owners to take the contract for the work to be done under these proceedings. SECTION S. That the 974- day of ,1958, at the hour of 7-' p.m., of said day, is the day an _ _hour and the Chambers of the City Council, in the City of Downey, is the place fixed by the Council when and where any and all persons having any objections to the proposed work or improve- extent of the district to be assessed, or to the proposed went or to the exte , grades to-wh p p g which the work is to be done, or to any or all of the foregoing, may appear before the Council and show cause why the proposed work or improvement should not be carried out in accordance with this Resolution. SECTION 9. That the Superintendent of Streets shall cause to be conspicuously posted along the line of the contemplated work or improvement and along all open streets within the district liable _ to be assessed, notices of the adoption of this Resolution in the manner and in the form required by law. SECTION 10. The Clerk of the City Council shall certify to the adoption of r"1 this Resolution and shall cause the same to be published for two days in the Downey Livewire , a newspaper published or circulated in the City of Downey, which is hereby designated for that purpose by the Council. The City Council does hereby direct the Clerk thereof to mail notices of the adoption of this Resolution of Intention to all persons owning real property pro- posed to be assessed for the work herein described whose names and addresses appear on the last equalized assessment roll of the County of Los Angeles or as known to the Clerk, the contents of said notices to be as required by law.
