A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING RULES AND REGULATIONS FOR GARBAGE AND REFUSE COT =T =ECTION AND DIS- POSAL, AND THE TERMS AND CONDITIONS FOR BIDS FOR GARBAGE AND REFUSE COLLECTION AND DIS- POSAL CONTRACTS, AND CALLING FOR SEALED BIDS II FOR THE SAME. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the terms and provisions of that certain Ordinance No. - r , the City Council desires to procure bids and to make and contracts for the exclusive col - lection of garbage and refuse from residential premises within certain zones in the City of Downey as established and defined by Ordinance No . 7 , as follows: . ZONE 1 Beginning at the boundary of the City of Downey at its point of contact with the city boundary of South Gate, being spe- cifically described as Gardendale Street, a distance approximately 450 feet west of Garfield Avenue and proceeding northeasterly along said city boundary of Downey through all its courses and curvatures to the most northerly city boundary of Downey described as the south right of way line of the Santa Ana Freeway; thence southeasterly along the north city boundary of Downey to the inter -. section of the centerline of Paramount Boulevard; thence south- westerly along the centerline of Paramount Boulevard to the south city boundary of Downey described as Gardendale Street; thence f northwesterly along the south city boundary of Downey to the point of beginning. ZONE 2 Beginning at the intersection of Paramount Boulevard and the south city boundary of Downey described as Gardendale Street and proceeding northeasterly along the centerline of Paramount Boulevard to its intersection,With the north city boundary of Downey described as the south right of way line of the Santa Ana Freeway; thence southeasterly along this north city boundary of Downey to its intersection with the centerline of Lakewood Boule- vard; thence southwesterly along the centerline of Lakewood Bou- levard to the most southerly city boundary of Downey described as i the intersection of Lakewood Boulevard and Century Boulevard; a thence along the southerly city boundary of Downey with its mutual contact with the City of Paramount in its northwesterly, northeast- erly and northwesterly routes to the point of beginning at the intersection of Paramount Boulevard and Gardendale Street. ZONE 3 Beginning at the intersection of Lakewood Boulevard and Gardendale Street and proceeding northeasterly along the center- l ine of Lakewood Boulevard to the northerly city boundary of Downey described as the south right of way line of the Santa Ana Freeway; thence southeasterly along the northerly city boundary 17 3 of Downey to the most easterly citylitoundary of Downey described as the east right of way line of the San Gabriel River; thence southerly and south- westerly along the courses and curvatures of the east line of the San Gabriel River to the southerly boundary of the City of Downey described as Foster Road; thence westerly along the south right of way line of Foster Road (existing and proposelVthrough all its courses and curvatures to the point of beginning at the intersection of Lakewood Boulevard and Gardendale Streets. SECTION 2. Notice is hereby given that on September 19th,1957, in the Council Chambers of the Downey City Hall, sealed bids submitted to the: Clerk on or before 10:00 o'clock a.m. September 10th,1957, will be publicly opened by the City Clerk and declared and presented to the City Council for action at or after 8:00 p.m. on said date. The City Council, if it accepts any bid, will accept the bid of the highest and best bidder, as determined by the City Council, for each of the districts within the city. No bidder will be awarded a contract for more than one district. The City Council may reject any or all bids. Past performance, reputation and ability to provide the best service to the citizens of Downey shall be of primary consideration in the awarding of the contracts. SECTION 3. Each bidder by so bidding agrees if his bid is accepted to abide by all of the conditions, rules and regularions set forth in Ordinance No. 47, and all conditions, rules and regularion of this resolution, and all terms , covenants and conditions of a contract to be entered into between the city and the contractor consistent with said Ordinance No. 47, this resolution and siad bid. The City Council hereby establishes the following additional conditions , rules and regulations, to wit: n (1) Terms. The contract for each zone shall be from October 1, 1957 to and through October 1, 1960, provided, however , that either party may terminate the same upon 180 days written notice to the other party. (2) Rate or Fee. The monthly rate or fee to be paid by the occupier of the place or premises, other than places of business, commercial or industrial, where garbage or refuse are desired by said occupier to be collected shall not exceed $1.00 per month for single family dwelling units and for multiple dwelling units shall not exceed $1,00 per month for the first unit and 35 cents a month for each additional unit. (3) City Not Responsible. The City shall not be responsible for the collection of any sums due the contractor in providing said service nor does the city guamantee or warrant payment to the contractor for said services in any way whatsoever. (4)c Contracts. The contractor shall make all agreements for the col- lection and disposal of garbage and refuse with the occupant of single family residential premises and with the owner or person in charge of all multiple family residential premises . Such agreements shall be made independent of any help or assistance of the city and payments, as provided in said contract, s1ii4 be collected by the contractor from the person with whom the contract is made. 174 Qc (6) Pick Up. Garbage shall be picked up twice each week; and refuse shafl be picked up once each week. There shall be no pick up on Sunday. Hours of collection from any residen- tial premises shall be between 7:00 A.M. and 5:00 P.M. c (:r) Employees and Wages. The contractor shall comply at all times with the minimum wage and child labor laws, and shall at all times pay employees the prevailing union scale of wages. C6 Refuse Materials to be Collected and Disposed of. The contractor agrees to collect and dispose of, in quantities equal to a weekly accumulation, the following items from each residential premises contracting with said contractor for the col- lection and disposal of the same as provided in Ordinance No. 977 and this resolution. (a) Grass clippings (b) Wire (c) Plaster and stucco remnants not to exceed fifty (50) pounds per week (d) Paper (e) Flower trimmings (f) Tree, bush, brush and plant trimmings, including branches and limbs when cut and stacked into neat, compact bundles (g) Broken toys and children's vehicles (h) Garbage (i) Garden hose (j) Dirt and rocks not to exceed fifty (50) pounds per week (k) Magazines (1) Bricks not to exceed thirty (30) pounds per week (m) Tin cans (n) Broken glass, bottles and related materials (o) Lumber not to exceed forty (240) pounds per week (p) Ordinary home and garden tools including lawn mowers and edgers (q) Cardboard boxes (r) Apple, potato, fruit and vegetable and related wooden boxes (s) Water heaters (t) All types of household furniture and fittings exclusive of pianos (u) Dead animals when necessary or when requested by the city 175 ( Disposed of. The contractor shall dispose of said garbage and refuse at sites or places where lawful and the city shall not be liable for the disposal of the same or to provide sites or places for the disposal of the same. SECTION 4. Each bid shall be presented to the City Clerk in a sealed cover and contain bidder's name and address on cover identifying it as "Garbage and Refuse Disposal Bid", and: (1) Name and address of bidder. (2) If a firm, partnership or corporation, the name of said firm, partnership or corporation and the names and addresses of all members or officers of the same. (3) The zone bid upon. (4) The amount the bidder will pay for the exclusive contract with the city. r-, (5) Th. bidderts security as required by Ordinance No. (6) The covenant and agreement of the bidder to con- form to and perform all conditions of Ordinance No. , of this resolution and of the contract rnad P ursuant to this resolution and said Ordinance No. (7) The number of refuse trucks to be used in each zone and the make, year, description and license number of all such trucks used in each zone. (8) The number of garbage trucks to be used in each zone and the make, year, description and license number of all such trucks used in each zone. (9) Routes by streets to be followed in each zone. (10) Days and approximate hours for service in each zone on each route in said zone. Submitted to the Director of Public Works 15 days after award - ing of contract. (11) Previous operational experience. (12) Any additional information. 176 SECTION 5. The City Clerk is directed to post this resolution in three public places and to mail a copy of this resolution to all persons who have inquired of the city concern- ing garbage and refuse contracts, and to all persons having a license with the city to collect garbage or refuse. The City Clerk is also directed to see that this resolution receives pub- licity in the local newspapers. r•-■ SECTION 6.
