HomeMy WebLinkAboutResolution No. 110 r 119 RESOLUTION NO. 110 PROPOSED SALARY RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, PROVIDING FOR THE NUMBER, TITLES, CLASSIFICATION, AND COMPENSATION OF OFFICERS AND EMPLOYEES; AND ADOPTING THE CLASSIFICATION PLAN AND THE PAY PLAN. WHEREAS, a Classification Plan for the classification of positions in the Classified Service of the City of Downey, with Class Titles and Class Title Numbers, has been recommended by the City Manager; and, WHEREAS, the City Manager has allocated every position in the Classified Service to an appropriate class established by the Classi- fication Plan; and, WHEREAS, a Pay Plan has been recommended by the City Manager, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Downey that the Classification Plan and Pay Plan be approved and adopted, and that the allocation of positions be approved and made as herein provided. BE IT FURTHER RESOLVED by said City Council as follows: ARTICLE I THE PAY PLAN SECTION 1: STEP PLAN. The Pay Plan includes a salary step plan consisting of 35 schedules of salary ranges consists of five o-., scheduled amounts or steps of monthly compensation; and each of said ranges is designated by a number herein named the Schedule Number. The step plan and schedules of ranges, steps and schedule numbers are approved and adopted to become effective July 1, 1957. SECTION 3: HOURLY RATES OF COMPENSATION. The hourly rate of compensation for payroll purposes shall be computed on the basis of twelve times the monthly rate divided by fifty -two times the number of working hours per week for the position for which such hourly rate is computed. Hourly rates for positions designated in Section 7 of this resolution as "per hour" positions shall be computed on the basis of a forty hour week unless otherwise noted. J 121 SECTION 4: Persons employed for temporary and emergency purposes, which are not otherwise provided for in this resolution, shall be designated as "Emergency Help" and shall be compensated at a salary rate provided for in the step plan and consistent with the provisions of this resolution. SECTION 5: SPECIAL RATES OF COMPENSATION. The Pay Plan includes r special rates of compensation for certain officers and employees who are not compensated on the basis of the step plan. Said rates of compensation are named Special Compensation and are approved and adopted as the rates of compensation of the officers and employees to who such rates are applicable, as follows: ITEM CLASS TITLE NO. TITLE OF POSITION SALARY 1 a'.7 CITY MANAGER $17,500. per annum 2 C -5 CITY ATTORNEY 600. per month (Part Time) SECTION 5A:z SPECIAL RATES OF COMPENSATION: POLICE DIVISION: FIREARMS TRAINING AND ADDITIONAL COMPENSATION FOR MARKSMANSHIP. Employees of the Police Division who may be called upon to use firearms in the performance of the duties to which they are or may be assigned shall: (a) As directed by the Police Chief fire the prescribed combat or target course once a month for a minimum of 10 months per fiscal year. Any employee failing to fire as herein required may be fined one day's pay upon the recommendation of the Police Chief and approval of the City Manager. In addition to the required number of courses the Police Chief may require a minimum point qualification for both combat and target courses which he deems necessary to insure 0- 1 proficiency of such employees and may require any such employee who within the past year has not attained the minimum point qualification to take additional firearms training. This section does not restrict personnel action by the Police Chief. (b) Receive additional compensation each month for marks- manship as herein provided. Such additional compensation shall be in the following amounts and based on the following scale of proficiency as demonstrated upon the approved firearms target type course: Marksman $2.00 per month 300 to 339 Sharpshooter $4.00 per month 340 to 369 Expert $6.00 per month 370 to 384 Super Expert $8.00 per month 385 to 440 An employee shall receive the additional compensation only for the 12- month period immediately following his demonstration of proficiency as herein provided to the satisfaction of the Police Chief and the certifi- cation of such proficiency to the City Controller. The Police Chief shall determine the firearms course. The determination of the Police Chief on all scoring is final and conclusive. P" SECTION 5B: SPECIAL RATES OF COMPENSATION. OVERTIME WORK AND COURT TIME. "Overtime work" and "court time" defined. (a) Overtime work. Overtime work is work performed by an employee compensated on a monthly basis at times other than those normally required for his employment. Any other provision of this article notwithstanding, any dispute or question of fact as to what times are normally required for the employment of any person shall be decided by the City Manager, and his decision shall be final. . 122 • (b) 'Court time. Court time is time required and spent by a safety member of the police division in attending in response to a sub- poena, a coroner's inquest, or a hearing or trial in a civil action on be- half of the City, or criminal case at a time other than that regularly required of such employee for his employment for the purpose of testifying as to his knowledge acquired by such employee in the course of his employ- ment with the City. SECTION 5C: SPECIAL RATES OF COMPENSATION. Approval by City Manager required. It is the policy of the City that overtime work is to be discouraged. However, in case of emergency or whenever the public interest or necessity requires, any department or division head may require any employee in such department or division to perform overtime work. No employee shall be required to perform overtime work except upon the approval of the City Manager filed with the Finance Director. Such approval must be given prior to the performance of the overtime work except when per - formed in an emergency to prevent loss of life or injury or damage to person or property. No employee shall be compensated for overtime work in any manner unless approved as provided in this section. SECTION 5D: SPECIAL RATES OF COMPENSATION. Compensation for overtime work and Court Time. (a) Compensation for overtime. Employees compensated on a monthly basis shall be compensated for approved overtime work by addition- al pay at an hourly rate equal to the regular hourly rate of such employee provided, however, that upon the recommendation of an employee's division head and the approval of the City Manager, such employee may be compensated for approved overtime work by a leave of absence with pay for a period equal to the time during which such overtime work was performed. Leaves of absence for overtime shall not exceed twenty working days in any calendar year, except where the City Manager upon substantial evidence finds that the leave of absence is compensation for overtime work necessar- ily performed due to an emergency; provided, that a leave of absence , ', shall not exceed five additional days for any one emergency. (b) Compensation for court time. Any safety member of the police division shall be compensated for court time as follows: He shall be paid at the applicable hourly rate, or with the approval of the police chief he may in lieu of pay accumulate any portion of his court time and take an equivalent leave of absence. Such member shall be entitled to necessary transportation expense in connection with his court time. He shall obtain from the person causing him to be subpoenaed mileage and other fees allowed by law. Compensation for transportation and the payments herein specified shall be reduced by the amount of mileage fees and other fees paid such member by or on behalf of the person causing him to be subpoenaed. The accumulation of court time shall be limited to the number of hours earned for which such member has not been compensated at the applicable hourly rate by pay or by fees paid to him by or on behalf of the person causing him to be subpoenaed. Payments under this section shall be monthly for the previous month. The police chief shall by the tenth of each month make a report to the Finance Director listing the members earning benefits under this section. Such reports shall indicate the court time each member earned in the previous month, the transportation expense incurred in connection therewith, whether he has elected to receive equivalent leave of absence, and the amount of fees paid such member by or on behalf of the person causing him to be subpoenaed. SECTION 5E: SPECIAL RATES FOR COMPENSATION. Motorcycle officers shall receive 10% above base pay for hazardous duty. Crossing guards shall be paid at the mte of $1.65 per hour. ARTICLE II THE CLASSIFICATION PLAN 1 123 SECTION 6: The Classification Plan is hereby approved and adopted.
