A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL
ELECTION HELD IN SAID CITY OF DOWNEY ON THE 5Th DAY OF
MAY, 1998, DECLARING THE RESULT THEREOF AND SUCH
OTHER MATTERS AS ARE PROVIDED BY LAW
WHEREAS, a Special Municipal Election was held and conducted in the City of Downey,
California, on Tuesday, May 5, 1998, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided by
law; that voting precincts were properly established; that election officers were appointed; and
that in all respects, the election was held and conducted and the votes were cast, received and
canvassed and the returns made and declared in time, form and manner as required by the
provisions of the Elections Code of the State of California for the holding of elections in charter
cities; and
WHEREAS, pursuant to Resolution No. 6153 adopted March 24, 1998, the City Clerk of
the City of Downey canvassed the returns of the election and has certified the results to this City
Council, the results are received, attached and made a part hereof as "Exhibit A."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
RESOLVE AS FOLLOWS:
SECTION 1. That there were 20 voting precincts established for the purpose of holding
said election consisting of consolidations by the City Clerk of the City of Downey of the regular
election precincts in the City of Downey.
SECTION 2. That said Special Municipal Election was held for the purpose of
submitting the following questions to the voters of the City of Downey:
CHARTER AMENDMENT NO. 11: Shall a Charter amendment proposed by the
Downey City Council which requires authorization through an affirmative advisory
vote by not less than two- thirds of the voters at a general municipal election in
order to permit an alternative to providing through its own staff for police and fire
departments, be adopted?
CHARTER AMENDMENT NO. 12: Shall a Charter amendment proposed by the
Downey City Council which requires that any proposed amendment to the City
Charter on the same subject matter shall not be voted upon twice within any
12 -month period at any special or general municipal election, be adopted?
SECTION 3. That the whole number of ballots cast in the precincts except absentee
voter ballots and provisional ballots was 3,567.
That the whole number of absent voter ballots cast in the City was 1,913, and the whole
number of provisional ballots cast was 21; making a total of 5,501 ballots cast in the City.

SECTION 4. That the number of votes given at each precinct and the number of votes
given in the City for each of the ballot measures were as listed in Exhibit "A."
SECTION 5. That the City Council does declare and determine:
That as a result of the election, a majority of the voters voting on Charter Amendment
No. 11 did vote in favor of it, and the measure is deemed adopted and ratified.
That as a result of the election, a majority of the voters voting on Charter Amendment
No. 12 did vote in favor of it, and the measure is deemed adopted and ratified.
SECTION 6. That the City Clerk shall attach and make a part hereof as "Exhibit B" a
statement of the results of the votes given at each precinct.
SECTION 7. That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions of the City.
