SUBJECT: Adoption of an Ordinance Prohibiting Smoking in City Parks, Except
in Designated Areas, and During City-Sponsored Events
RECOMMENDATION
City Council to review the attached ordinance and thereafter adopt:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING
ARTICLE X CHAPTER 1 OF THE DOWNEY MUNICIPAL CODE BY ADDING
SECTION 10128 TO PROHIBIT SMOKING IN PUBLIC PARKS AND DURING CITY-
SPONSORED EVENTS, EXCEPT IN DESIGNATED AREAS
BACKGROUND
On October 25, 2011, the City Council discussed a proposal brought forth by Council
Member Fernando Vasquez on whether or not to prohibit smoking in city parks and at
city-sponsored events. During this meeting, the City Council received substantial public
comments on this proposal. At the conclusion of the discussion, the Council directed
that an ordinance be prepared that would prohibit smoking in city parks, and city-
sponsored events, except in designated areas.
On November 8, 2011, the Council discussed the ordinance after considering extensive
public comment. The ordinance was introduced by the Council with minor changes
which were read into the record. Direction was given to staff to provide waste
receptacles in the designated smoking areas.
DISCUSSION
Ordinance. The ordinance contains the following elements:
I.City Parks.
A. Smoking is prohibited in City Parks, except in designated areas.
B. City Parks is defined as “any outdoor area, owned or operated by the City of
Downey which is open to the general public for primarily recreational
purposes, regardless of any fee or age requirement, including, but not
limited to, picnic areas, playgrounds, sports or athletic fields, walking paths,
gardens, hiking trails, bike paths, skateboard parks and dog parks”.
CITY OF DOWNEY, CALIFORNIA
A City Park does not include a golf course, any paved public sidewalk
immediately abutting the boundary of a City Park, or any parking area
within the boundaries of a City Park.
C. “No Smoking” signs are required to be posted at the entrances of all City
Parks and throughout the park, as needed.
D. “Smoking” signs will be posted to designate the area in a City Park where
smoking is permitted.
Once the Ordinance has been adopted, City staff will study each of the City Parks
covered by the Ordinance, and determine the appropriate area to designate for
smoking.
II.City-sponsored Events.
A. Smoking during any city-sponsored event is prohibited, except in areas
designated for smoking by city staff. Smokers may still smoke in designated
areas of a City Park if the city event takes place in a City Park.
B. City-sponsored events is defined as an event in which the City of Downey
plans, administers, coordinates and finances, and which is held on City-
owned property. This would cover the “Taste of Downey”, and other city
events taking place on city-owned property outside of the parks.
City staff has the option of posting temporary signs or making periodic
announcements during a city event reminding attendees that smoking is
prohibited.
III.Enforcement.
A. A violation of the ordinance is an infraction.
There are various cost-effective approaches that can be utilized to enforce this
new Ordinance. Prior to issuing an infraction citation, and depending on a given
situation, both police officers and park staff have the discretion to simply warn an
individual that he/she is violating the Ordinance and ask that he/she stop smoking.
It is expected that such an approach will in most cases result in compliance with
the Ordinance.
In the alternative, and depending on a given situation, police officers have the
discretion to issue an infraction citation or to issue an administrative citation. An
infraction citation results in a $35 fine plus court-imposed penalty assessments
which amounts to a fine of approximately $250-$300 (depending on the amount of
the penalty assessments). The administrative citation is a flat rate fine of $100
and is handled administratively through a contractor that provides the city with
citation management services for its administrative citation program.
2
Once the Ordinance has been adopted, Police Department staff and the City
Attorney will discuss these enforcement options to identify the best cost-effective
approach to achieve compliance with the Ordinance.
FISCAL IMPACT
The City will receive some revenue from the payment of fines if infraction or
administrative citations are issued, but the amount is expected to be minimal.
