Prop 84 River Parkways Grants AGENDA MEMO DATE: September 27, 2011 TO: Mayor and Members of the City Council FROM: Office of the City Manager By: Shannon DeLong, Assistant to the City Manager SUBJECT:AUTHORIZATION TO SUBMIT APPLICATIONS FOR THE CALIFORNIA RIVER PARKWAYS GRANT PROGRAM UNDER PROPOSITION 84 RECOMMENDATION That the City Council adopt: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING SUBMITTAL OF APPLICATIONS FOR ALL GRANT FUNDS FOR THE CALIFORNIA RIVER PARKWAYS GRANT PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 FOR WHICH THE CITY OF DOWNEY IS ELIGIBLE, AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE ALL GRANT DOCUMENTS DISCUSSION The State of California’s Natural Resources Agency is soliciting applications for the California River Parkways Grant Program under the Safe Drinking Water, Water Quality and Supply, Flood Control River and Costal Protection Bond Act of 2006, also known as Proposition 84. The River Parkways Grant Program is intended to fund projects that involve natural creeks, streams, and/or rivers, channelized or culverted creeks, and streams and/or rivers. Projects must also involve two of the following criteria: recreation, habitat, flood management, conversion to River Parkways and Conservation and Interpretive Enhancement. A resolution authorizing submission of applications is required. If awarded, grant funds will be used to make several upgrades to Wilderness, Crawford and Furman Parks, such as adding exercise equipment and walking trails, upgrading irrigation systems, replacing or expanding picnic shelters or restroom buildings, planting drought tolerant/native landscaping and other eligible improvements. This is the final round of the Prop 84 River Parkways Grant Program, and $30 million is available for awards. FISCAL IMPACT There is no impact on the City’s General Fund. Funds received from the grants will provide resources and materials for previously-budgeted projects and future projects. Attachment: Resolution CITY OF DOWNEY, CALIFORNIA RESOLUTION NO.______ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING SUBMITTAL OF APPLICATIONS FOR ALL GRANT FUNDS FOR THE CALIFORNIA RIVER PARKWAYS GRANT PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 FOR WHICH THE CITY OF DOWNEY IS ELIGIBLE, AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE ALL GRANT DOCUMENTS WHEREAS , the Legislature and Governor of the State of California have provided funds for the program shown above; and WHEREAS , the California Natural Resources Agency has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS , said procedures established by the California Natural Resources Agency require a resolution certifying the approval and application(s) by the Applicants governing board before submission of said application(s) to the State; and WHEREAS , the Applicant, if selected, will enter into an agreement with the State of California to carry out the project. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Approves the filing of applications for the Wilderness, Crawford, and Apollo Park projects. SECTION 2. Certifies that Applicant understands the assurances and certification in the application; and, SECTION 3. Certifies that Applicant or title holder will have sufficient funds to operate and maintain the projects consistent with the land tenure requirements; or will secure the resources to do so; and, SECTION 4. Certifies that it will comply with all provisions of Section 1771.5 of the California Labor Code; and SECTION 5. If applicable, certifies that the project will comply with any laws and regulations including, but not limited to, the California Environmental Quality Act (CEQA), legal requirements for building codes, health and safety codes, disabled access laws, and that prior to commencement of construction, all applicable permits will have been obtained; and, SECTION 6. Certifies that applicant will work towards the State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1; and SECTION 7. Appoints the City Manager or his designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project(s). SECTION 8 . The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this ____day of __________________, 2011. ______________________________ LUIS H.
