04. Water Mgmt-Pollution
AGENDA MEMO DATE: September 27, 2011 TO: Mayor and Members of the City Council FROM: Office of the City Manager By: John Oskoui, P.E., Director of Public Works SUBJECTFY 2011/12 PROFESSIONAL SERVICES AGREEMENT FOR : STORMWATER PROGRAM MANAGEMENT AND NPDES/MS4 PERMIT COMPLIANCE AND PLAN CHECK SERVICES RECOMMENDATION That the City Council authorize the Mayor to execute a Professional Services Agreement with John L. Hunter and Associates, Inc. (JLH), for a period of up to one (1) year for NPDES/MS4 Permit Compliance and Plan Check Services. BACKGROUND The City is required to implement the adopted Los Angeles County National Pollution Discharge Elimination System Permit (NPDES Permit No. CAS004001), which regulates discharge of Stormwater and urban runoff in Los Angeles County into Municipal Separate Storm Sewer Systems (MS4). Under this permit, Los Angeles County has developed five model programs, which must be followed for compliance with the NPDES Permit. The City must continue implementing these programs and preparing annual status reports for submittal to the Regional Board. For the past several years, City staff has implemented these programs and prepared and submitted the annual reports, however, due to staffing changes, City staff will no longer have the ability to continue providing these services. DISCUSSION The City has an ongoing obligation to comply with the Los Angeles County NPDES Permit No. CAS004001 which was issued by the Regional Water Quality Control Board (RWQCB) in 2001 to Los Angeles County as the Principal Permittee and eighty-four cities as co-permittees, including the City of Downey. The Permit expired on December 13, 2006, and is expected to be renewed in spring of 2012. Both the NPDES Permit No. CAS004001. (Waste Discharge Requirements for Municipal Stormwater and Urban Runoff Discharges), and the Downey Municipal Code prohibit the discharge, or the potential for discharge, of pollutants and illicit substances into the City's streets and/or storm drain system. The storm drain system, into which pollutants may discharge, flows directly to rivers and eventually the Pacific Ocean without treatment. Staff anticipates that the new NPDES Stormwater Permit will be substantially different than the expired permit. Additionally, staff anticipates that the new Permit will include numerical limits for pollutants, such as trash and metals, with a bacteria limit soon to be adopted. These CITY OF DOWNEY, CALIFORNIA Mayor and Members of the City Council FY2011/12 Professional Services Agreement for Stormwater Program Management and NPDES/MS4 Permit Compliance and Plan Check Services September 27, 2011 Page 2 new requirements are referred to as Total Maximum Daily Loads (TMDL), which are essentially the total amount of the contaminate that a body of water can contain before it becomes harmful to aquatic life. Due to the complexity of State mandates for the NPDES Stormwater Permit and recent staff changes, and in order to continue to implement Municipal Stormwater Best Management Practices (BMPs) as called for in the MS4 Permit and the City’s Stormwater Quality Management Plan (SQMP), it is necessary to secure the services of a qualified environmental consultant with the expertise and experience to support the City by performing the following tasks/activities: Stormwater Quality Management Plan (SQMP) Activities Identifying Illicit Connections and Illegal Discharges to Storm Drains Performing Development Planning and Construction Plan Checks Providing City Staff Training Performing Industrial and Commercial Inspections Providing Public Outreach Preparing Total Maximum Daily Loads (TMDLs) Reports JLH is highly qualified to provide the City with said professional services, based upon relevant experience, understanding of the local, regional and national stormwater issues, demonstrated knowledge of the Scope of Work, and staff availability to provide the services in an expeditious manner. JLH provides similar services to numerous cities in the region providing excellent client service and very sound representation. As such, staff requests that the City Council approve a sole-source agreement with John L. Hunter and Associates, Inc. A copy of the Professional Services Agreement, and Proposal which includes the Scope of Work, and Project Budget are attached. FINANCIAL IMPACT The cost to the City for services provided by JLH is $80,080. The Fiscal Year 2011-12 budget includes sufficient funds for the $80,080 cost to complete the activities required. In order to execute the Agreement, the following amount will need to be appropriated from account number 51-3550-0700. Attachments: Exhibit “A” – John L Hunter, Inc.
