RESOLUTION NO. 11-2733 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN-11-00220 (SPECIAL EVENT PERMIT), THEREBY ALLOWING A FOOD TRUCK RALLY WITHIN THE PARKING
LOT OF STONEWOOD CENTER ON PROPERTY LOCATED AT 251 STONEWOOD ST, ZONED SP 89-1 (STONEWOOD SPECIFIC PLAN) THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION
1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. On August 25, 2011, the applicant submitted a request for a Special Event Permit (PLN-11-00220),
requesting to conduct a food truck rally on the subject site; and, B. On September 1, 2011, the Special Event Permit application was deemed complete; and, C. On September 8, 2011, notice
of the pending application was mailed to all property owners within 500’ of the subject site and published in the Downey Patriot. Furthermore, the notice was mailed to all property owners
within 500’ of the subject site on September 9, 2011; and, D. The Planning Commission held a duly noticed public hearing on September 21, 2011 and after fully considering all oral and
written testimony and facts and opinions offered at the aforesaid public hearing adopted this resolution, subject to conditions of approval (Exhibit A). SECTION 2. The Planning Commission
further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to be in compliance with the California Environmental
Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15304 (Class 4, Minor Alterations to Land). SECTION 3. Having considered all of the oral and
written evidence presented to it at said public hearings, the Planning Commission further finds, determines and declares that: 1. That the proposed activity or use will be consistent
with the objectives, policies, and general land uses and programs specified in the City’s General Plan. The subject site has a General Plan Land Use Designation of General Commercial,
which according to the General Plan is intended to provide a full range of commercial uses including shopping centers, automobile dealerships, and hotels. These types of uses are meant
to not only serve the immediate community, but provide access to goods and services for the region. The proposed food truck rally draws its customers from beyond the City’s borders by
utilizing social media to attract consumers from the entire region. Additionally, it is anticipated that 1,000 people will attend this event each day, which will provide exposure and
additional business to the tenants of the Stonewood Center. 2. That the proposed activity or use is consistent with other provisions of Article IX of the Downey Municipal Code. The proposed
special event will be located within the easterly parking lot of Stonewood Center. The event will utilize gourmet food trucks that are parked on the site during the event only. This
location of the event will not hinder on site movement and there is sufficient parking to accommodate the event.

in conditions or circumstances contrary to the public health, safety, and general welfare. The food truck rally is temporary in nature, and will not result in impacts to surrounding
properties. Furthermore, several conditions of approval to address potential trash, noise, and life safety issues created by the event have been included in this approval. SECTION 4.
Based upon the findings set forth in Sections 1 through 3 of this Resolution, the Planning Commission of the City of Downey hereby approves Special Event Permit (PLN-11-00220), subject
to conditions of approval attached hereto as Exhibit A, which are necessary to preserve the health, safety and general welfare of the community and enable the Planning Commission to
make the findings set forth in the previous sections. The conditions are fair and reasonable for the accomplishment of these purposes SECTION 5. The Secretary shall certify the adoption

PLANNING 1) The approval of Special Event Permit (PLN-11-00220) permits the operation of a food truck rally within the parking lot of Stonewood Center on the following days: October
16 & 17; October 29 & 30; November 12 & 13, 2011. 2) Approval of this Special Event Permit shall not be construed to mean any waiver of applicable and appropriate zoning regulations,
or any Federal, State, County, and City laws and regulations. Unless otherwise expressly specified, all other requirements of the City of Downey Municipal Code shall apply. 3) The City
Planner is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would
strict compliance with said plans and conditions. 4) All conditions of approval set forth in this resolution shall be complied with before the Special Event Permit becomes valid. 5)
The food truck rally shall only occupy the parking lot on the eastern side of the site, between Sears and Woodruff Avenue. 6) Only Gourmet Food Trucks shall be permitted to sell at the
event. There shall be no push carts, retail sales, or other types of vendors permitted. 7) The event shall only operate between 11:00 a.m. and 7:00 p.m. 8) Amplified music may be permitted,
provided the following provisions are adhered to: a) Speakers shall be pointed away from the residences on Woodruff Ave b) No standalone generator shall be used. Power shall be drawn
from adjoining businesses. c) Music shall cease at the request of the Police Department, which shall be based on the Police Department receiving complaints about noise. d) Music shall
be limited to DJ only. There shall be no bands, karaoke, or patron participation. 9) The area between food trucks, where attendees are congregating shall be barricaded to prevent vehicles
from driving through the area. 10) Trash cans shall be provided through out the event. Trash cans shall be emptied on regular basis to avoid accumulation of trash on the site. At the
conclusion of each day’s events, the operators of the event or the mall shall ensure all litter is cleaned from the site. 11) Vehicle and pedestrian access to the site shall not be blocked
at any time. FIRE 12) A 25’ emergency access shall be maintained to all portions of the event. 13) All food trucks shall maintain a minimum 30’ from any structure.
