PLANNER SUBJECT: CONSENT CALENDAR ITEM #1 A request for a one-year time extension for Site Plan Review No. 09-71, an application for a 6-story, 50-unit apartment development (View Apartments)
at 8214 2nd Street, zoned Downtown Specific Plan. RECOMMENDATION That the Planning Commission adopt a Minute Action approving the requested one-year time extension for Site Plan Review
Application No. 09-71. CODE AUTHORITY Downey Municipal Code Section 9820-06(j)(3) DISCUSSION Staff received a letter from the applicant for Site Plan Review No. 09-71 (see attachment),
asking for a one-year time extension for the project, also known as the View Apartments. The Planning Commission approved Site Plan Review No. 09-71 on October 20, 2010, which was for
a 6-story, 50-unit multi-family affordable apartment development at 8214 2nd Street. The project site totals .52 acres, or 22,540 square feet and it’s located downtown on the south side
of 2nd Street, about a half block east of Downey Avenue. Planning Commissioners may have noticed that a demolition firm recently razed the building that formerly occupied the project
site in order to make way for the View. As the attached letter indicates, the applicant (National CORE) is seeking a one-year extension for Site Plan Review No. 09-71, which is permitted
under Zoning Ordinance Section 9820.06(j)(3). According to the code section, a Site Plan Review Permit is subject to revocation, unless the construction authorized by the entitlement
has been submitted to plan check within one (1) year after the permit is granted and pursued diligently to completion. The code section further stipulates that the Planning Commission
may extend that time period for one (1) year if the applicant submits a written request showing cause why the extension is necessary, but in no case shall the extension exceed one (1)
year. According to National CORE’s request, the delay in starting construction is due to a funding shortfall. The applicant was successful in obtaining financing from the City of Industry
housing funds for the bulk of the project, but unsuccessful in securing an allocation of Federal Income Housing Tax Credits for the balance. National CORE, however, intends to restructure
their tax credit application and resubmit it in the first round of 2012. On a related note, the applicant has completed the project’s architectural plans. Attachment: Letter dated September
