HomeMy WebLinkAbout5a-9441 Washburn Rd PLN-11-00021 (Res) RESOLUTION NO. 11-2707 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN-11-00021 (CONDITIONAL USE PERMIT), A REQUEST TO OPERATE AN AMBULANCE STORAGE AND COMMUNICATIONS CENTER ON PROPERTY AT 9441 WASHBURN, ZONED M-2 (GENERAL MANUFACTURING) THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. An application was filed by Daniel Graham, (hereinafter "applicant") requesting PLN-11-00021 (Site Plan Review & Conditional Use Permit) to permit the operation of an ambulance storage and communications facility, on property at 9441 Washburn Road, zoned M-2 (General Manufacturing) (hereinafter “subject property”) (AIN 6284-025-020); B. On March 25, 2011, notice of the public hearing was sent to all property owners within 500’ of the subject site and the notice was published in the Downey Patriot; and, C.The Planning Commission held a duly noticed public hearing on April 6, 2011 and, after fully considering all oral and written testimony and facts and opinions offered at aforesaid public hearings, adopted Resolution No. 11-2707, subject to conditions of approval (Exhibit A). SECTION 2. The Planning Commission further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to be in compliance with the California Environmental Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing Facilities). SECTION 3. Having considered all of the oral and written evidence presented to it at said public hearings, the Planning Commission further finds, determines and declares that: A. That the requested conditional use permit will not adversely affect the purpose and intent of this chapter or the City’s General Plan or the public convenience or general welfare of persons residing or working in the neighborhood thereof. The subject site is located within the M-2 zone (General Manufacturing) and has a General Plan Land Use Designation of “General Manufacturing”. It is the intent and purpose of the Land Use Designation to provide development of general manufacturing, wholesales, warehousing, and similar uses within the community. Allowing the ambulance business at the subject site would be in consistent with the surrounding industrial uses. Activities of the proposed ambulance business, with the conditions of approval, will not impact the welfare of the nearby residential uses. B. That the requested use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. The requested use will not affect neighboring land uses due to the nature of the use and the manner in which the development housing the ambulance business is oriented and designed. Specifically, the main entrance to the building is oriented toward the driveway on the east side of the building, while the residential Resolution No. 11-2707 Downey Planning Commission uses locating on the south side of Washburn Road. Also, several other existing industrial businesses are bordering to the subject site. Accordingly, staff has prepared a list of conditions of approval to mitigate any potential adverse impacts to the adjoining properties (see Exhibit A – Conditions). C. That the size and shape of the subject property proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area. The size and shape of the subject property is adequate to accommodate the requested use. The proposed use will be contained within an existing tenant space and does not require any expansion to the physical size of the building. The property measures 44,416 square feet with a width of 184.3 feet along Washburn Road and a depth of 241 feet, which exceeds the minimum requirements of the Downey Municipal Code. D.That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways in the area. Washburn Road serves the project site. It is classified as a “Collector” street on the City’s Master Plan of Streets and Highways. Collector streets are intended to provide access to arterial roads and highways from local streets. Washburn Road contains one lane in each direction. It is staff’s opinion that it would be able to absorb any additional traffic the requested use may create. The traffic generated by the proposed use will not impose an undue burden upon the streets in the area due to the size of the project. SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution, the Planning Commission of the City of Downey hereby approves PLN-11-00021 (Conditional Use Permit), subject to conditions of approval attached hereto as Exhibit A, which are necessary to preserve the health, safety and general welfare of the community and enable the Planning Commission to make the findings set forth in the previous sections. The conditions are fair and reasonable for the accomplishment of these purposes. SECTION 5. Deviations or exceptions from said site plan, other than those authorized by this resolution or those that do not impact other conditions, shall not be permitted without the approval of the Downey Planning Commission. 2) The permitted hours of operation of the ambulance business are as follows: Unit start times Office hours (10-hour shift) 6:00 a.m. 8:00 a.m. 7:00 a.m. – 4:30 p.m. Monday – Friday 10:00 a.m. 12:00 noon 1:00 p.m. (2 units) 2:00 p.m. 3:00 p.m. 9:00 p.m. 6:00 a.m. 8:00 a.m. Closed Saturday – Sunday 10:00 a.m. 2:00 p.m. 9:00 p.m. 3) No shift changes shall occur between 9:00 pm and 6:00 am, Monday - Sunday. 4) The use of sirens and/or emergency lighting is prohibited until ambulances reach the intersections of Washburn Road/Woodruff Avenue or Washburn Road/Bellflower Boulevard. 5) Idling ambulance vehicles inside the subject building is prohibited at all times. 6) Sleeping and cooking on the premises are prohibited at all times. 7) Washing ambulances at the subject site is prohibited at all times. 8) On-site ambulance maintenance shall be limited to oil changes, battery replacement, and other minor services. 9) Approval of PLN-11-00021 shall not be construed to mean any waiver of applicable and appropriate zoning regulations, or any Federal, State, County, and City laws and regulations. Unless otherwise expressly specified, all other requirements of the City of Downey Municipal Code shall apply. 10) Trans-filling oxygen bottle is prohibited at all times. Conditional Use Permit – 9441 Washburn Rd April 6, 2011 - Page 4 Resolution No. 11-2707 Downey Planning Commission 11) The Planning Commission shall retain jurisdiction to amend or add conditions with public notice to assure compatibility with the purpose and intent of the Comprehensive Zoning Ordinance and to protect the public health, safety and general welfare. 12) PLN-11-00021 shall become null and void one (1) year after the adoption of this resolution, unless the construction or occupancy authorized by such Conditional Use Permit have been commenced within one year after the granting of such approval and pursued diligently to completion. 13) All conditions of approval of PLN-11-00021 shall be complied with before this Conditional Use Permit become valid. 14) All roof-mounted mechanical equipment shall be screened from view. The working drawings shall include a cross-section detail to illustrate that the height of the building parapet is sufficient to screen all roof-mounted equipment from the view of adjoining streets and neighboring properties. 15) The Applicant shall incorporate a copy of this Exhibit A, Conditions of Approval for PLN- 11-00021, into the approved set of building plans. BUILDING 16) All construction shall comply with the 2010 California Building Code and Title 24 of the California Energy Code. 17) Prior to the commencement of interior improvements, the applicant shall obtain all required permits. Additionally, the applicant shall obtain all necessary inspections and permit final prior to beginning operation of the site. PUBLIC WORKS/ENGINEERING 18) The owner/applicant hereby consents to the annexation of the property into the Downey City Lighting Maintenance District in accordance with Division 15 of the Streets and Highways Code, and to incorporation or annexation into a new or existing Benefit Assessment or Municipal Improvement District in accordance with Division 10 and Division 12 of the Streets and Highways Code and/or Division 2 of the Government Code of the State of California. 19) If applicable, the applicant shall install all new utilities associated with this project underground. 20) If applicable, the owner/applicant shall install a 9500-lumen high-pressure sodium street light with full-cutoff fixture optics on a new marbelite standard with underground service along Washburn Road frontage. 21) If applicable, the owner/applicant shall prepare and submit a traffic impact analysis study to the satisfaction of the City Traffic Engineer, who shall define the specific requirements of the Study. The owner/applicant shall be responsible for any improvements required to mitigate traffic impacts created by the project as identified by the study and/or financially contribute a fair share toward the cost of constructing capital improvements, not considered part of the frontage of the project site, necessary to offset all or a portion of the project traffic impacts. Conditional Use Permit – 9441 Washburn Rd April 6, 2011 - Page 5 Resolution No. 11-2707 Downey Planning Commission 22) All areas within the scope of work of this project shall comply with the National Pollutant Discharge Elimination System (NPDES) requirements of the Federal Clean Water Act; the General Construction Activities Stormwater Permit (GCASP) of the State, the Stormwater Quality Management Plan (SQMP) of the Los Angeles County Department of Public Works, and Ordinance 1142 of the Downey Municipal Code. 23) If applicable, prior to the issuance of demolition permits, the applicant shall complete a Construction & Demolition (C&D) Waste Management Plan per Article V, Chapter 8 of the Downey Municipal Code. 24) The owner/applicant shall obtain all necessary plan approvals and permits and shall provide that the standards of improvements, construction materials, and methods of construction shall be in conformance with the Standard Plans and Specification for Public Works Construction and as modified by the City of Downey’s Standard Plans and Specifications. FIRE 25) Plans to be submitted through Building and Safety and shall comply with 2010 California Fire Code, 2010 California Building Code, current Downey Municipal Code Ordinances and any other pertinent requirements to be determined at time of plan submission and review. 26) The applicant/owner shall install a Knox® Rapid Entry System with master key and key switch for electric gates for the building. 27) The applicant/owner shall install an approved Automatic Fire Extinguishing System throughout. 28) The applicant/owner shall install an approved fire alarm system for the entire building. 29) The applicant/owner shall install an approved fire sprinkler system for the entire building. 30) The applicant/owner shall install an approved ventilation system for the warehouse (ambulance parking) area. 31) The applicant/owner shall install emergency lighting system for the entire building. 32) The applicant/owner shall include an emergency evacuation plan into the building plans. Also, building plans shall include fire extinguisher location and size, vehicle repair area, hazardous waste, (Bio & Chemical) quantities and type.
