DAVIS, CITY PLANNER SUBJECT:PLN CASE NO. 10-08161 - AREQUEST TO MODIFY THE CONDITIONS OF APPROVAL OF CONDITIONALUSE PERMIT NO. 08-62, THEREBY INCREASINGTHE NUMBER OF PARTICIPANTS AT AN ADULT DAY CARE FACILITY FROM 127 TO 160,ONPROPERTYAT12130 PARAMOUNT BOULEVARD, ZONED C2(GENERAL COMMERCIAL) BACKGROUND On May 21, 2008,the Downey Planning Commissionapproved Conditional UsePermit No. 08-62, which established the AltaMed Services Corporation adultday care facility at 12130 Paramount Boulevard. On March 2,2011, the Planning Commission openedapublic hearingtoconsider a request by AltaMedto modifyacondition ofapproval for Conditional Use Permit No. 08-62that wouldincreasethenumber of participantsat thefacility. ConditionNo. 1 ofthe Conditionsof Approvalfor Conditional Use Permit No. 08-62states that the maximum numberof adultsoccupyingthe building atone time (employeesand clients combined) shall notexceed 127 persons.AltaMed seeks to expand its operationby increasing thenumberof clientsto160 with 40employees. Therefore, AltaMed’srequest to modify Condition No. 1 wouldincrease the number of participantsat the facility from 127 to 160 persons. (Please refer to the attached staffreport from theMarch2, 2011PlanningCommission meeting forfurther analysis.) The Planning Commission received a staff report,testimony from the Applicant, Ms.Angela Roberts, anddissenting commentsfrom Mr. Bob Davila, the ownerof theadjacent residential property tothe east.Mr.Davila discussed the following: 1.Minutesfromthe May21, 2008Planning Commission meetingdid not address the issues he brought forththat evening. 2.Trashfromthe AltaMed siteblows over the wall and into his yard. PLANNING DIVISION CITY OF DOWNEY, CALIFORNIA 3.A petitionsignedbyneighbors,accompanied with photos, opposing the requestedexpansion. Itcites traffic issues,bus parkingon AlbiaStreet,and seeing groupsofseniorpatients walking in themiddleof Albia Street aspartof their rehabilitationoften,which poses an unsafe condition forbothresidents trying toenterandexisttheirdriveways and forthe pedestrians walking in the street. 4.Increased bus and van traffic. 5.Nobarriers existto prevent vans fromdamagingthe block wall thatseparates his property from the AltaMedsite. 6. Overgrownweeds 7.An airconditioning condenser leakswaterand creates a placeformosquitoes to breed. 8.Vibration fromthe buses is damaging theblock wall. 9.Staffcommented that the vans would notstay onthe property. 10.Atruckparks onParamount for extended periodsto collect contaminated items. The Planning Commission allowed Ms. Roberts to respondto Mr.Davila’sstatementsand she provided thefollowing reply: a previoustenant damagedtheblockwall, not AltaMed, and the wallwasrepairedyears ago; shewilladdress the weeds andtrash issues by having gardeners and trash collectors visit the sitetwicea week; and that Stericycle trucks parklegallytocollect hazardous waste-shewould ask them to come more often; andthat shewould addressthe stacking of vehicles and re-orienthowtheyenter thesite. After receiving publictestimonies,thePlanning Commissioncontinued the public hearingto its regular meetingon April 6,2011. The additionaltime will allow the City toinvestigate Mr. Davila’s complaints and allowAltaMed to respondto allthe information heprovided. DISCUSSION Staff inspectedthe site several timesafter theMarch2,2011 PlanningCommission meeting to validate Mr. Davila’s complaints andto observe the Applicant’sprogressin resolving those issues. Staff’s inspections occurred beforenoon orduringtheearly afternoon hours.An inspection onMarch 3, 2011,revealed that the trashbinwas overflowing,and thatweedsexisted at theedgeofthe parking lotadjacent to the easterly block wall of thesubjectsite;however,on March 7,2011, trash wascontained within the binand the weeds were removed. Duringsubsequentinspections, staffnever observed any trash orvegetationproblems again,never observed on-site circulationproblemswith the vans,neverobserved vansparking onthe street, andnever saw AltaMed’spatientsor staff walkingon Albia Street. Staff observeda vanparked onthe site onetime only, March 29, 2011.The attached photographs record staff’sobservations. PLN-10-08161 12130 Paramount Boulevard April6,2011 - Page 2 CORRESPONDENCE On March 25, 2011, AltaMed submitted a package containing a letter fromAltaMed that respondsto Mr. Davila’s complaints; a letterfrom CurtisCare, an infant developmentcenter tothe north that supportsAltaMed’s proposal;an affidavitfrom JacquelineEscobarthat describes anincidentinvolving a man who preventedher from enteringthe parkinglot; severalphotographs and Mr. Davila’ssigned petition. Mr. Davila requestedcopies of the Minutesfrom the March2, 2011 and May21, 2008Planning Commission public hearings on Conditional Use Permit No. 08-62. CONCLUSION Staff recommends that the Planning Commissionadopt Resolution No.11-2700,thereby approving PLN-10-08161, AltaMed’srequestto modify theconditionsof approvalfor Conditional Use Permit No. 08-62toincreasethenumber ofemployees andclients allowed attheadult care facility from127 persons to 200.
