Staff has reviewed the proposed use for compliance with California Environmental Quality
Act (CEQA). Upon completion of this review, staff determined that this request is
categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1,
Existing Facilities). Categorical Exemptions are projects, which have been determined not
to have a significant effect on the environment and have been exempted from the
requirements of the California Environmental Quality Act. Class 1 includes minor
expansion of uses. It is staffs opinion that the proposed electron beam welding business
will not have a significant effect on the environment; thereby qualifying for the Class 1
exemption.
RECOMMENDATION
Staff recommends that the Planning Commission adopt the following titled resolution:

CODE AUTHORITY
Section 9314.04 of the Downey Municipal Code requires a conditional use permit for metal
fabrication uses if the use is within 200 feet of a residential zone. The Planning
Commission's authority to consider conditional use permit applications is set forth in
Section 9802 of the Code.

The applicant, Russell Pho. submitted a Land Use Permit Anp|i0aUonb] obtain approval
of a conditional use permit (PLN-11-00019) to establish a metattfabrication business (Hi
Tech Machining Services) at the Hall Road Business Park. This Ite is located on the south
side of Hall Road, between Bellflower Boulevard and Woodruff enue and it covers
384,725 square feet (8.83 acres) of land. It has two zone design tions: M-2 (General
Manufacturing) and P-B (Parking Buffer). The westerly 70 feet o he property is zoned P-B
(Parking Buffer) while the remaining portion is zoned M-2 (Gene , I Manufacturing).
Hall Road Business Park was conceived as a 50-unit, 192,000 sq. ft. industrial
condmrniniurn bui|ding, whereby each unit would be owned individually. The rectangular-
shaped building is divided equally, providing twenty-five (25) units along the east and west
sides. Each unit contains approximately 3,200 square feet of floor area (40' x 80'). The
easterly units on the building face an industrial use, while the westerly units face residential
developments.
The individual ownership con�pt for the Hall Road Business Park has not caught on as
8DUcipated, so the owners of the Park leased many of the units instead. However, Mr. Pha
is one of the few individuals to purchase a unit. His space, 9236 Hall Road, is on the
easterly side of the Hall Road Project making it within the M-2 zone.
Staif completed a review of the application on February 2, 2011, and deemed the
application complete. On February 18, 2011, noti� of the pending public hearing was sent
to all property owners within 500' of the subject site and the notice was published in the
Downey Patriot.

the Planning Commission's approval of a conditional use permit to comply with the City's
zoning regulations. Metal fabrication is a light-manufacturing use that is appropriate for the
M-2 Zone; however, the subject property abuts R-3 and R-1 zoned, residentially-developed
properties and Mr. Pha's unit is within 200 feet of them. Section 9314.04 of the Downey
Municipal Code requires a conditional use permit for metal fabri tion uses if the use is
within 200 feet of a residential zone.

Staff has inspected the subject site and observed that Hi-Tech Machining Services is clean
and quiet. Mr. Pha does not store any materials or equipment outside the building. The
milling and lathing of work pieces occurs within the CNC machines, which also collect the
shaved metal. The sound decibels levels measure 65 dBA or less outside the building. The
doors of this unit face the industrial property to the east; however, sounds emanating from
the operation are not discernable from the residential properties to the west.

Boulevard). All three streets have sufficient capacity to absorb any additional traffic the

commenced within one year of this approval and pursued diligently to completion or a one-year
extension of time granted by the Downey Planriing Commission, pursuant to Section 9824 of the
Downey Municipal Code.
SECTION 6. The Secretary shall certify the adoption of this

EXHIBIT A - CONDITIONS
1) The approval of PLN-11-00019 (Conditional Use Permit) to establish a metal fabrication
business to manufacture engine parts for automobiles in the racing industry, by utilizing
state-of-the-art CNC milling and lathing machines, at 9246 Hall Road, as shown on the
approved site plan. Any deviations or exceptions from said site plan, other than those
authorized by this resolution or those that do not impact ot r conditions, shall not be
permitted without the approval by the Downey Planning Co mission.
2) The City Planner is authorized to make minor modifications to the approved preliminary
plans or any of the conditions if such modifications shall actleve substantially the same
results as would strict compliance with said plans and con ions.
3) Approval of this PLN-11-00019 (Conditional Use Permit) sIlFll not be construed to mean
any waiver of applicable and appropriate zoning regulation or any Federal, State, County,
and City laws and regulations. Unless otherwise expressly 3pecified, all other requirements
of the City of Downey Municipal Code shall apply.
4) The Downey Planning Commission shall retain jurisdiction amend or add conditions with
public notice to assure compatibility with the purpose and ir4ent of the Comprehensive
Zoning Ordinance and to protect the public health, safety a d general welfare.
5) The Applicant shall comply with all conditions of PLN-10-08102 (Conditional Use Permit)
before this Conditional Use Permit becomes valid.
6) The Applicant shall obtain all required approvals and permits for tenant improvements
performed at the subject location.
7) The sound levels created by the operation of equipment associated with the proposed use
shall remain within the noise standards established by the Downey Municipal Code for
industrial uses.
8) The applicant shall not store equipment or materials outside the building.
9) The operation of the proposed metal fabrication operation shall be conducted in
accordance with Section 9516 (Environmental Performance Standards) of the Downey
Municipal Code.

The following is intended as an attachment for construction a d grading plans and
represent the minimum standards of good housekeeping whi must be implemented on all
construction sites regardless of size.
Eroded sediments and other pollutants must be retained o site and may not be
transported from the site via sheetflow, swales, area drainsJ natural drainage courses or
wind.
Stockpiles of earth and other construction related materials must be protected from being
transported from the site by the forces of wind or water.
Fuels, oils, solvents and other toxic materials must be stored in accordance with their listing
and are not to contaminate the soil and surface waters. All approved storage containers are
to be protected from the weather. Spills must be cleaned up immediately and disposed of in
a proper mariner. Spills may not be washed into the drainage system.
Non-storm water runoff from equipment and vehicle washing and any other activity shall be
contained at the project site.
