Resolution No. 10-7238 - Approve Employment Agreement with Mark Sauter Emerg Srvcs Manager
( RESOLUTION NO. 10 – 7238 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, APPROVING AN EMPLOYMENT AGREEMENT BETWEEN THE CITY OF DOWNEY AND MARK SAUTER (EMERGENCY SERVICES MANAGER). WHEREAS, Mr. Mark Sauter currently serves as Deputy City Manager/Public Safety Emergency Operations Chief; and WHEREAS, Mr. Sauter’s employment with the City is scheduled to end on December 31, 2010; and WHEREAS, the City wishes to retain Mr. Sauter to manage the City’s Emergency Services for an additional year. NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Employment Agreement between the City of Downey and Mr. Mark Sauter, attached hereto as Exhibit “A”, is hereby approved as to form and content. SECTION 2. The City Manager is authorized to execute the Employment Agreement on behalf of the City. ( SECTION 3. The City Clerk shall certify the adoption of this Resolution. MIIDSTOKKE, City Clerk I EMPLOYMENT AGREEMENT BETWEEN THE CITY OF DOWNEY AND MR. MARK SAUTER WHEREAS, Mr. Mark Sauter currently serves as Deputy City Manager/Public Safety Emergency Operations Chief; and WHEREAS, Mr. Sauter’s employment with the City is scheduled to end on December 31, 2010; and WHEREAS, the City wishes to retain Mr. Sauter to manage the City’s Emergency Services for an additional year. The City hereby agrees to employ Mr. Sauter commencing on January 1, 2011 as a part-time employee of the City of Downey under the following conditions: 1. Mr. Sauter will serve as Emergency Services Manager. 2. Mr. Sauter will continue to direct the City’s emergency management preparation working under the direction of the Chief of Police. 3. Mr. Sauter will be paid an hourly rate of $83.33, up to a maximum of $160,000. and be classified as a part-time employee of the City. 4. In accordance with regulations of the Public Employee Retirement System, Mr. Sauter will work no more than 960 hours per fiscal year (defined as the twelve month period commencing on July 1 and ending on June 30) under this contract. 5. This agreement will expire no later than December 31, 2011.
