I-5 JPA 5th Amend AGENDA MEMO DATE: February 8, 2011 TO: Mayor and Members of the City Council FROM: Office of the City Manager Shannon DeLong, Assistant to the City Manager SUBJECT: FIFTH AMENDMENT TO THE I-5 CONSORTIUM CITIES JOINT POWERS AUTHORITY AGREEMENT RECOMMENDATION That the City Council of the City of Downey approve Amendment No. 5 to the I-5 Consortium Cities Joint Powers Authority Agreement. BACKGROUND The City of Downey is one of six member cities of the Interstate-5 Consortium Cities Joint Powers Authority (JPA), which was established in 1990. The goal of the JPA is to work in partnership with Caltrans and the Federal Highway Administration to pursue innovative capacity enhancement alternatives for the expansion of the I-5 freeway to avoid significant at-grade widening that would have negative adverse social and economic impacts on corridor communities. The JPA has been successful in its efforts to secure Federal financial support for a non-traditional approach, which will provide for improved traffic flow and capacity in a manner that will minimize the displacement of businesses and homes in the I-5 corridor. DISCUSSION Amendments No. 1, 2, and 3 have extended the term of the original agreement by 5- year increments. Amendment No. 4 made modifications to budget and contract approval requirements. Amendment No. 5 would extend the term for an additional five (5) years and will expire in November 2015. The Policy Board of the I-5 JPA approved this Amendment at its November 22, 2010 meeting. At that meeting, the Board was informed of the City of Buena Park’s decision to withdraw its membership in the I-5 JPA. This will reduce the I-5 JPA membership to five member agencies: Commerce, Downey, La Mirada, Norwalk and Santa Fe Springs. FISCAL IMPACT The cost of membership in the I-5 Consortium Cities Joint Powers Authority is paid with Gas Tax Funds and was estimated at $55,600 for the FY10-11 budget. th Attachment: 5 Amendment to Agreement CITY OF DOWNEY, CALIFORNIA FIFTH AMENDMENT TO INTERSTATE 5 CONSORTIUM CITIES JOINT POWERS AGREEMENT That certain Agreement entered into by and between the cities of Buena Park, Commerce, Downey, La Mirada, Norwalk and Santa Fe Springs, creating the Interstate 5 Joint Powers Authority is hereby amended by amending Section 2 to read as follows: “Section 2. Term. The term of this Agreement shall be for a period of twenty-five years from and after November 1, 1990. The Agreement may be extended by mutual consent of all parties.” In the event not all of the Parties execute this Amendment, the Agreement shall be binding on those that do execute the Amendment. Except as amended herein, all terms of the Agreement, as previously amended, shall remain in full force and effect. th IN WITNESS WHEREOF, this Agreement is executed this 8 day of February, 2011, by the Parties as follows: CITY OF DOWNEY _______________________________ LUIS H.
