CEQA
Staff reviewed the proposed activity for compliance with the California Environmental Quality
Act (CEQA). Upon completion of this review, staff determined this request is categorically
exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing Facilities).
CODE AUTHORIZATION
Section 9314.04 of theDowneyMunicipalCode requires a conditional use permit for restaurants,
cafes,and coffee establishments withalcohol salesand liveentertainment. The Planning
Commission’s authority to consider conditional use permit applications is set forthinSection9802of
the Code
.
SUMMARY
On September16,2009, the Planning Commission held a publichearingto considera request by
Blanca Mendez to modify a previously approvedConditional Use Permit (CUP 08-04)to allow live
entertainmentatthe Habana CaféRestaurantlocatedat 11402 Old River SchoolRoad. After
receiving allpublic testimony andfacts regardingthe proposeduse, the PlanningCommission
adoptedResolutionNo. 2599, which requires thePlanning Commission to reviewtheapplicant’s
compliance with theconditionsof approvalsix months later.

BACKGROUND
On April16, 2008,the Planning Commission approved Conditional Use Permit No. 08-04,to permit
anexpansion toan existingliquor license from a Type 41 toType47 and to includeafull bar area
within the Habana Café Restaurant.
December 17, 2008,the Planning Commissionapproved Conditional Use Permit No.08-04,
Revision A, allowingthe previouslyapproved bar area tobe relocated to therear ofthe restaurant.
September16, 2009the Planning Commissionapproved Conditional Use Permit No.08-04,
Revision B allowing liveentertainmentwithinthe existingrestaurant, but requiredthat the applicant
return for a reviewofthe useand the conditionsofapproval.
DISCUSSION
After inspecting thesubject site, staffdetermined theapplicanthas compliedwith27 of the28
Conditionsof ApprovalofResolution No. 09-2599for CUP No.08-04, Revision B (ExhibitC).The
only exceptionisCondition#16, which concernstheparking lot.This condition states: “The
owner/applicant shall patchand slurry sealthe existingasphalt parking lot[…].” The property
ownerpatcheddamaged areas and slurry sealed theentireparking lot, buthewasunaware that
building permits are requiredfor such work. Consequently, neitherthe Building&Safety Division
nor the Engineering Division conductednecessary plan reviewor inspections of this work.During
thePlanning Division’s site inspection,visible evidence showedthatpatching and slurry seal was
not done correctly, as such,cracks andpotholesstill remain (see photos).

Afterreviewingthe current conditionoftheparking lot, staffdetermined the owner didnot comply
with theconditionappropriately sincepermits were neverissued for the work.In addition,staff finds
that furtherpatching and slurry sealing willnotimprovethe lot’scondition and additionalwork must
be conductedto repair thesignificant wearanddamageto the asphalt.Specifically, the parking
lot’s longitudinal guttermustbe reconstructed to allow for correctwaterflow andatwo-inchasphalt
overlay is required toridthe parking lotof theextensive“alligator” cracking and potholes.

Thus, staffrecommendsthe propertyowner work with Citystaffto appropriatelycomplete
Condition #16 by obtaining all the necessarypermits and completingtherepairwork inaccordance
with the City’sdirection.
As ofthe datethisreport was written, there werenocallsfor serviceto the Police Department
regarding noiseor nuisancesat thesubject site.
RECOMMENDATION
Staff recommends the Planning Commission continue this review of Conditional Use Permit No.
08-04, Revision B to a future meeting and grant the property owner a 60-day extension to
completeCondition#16 of Resolution No. 09-2599.
