Caton City Manager SUBJECT:Employment Agreement for Emergency Services Manager RECOMMENDATION That the City Council approve the attached resolution: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA APPROVING AN EMPLOYMENT AGREEMENT BETWEEN THE CITY OF DOWNEY AND MR. MARK SAUTER DISCUSSION I am requesting that the City Council approve an employment agreement between the City of Downey and Mr. Mark Sauter. The employment agreement stipulates that Mr. Sauter will serve as Emergency Services Manager from January 1, 2011 to December 31, 2011. Mr. Sauter has served in the capacity of Deputy City Manager/Public Safety Emergency Operations Chief for the past two years and was the City’s Fire Chief for the prior eight and one-half years. He first came to work for the City in 1979 as a Fire Fighter. The City Council created the position of Deputy City Manager/Public Safety Emergency Operations Chief after a City-wide boil water order was issued by the State of California in late September, 2008, following a laboratory reporting of false positive tests for coliform bacteria in the City’s water system. This episode exposed several major emergency management problems within the City’s administration, including the inability to properly communicate important crisis information to the public in a timely manner. The City Council directed that these problems be quickly solved. During the past two years, Mr. Sauter has done an excellent job implementing changes to the City’s Emergency Management Program. Attached you will find a list of accomplish- ments he has achieved. I am especially pleased with Mr. Sauter’s communication with the public on how to prepare for emergencies. His efforts have included an ongoing series of emergency preparedness articles in our local newspaper. Given the current City’s large budget deficit, I reluctantly recommended during this year’s budget process that the Council only fund the Deputy City Manager/Public Safety Emergency Operations Chief’s position through the end of the calendar year. An additional $50,000 was allocated for emergency preparedness administration for the remainder of the fiscal year. CITY OF DOWNEY, CALIFORNIA With the elimination of the Deputy City Manager/Public Safety Emergency Operations Chief’s position, Mr. Sauter is scheduled to end his City employment on December 31, 2010. In order to retain Mr. Sauter’s expertise in Emergency Services for an additional year, I am recommending that his employment status be changed from full-time to part- time and his position title be modified to Emergency Services Manager. The attached agreement will implement these changes. If approved, this new position will be reporting directly to the Chief of Police. FISCAL IMPACT The cost of the twelve month proposed agreement will be $100,000. There are sufficient budgeted funds in the Emergency Management Account (10-1260) to fund this part-time position through the end of the current fiscal year. For the twelve month period of the proposed agreement, the City will save over $200,000 from the prior fiscal year’s budgeted position for Deputy City Manager/Public Safety Emergency Operations Chief. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA APPROVING AN EMPLOYMENT AGREEMENT BETWEEN THE CITY OF DOWNEY AND MARK SAUTER WHEREAS, Mr. Mark Sauter currently serves as Deputy City Manager/Public Safety Emergency Operations Chief; and WHEREAS, Mr. Sauter’s employment with the City is scheduled to end on December 31, 2010; and WHEREAS, the City wishes to retain Mr. Sauter to manage the City’s Emergency Services for an additional year. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Employment Agreement Between the City of Downey and Mr. Mark Sauter, attached hereto as Exhibit “A”, is hereby approved as to form and content. SECTION 2. The City Manager is authorized to execute the Employment Agreement on behalf of the City. SECTION 3. The City Clerk shall certify the adoption of this Resolution. MARK SAUTER WHEREAS,Mr. Mark Sauter currently serves as Deputy City Manager/Public Safety Emergency Operations Chief; and WHEREAS, Mr. Sauter’s employment with the City is scheduled to end on December 31, 2010; and WHEREAS, the City wishes to retain Mr. Sauter to manage the City’s Emergency Services for an additional year. The City hereby agrees to employ Mr. Sauter commencing on January 2, 2011 as a part-time employee of the City of Downey under the following conditions: 1. Mr. Sauter will serve as Emergency Services Manager. 2. Mr. Sauter will continue to direct the City’s emergency management preparation working under the direction of the Chief of Police. 3. Mr. Sauter will be paid an hourly rate of $91.50 and be classified as a part- time employee of the City. 4. In accordance with regulations of the Public Employee Retirement System, Mr. Sauter will work no more than 960 hours per fiscal year (defined as the twelve month period commencing on July 1 and ending on June 30) under this contract. 5. This agreement will expire no later than December 31, 2011.
