Minutes - 10-12-10 Regular Meeting MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING OCTOBER 12, 2010 The City Council of the City of Downey held a Regular Meeting at 7:32 p.m., October 12, 2010, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor Anne M. Bayer presiding. PRESENT: Council Members: Anne M. Bayer Mayor Luis H. Marquez Mayor Pro Tem Roger C. Brossmer David R. Gafin Mario A. Guerra ALSO PRESENT: Gerald M. Caton, City Manager Charles S. Vose, Interim City Attorney Gilbert Livas, Assistant City Manager Kathleen L. Pomrehn, Assistant Deputy City Manager Rick Esteves, Police Chief John Michicoff, Finance Director John Oskoui, Public Works Director Thad Phillips, Community Services Director Brian Saeki, Community Development Director Jeff Turner, Fire Chief Susan Domen, Deputy City Clerk Other City Staff COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND CONFERENCE/MEETING REPORTS: Council Member Gafin reported that he attended the La Casita graduation along with Council Member Guerra last week; announced the Chamber of Commerce City Affairs meeting will be at 12:00 p.m. tomorrow; and next Tuesday the Business Watch meeting will be at 12:30 p.m. in the Council Chambers. Council Member Guerra reported that he attended the Southern California Association of th Governments meeting last week where “Clean Cities” was discussed; attended the 60 Neighborhood Watch meeting last night; announced that next Wednesday is his annual Town Hall meeting at the Barbara J. Riley Center; Saturday will be the 1st anniversary of the opening of Bob’s Big Boy where they will be having a celebration; recognized Diane Martinez former Council Member for the City of Paramount and Contract Cities Secretary/Treasurer in the audience; and announced that the Downey Unified School District along with the City of Downey will be getting the Golden Bell Award for the Character Counts program next week. -1- City Council Minutes 10/12/10 Mayor Pro Tem Marquez reported that he attended the Police and Fire Foundation annual Golf Tournament last week; mentioned the article in the Press Telegram regarding the City being a finalist for the Most Business Friendly City; and congratulated staff for their efforts on achieving this. Mayor Bayer recognized her Commissioner Lee Ann Sears in the audience. PRESENTATIONS: Mayor Bayer presented City Pins to Miss Downey/Miss Teen Downey/Junior Miss Downey and their Courts. Mayor Bayer presented Certificates of Recognition to former Health and Environmental Sanitation Committee members. Mayor Bayer presented a Proclamation declaring Breast Cancer Awareness Month, October and End Domestic Violence Month, November. Mayor Bayer and Edmund Leviste presented the Metropolitan Lodge 2010 Community Leadership Award to City Clerk Kathleen Midstokke. Council Member Gafin recognized City Council candidate Alex Saab in the audience. PUBLIC HEARINGS: None. NON-AGENDA PUBLIC COMMENT: Bob Feliciano, resident of Downey, thanked the City, staff and the Council for making the Amazing Day Walk a great event. Diane Martinez, former Council Member for the City of Paramount and Contract Cities Secretary/Treasurer, thanked the City for being a member of the organization. CONSENT ITEMS REMOVED: 4. ADOPT RESOLUTION NO. ___________, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SUPPORTING AND AUTHORIZING AN APPLICATION FOR THE DOWNEY CIVIC CENTER AND TRANSPORTATION PLAN TO THE DEMONSTRATION PROJECT SOLICITATION FROM THE SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS: Community Development. This item was pulled at the request of Council Member Guerra and is listed under Other Business below. 5. ADOPT RESOLUTION NO. ___________, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE CITY’S CONFLICT OF INTEREST CODE WHICH INCORPORATES BY REFERENCE THE FAIR POLITICAL PRACTICES COMMISSION’S STANDARD MODEL CONFLICT OF INTEREST CODE: City Clerk. This item was pulled at the request of Mayor Bayer and is listed under Other Business below. CONSENT CALENDAR: -2- City Council Minutes 10/12/10 It was moved by Council Member Gafin, seconded by Council Member Guerra, and approve the remainder of the Consent Calendar unanimously carried to items as recommended: 1. APPROVED CITY COUNCIL MINUTES: Regular and Adjourned Meetings September 28, : 2010 City Clerk. Noting that Council Member Brosmmer abstained due to his absence at the meeting. 2. APPROVED WARRANTS ISSUED: Warrant Nos. 253412 – 253731; Wire Nos. 30002236 – : 30002245 and 645 – 648; in the total amount of $3,986,163.24 Finance. 3. CASH CONTRACT NO. S.S. 610 – PEDESTRIAN COUNTDOWN HEADS PROJECT – AWARDED CONTRACT TO REPUBLIC INTELLIGENT TRANSPORTATION SERVICES, INC. IN THE AMOUNT OF $27,720: Public Works. 6. ADOPTED RESOLUTION NO. 10-7228, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ACCEPTING CHANGES TO THE CITY NATURAL HAZARD MITIGATION PLAN FOR 2010: Administration. 7. ADOPTED ORDINANCE NO. 10 – 1266, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING DOWNEY MUNICIPAL CODE SECTION 3179(c)4 TRUCK ROUTES ON FIRESTONE BOULEVARD : Public Works. 8. DOWNTOWN DOWNEY SPECIFIC PLAN (PLN-10-98074) A. ADOPTED ORDINANCE NO. 10 – 1267, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING THE DOWNTOWN DOWNEY SPECIFIC PLAN: Community Development. B. ADOPTED ORDINANCE NO. 10 – 1268, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY REPEALING SECTION 9326 OF ARTICLE IX OF THE DOWNEY MUNICIPAL CODE, THEREBY REVOKING THE DOWNTOWN DOWNEY PLAN FOR DOWNEY’S HISTORICAL DOWNTOWN DISTRICT: Community Development. 9. APPROVED EMPLOYMENT AGREEMENT WITH GILBERT A. LIVAS FOR THE TRANSITION OF THE CITY MANAGER POSITION EFFECTIVE DECEMBER 31, 2011: City Attorney. ADMINISTRATIVE REPORTS: None. OTHER BUSINESS: 10. APPROVED NAMING CITY COUNCIL PARKING AREA “RESPONSIBILITY ROW” AND AUTHORIZED THE INSTALLATION OF A SIGN: Council Member Guerra. Council Member Guerra explained the he would like this sign to remind the High School students that pass through the area every day that Character Counts matters in the City and that the cost will be minimal. It was moved by Council Member Guerra, seconded by Council Member Brossmer and approve naming the City Council parking lot carried, noting the dissent of Mayor Bayer, to “Responsibility Row”. -3- City Council Minutes 10/12/10 Prior to the vote, Mayor Bayer stated that she fully supports the Character Counts program, however, does not feel the City should be spending any extra funds at this time. CONSENT ITEMS REMOVED: 4. ADOPTED RESOLUTION NO. 10 - 7226, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SUPPORTING AND AUTHORIZING AN APPLICATION FOR THE DOWNEY CIVIC CENTER AND TRANSPORTATION PLAN TO THE DEMONSTRATION PROJECT SOLICITATION FROM THE SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS: Community Development. Council Member Guerra requested that funding for the Bicycle/Pedestrian Path along the railroad tracks be added to this application. City Manager Caton explained that it could not be added to this item but staff would bring back a Resolution at the next meeting for the funding. It was moved by Council Member Guerra, seconded by Council Member Gafin and adopt the Resolution. unanimously carried to 5. ADOPTED RESOLUTION NO. 10 - 7227, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE CITY’S CONFLICT OF INTEREST CODE WHICH INCORPORATES BY REFERENCE THE FAIR POLITICAL PRACTICES COMMISSION’S STANDARD MODEL CONFLICT OF INTEREST CODE: City Clerk. Dan Cristea, resident of Downey, stated that he feels this is counter productive and if everyone swore to uphold the Constitution then there wouldn’t be the need for excessive laws. It was moved by Council Member Gafin, seconded by Mayor Pro Tem Marquez and adopt the Resolution. unanimously carried to STAFF COMMENTS: City Manager Caton noted that he feels this community is very special and the succession plan approved tonight for Gilbert Livas to take over as City Manager will leave the City in very good hands.
