Minutes - 08-24-10 Regular Meeting MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING AUGUST 24, 2010 The City Council of the City of Downey held a Regular Meeting at 7:33 p.m., August 24, 2010, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor Anne M. Bayer presiding. PRESENT: Council Members: Anne M. Bayer Mayor Luis H. Marquez Mayor Pro Tem Roger C. Brossmer David R. Gafin Mario A. Guerra ALSO PRESENT: Gerald M. Caton, City Manager Charles S. Midstokke, City Clerk Desi Alvarez, Deputy City Manager/Special Projects Mark Sauter, Deputy City Manager/Emergency Services Rick Esteves, Police Chief John Michicoff, Finance Director John Oskoui, Public Works Director Thad Phillips, Community Services Director Brian Saeki, Community Development Director Jeff Turner, Fire Chief Susan Domen, Deputy City Clerk Other City Staff COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND CONFERENCE/MEETING REPORTS: Council Member Brossmer recognized Downey Unified School District (DUSD) Board Member, Tod Corrin in the audience; and reported that he attended Downey Civic Theater and Columbia Memorial Space Science Learning Center subcommittee meetings. Council Member Gafin recognized former Mayor Diane Boggs and Assembly Member Calderon Field Representative Mike Holland, in the audience; announced that Wednesday will be the last concert in the series for this summer and the Marine Corps Band will be playing; noted he attended the annual Neighborhood Watch barbecue on Dunrobin Avenue; and encouraged other groups to get active. Council Member Guerra noted he attended the Dunrobin Avenue Neighborhood Watch th barbecue as well; the Sister Cities 50 celebration with Guadalajara, Mexico last week; the Downey Express baseball tournament to raise funds for care packages for soldiers in Afghanistan; the Gauldin Elementary recycling event on Friday and requested they be honored in a September meeting; and the Forum: The Future of Human Space Exploration held at the Columbia Memorial Space Science Learning Center, where he met Buzz Aldrin yesterday; announced that next Monday would be the dedication of the Challenger Learning Center; recognized Rubin Salgado Emergency -1- City Council Minutes 08/24/10 Preparedness Committee Member in the audience; requested staff look into the installation of a bike/walking path next to railroad tracks; and requested staff to bring back the Green Task Force appointments and suggested recommendations for discussion and/or approval. Mayor Pro Tem Marquez recognized former Chamber of Commerce President Rick Rodriguez, Planning Commissioner Fernando Vazquez and Emergency Preparedness Committee Member Janet Molinaro, in the audience; and reported that he attended the Sister City Guadalajara events last week. Mayor Bayer recognized Recreation and Community Services Commissioner/Emergency Preparedness Committee Member Lee Ann Sears in the audience and invited everyone to attend th the annual Blue Mass held at Our Lady of Perpetual Help on September 9 at 8:30 a.m. PRESENTATIONS: Mayor Bayer presented a Certificate of Recognition to Tracy Riley for his service on the Cable TV Citizens Advisory Committee. Mayer Bayer presented a Proclamation declaring the month of September as National Preparedness Month. PUBLIC HEARING: 1. CONFORMANCE WITH THE METROPOLITAN TRANSPORTATION AUTHORITY’S CONGESTION MANAGEMENT PROGRAM: Community Development. A. ADOPTED RESOLUTION NO. 10-7216, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL DEVELOPMENT REPORT IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089. The Public Hearing was opened at: 7:52 p.m. The City Clerk affirmed receipt of Proof of Publication. It was moved by Council Member Brossmer, seconded by Council Member Gafin and receive and file the proof of publication so ordered by the Mayor, to . Community Development Director Saeki presented the staff report explaining that the City is required to adopt a Resolution of Conformance self-certifying that they are in compliance with the 2004 Congestion Management Program (CMP) for Los Angeles County. Conformance with the CMP assures the continued receipt of Proposition 11 State Gas Tax funds. The City is estimated to receive $603,000 for the fiscal year 2010/2011. He concluded by noting that projects recorded for the previous fiscal year include 23 single-family residences, 2 multi-family residences, the new Porto’s building and various minor additions to commercial, institutional and restaurant buildings. There being no speakers from the audience, it was moved by Council Member Brossmer, close seconded by Council Member Gafin and was so ordered to the Public Hearing the time being 7:54 p.m. There being no further discussion, it was moved by Council Member Brossmer, seconded by adopt the Resolution. Mayor Pro Tem Marquez and unanimously carried to -2- City Council Minutes 08/24/10 NON-AGENDA PUBLIC COMMENT: Bill Minasian, resident of Downey, noted his appreciation for the City Manager’s quick response to salary information to the public in light of the City of Bell scandal and stated he had requested the same information from the Water Replenishment District and is awaiting the response. Del Esguerra, resident of Downey, explained he had filed a claim with the City and it was th referred to Nova Pro on July 14. He asked for assistance in dealing with them and was referred to Finance Director Michicoff. Deborah Samonset, resident of Downey, expressed concerns regarding her home renovations and responses from the Building Inspectors and Code Enforcement officers. Oscar Loretto, resident of Downey, requested assistance in changing safety equipment regulations at the Skate Park and was referred to Community Services Director Phillips. Council Member Brossmer noted he would like to sit in on the meeting. Greta Campbell, resident of Downey, noted that as a recent homeless person there are limited facilities for assistance to the Downey population that are close enough and requested that it be looked into. She was referred to speak to Community Development Director Saeki for further assistance. Ron Bours, resident of Downey, requested the City provide transitional programs for returning veterans and noted he has no respect for the Police Department. David Littlehals (sp?), executive Director of Rio Hondo Temporary Home, thanked the City for the continued support of financial funding. Sirah Ku (sp?), Maps for College, explained that the organization works with students to get into college and requested to partner with the City in providing these services. CONSENT ITEMS REMOVED: 8. APPROVE COMMUNITY DEVELOPMENT BLOCK GRANT SUBRECIPIENT GRANT AGREEMENTS WITH A COMBINED TOTAL ALLOCATION OF $66,400: Community Development. This item was removed at the request of Council Member Guerra and is listed under Other Business below. A. ARC OF SOUTHEAST LOS ANGELES COUNTY: $11,500; B. DOWNEY UNIFIED SCHOOL DISTRICT: $34,400; C. RIO HONDO TEMPORARY HOME: $17,500; and D. SOUTHERN CA REHABILITATION SERVICES, INC.: $3,000. CONSENT CALENDAR: It was moved by Council Member Brossmer, seconded by Council Member Gafin, and approve the remainder of the Consent Calendar unanimously carried to items as recommended: 2. ACCEPTED AND APPROPRIATED $5,000 FROM THE FEDERAL LIBRARY SERVICES AND TECHNOLOGY ACT FOR THE PUBLIC LIBRARY STAFF EDUCATION PROGRAM: Community Services. 9. APPROVED AGREEMENT WITH WG ZIMMERMAN ENGINEERING, INC. FOR ENGINEERING DESIGN SERVICES RELATED TO THE TRUCK IMPACTED INTERSECTION PROJECT – PHASE 2 FOR $111,835: Public Works. 10. APPROVED LOAN AGREEMENT WITH HABITAT FOR HUMANITY OF GREATER LOS ANGELES FOR THE ACQUISITION OF 7036 DINWIDDIE STREET #12 AND APPROPRIATED $182,000 IN FEDERAL HOME INVESTMENT PARTNERSHIP GRANT FUNDS: Community Development. 11. APPROVED EXTENSION OF AGREEMENT WITH WILLDAN ENGINEERING FOR ON- CALL CONSTRUCTION INSPECTION SERVICES: Public Works. 12. ADOPTED RESOLUTION NO. 10-7217 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT THE TRANSFER AND CONVEYANCE OF THE STORM DRAIN IMPROVEMENTS KNOWN AS MISCELLANEOUS TRANSFER DRAIN NO. 1754 IN THE CITY OF DOWNEY FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF: Public Works. 13. ADOPTED RESOLUTION NO. 10-7218, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SETTING FEES FOR THE COLUMBIA MEMORIAL SPACE SCIENCE LEARNING CENTER: Administration. ADMINISTRATIVE REPORTS: 14. REPORTED ON THE OLDER ADULTS SEEKING INFORMATION AND SKILLS (OASIS) PROGRAM – DISCUSSION AND DIRECTION: Community Services. Community Services Director Phillips presented the staff report explaining that this program was previously funded by the DUSD and held at Downey Adult School. The program serves approximately 75-100 seniors each Monday and included entertainment, educational and meal components. He noted that the program was evaluated and a budget prepared on anticipated costs, -4- City Council Minutes 08/24/10 with the actual food cost being unknown at this time. He concluded that $15,000 in Community Development Block Grant Funds can be allocated toward the program. Council Member Brossmer asked if the funds received from participants were taken into consideration and what the breakdown of the costs is. It was explained that the funds were considered and that the breakdown includes: Staff - $4,853, Entertainment - $600, Educational - $1,000, the unknown cost of food being estimated at $8 per person, and indirect costs of $5,000. Council Member Guerra stated that he believes in the program but cannot justify General Funds for this and suggested having it only once per month to fit within the $15,000. Mayor Bayer questioned if there are similar programs the City offers and was told that there is a daily nutritional program at Café Quill held at the Barbara J. Riley Center; however space is limited and neither includes the educational component. Sarah Ku (sp?) noted that she has many contacts and is willing to help provide resources towards the program. Harold Tseklenis, resident of Downey, noted that the program is operated during the school year only and questioned if the School District was asked the amount of funds they cut for the program and if they would continue it if they were provided. City Manager Caton reminded him that the City only acted on his request to take over the program and does not have the authority to ask the School District to continue it. It was moved by Council Member Guerra, seconded by Council Member Brossmer and unanimously carried to have staff bring back a program that will fit within the $15,000 from Community Development Block Grant monies. Prior to the vote, Council Member Brossmer suggested removing the dinner component to save on the costs. OTHER BUSINESS: CONSENT ITEMS REMOVED: 8. Council Member Guerra explained that he pulled this item to highlight the great work these organizations do.
