LA County Transfer Drain 1754 AGENDA MEMO DATE: August 24, 2010 TO: Mayor and Members of the City Council FROM: Office of the City Manager By: John Oskoui, P.E., Director of Public Works SUBJECT: MISCELLANEOUS TRANSFER DRAIN (MTD) 1754 RECOMMENDATION That the Mayor and City Council adopt: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT TO ACCEPT MISCELLANEOUS TRANSFER DRAIN 1754 BACKGROUND Under specific circumstances of shared design, inspection and approval privileges, the Los Angeles County Flood Control District (LACFCD) may elect to accept a Miscellaneous Transfer Drain (MTD), or storm drain line, from other entities, releasing those entities from substantial responsibility for the continued operation and maintenance of the facility. DISCUSSION One of the requirements for the development of the new Kaiser Hospital and Medical Office Building complex and Congressman Steve Horn Way was for Kaiser to design and construct a storm drain line that would collect the storm water runoff from the roadway and the property directly to the north of the roadway (Industrial Realty Group). With the intention of transferring the new storm drain line to the LACFCD, the City required Kaiser to design and construct the storm drain to LACFCD standards. Both the City and LACFCD were closely involved with Kaiser’s design consultants and both agencies signed off on the construction plans and specifications and had inspectors on- site during the construction activities. The storm drain line begins 200 feet west of the intersection of Bellflower Blvd. and Congressman Steve Horn Way, proceeds west to the intersection of Congressman Steve Horn Way and Ardis Avenue and then south to the intersection of Ardis Avenue and Imperial Highway. At this point the line joins an existing LACFCD box culvert that continues south on Ardis Avenue. The line varies in diameter from 36 inches near Bellflower Blvd. to 60 inches near Imperial Highway. CITY OF DOWNEY, CALIFORNIA Mayor and Members of the City Council Miscellaneous Transfer Drain (MTD) 1754 August 24, 2010 Page 2 The catch basins located in the center median and the 18 inch laterals that connect to the transfer drain, as well as the Continuous Deflection Unit structure that is used to filter and direct storm water to the City’s eight acre-foot detention/retention facility located under the east soccer field at Discovery Park are not part of the MTD. LACFCD is satisfied that the storm drain was constructed to their standards and have indicated that they are now ready to accept the improvements. The City Council for the City of Downey is responsible for requesting that the Board of Supervisors for the LACFCD, who are also the Los Angeles County Board of Supervisors, formally accept the MTD. Once the transfer is complete, LACFCD assumes the operational and maintenance responsibilities for the pipeline. FISCAL IMPACT There is no fiscal impact to the City associated with adoption of this resolution as the Kaiser Permanente Health Foundation has assumed responsibility for transfer costs. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT THE TRANSFER AND CONVEYANCE OF THE STORM DRAIN IMPROVEMENTS KNOWN AS MISCELLANEOUS TRANSFER DRAIN NO. 1754 IN THE CITY OF DOWNEY FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF. WHEREAS , there have been dedicated to, or the City of Downey has otherwise acquired, the storm drain improvements and drainage system known as Miscellaneous Transfer Drain (MTD) No. 1754, depicted on Los Angeles County Flood Control District Drawing Nos. 364-1107-F7.1 to 364-1107-F7.14 on file with the Director of the County of Los Angeles Department of Public Works; and WHEREAS , the City of Downey is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS , the City of Downey and the Los Angeles County Flood Control District entered into an Agreement dated February 9, 1982, and recorded on March 18, 1982, as Document No. 82-291571, of the Official Records in the Registrar-Recorder/County Clerk's office, whereby the City made certain warranties about its future transfers and conveyances of flood control facilities to the District; and WHEREAS , the best interest of the public will be served by transfer and conveyance of said storm drain improvements and drainage system from the City of Downey to the Los Angeles County Flood Control District for future operation, maintenance, repair, and improvement. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City does hereby request that the Los Angeles County Flood Control District accept the transfer and conveyance of the storm drain improvements and drainage system depicted on Los Angeles County Flood Control District Drawing Nos. 364-1107-F7.1 to 364-1107-F7.14 on file with the Director of the County of Los Angeles Department of Public Works. SECTION 2. Subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents to effectuate said transfer and conveyance and that the Mayor is authorized and instructed to execute said documents and other instruments. The Los Angeles County Flood Control District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights of way for said drain now vested in the City and all other necessary rights of way have been conveyed to and accepted by the Los Angeles County Flood Control District.
