Minutes - 08-10-10 Regular Meeting MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING AUGUST 10, 2010 The City Council of the City of Downey held a Regular Meeting at 7:30 p.m., August 10, 2010, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor Anne M. Bayer presiding. PRESENT: Council Members: Anne M. Bayer Mayor Luis H. Marquez Mayor Pro Tem Roger C. Brossmer (absent excused) David R. Gafin Mario A. Guerra ALSO PRESENT: Gerald M. Pomrehn, Assistant Deputy City Manager Rick Esteves, Police Chief John Michicoff, Finance Director John Oskoui, Public Works Director Thad Phillips, Community Services Director Brian Saeki, Community Development Director Jeff Turner, Fire Chief Susan Domen, Deputy City Clerk Other City Staff COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND CONFERENCE/MEETING REPORTS: Council Member Gafin recognized former Council Member Diane Boggs and Chamber of Commerce Vice President Patricia Kotze in the audience. Council Member Guerra reported that he attended a community forum sponsored by Southern California Edison; announced he had a great personal week with the celebrations of his thth 25 wedding anniversary and his mother in-law’s 90 birthday as well as taking his youngest daughter to college; explained that over the next several months the Council will diligently be recruiting for a new City Attorney. Mayor Bayer recognized Council Candidate Alex Saab in the audience. PRESENTATIONS: Mayor Bayer announced there would be an added presentation. -1- City Council Minutes 08/10/10 Dorothy Pemberton and Tina Hernandez with the Downey Girls Ponytail Athletic Association announced that 4 teams advanced to the ASA World Championship of Girls Softball: 10 year old ththth division took 13 place, 14 year olds took 9 place, the 16 Under division took 4 place, 12 Under nd took 2 place. They presented trading pins to the Council, staff and the audience. recessedreconvened The meeting at 7:39 p.m. and with all Council Members present at 7:42 p.m. PUBLIC HEARINGS: None. NON-AGENDA PUBLIC COMMENT: Derek Allatore (sp?), representative for the Air Quality Management District, thanked the City for using funding towards alternative fuel vehicles and infrastructures; and invited the Council to the Clean Air Awards to be held October 2, 2010 at the Biltmore Hotel. John Lacy, resident of Downey, noted his concerns for the City pension funds; the lack of transparency with CalPers; the hiring of the City Attorney and their representing the interest of the entire City; and the landscape overgrowth covering the Police Station sign. Oscar Loreto, resident of Downey, requested that the Council review the elbow pad requirement at the skate park and requested it be optional. CONSENT ITEMS REMOVED: None. CONSENT CALENDAR: It was moved by Council Member Gafin, seconded by Mayor Pro Tem Marquez, and approve the remainder of the Consent Calendar unanimously carried to items as recommended: 1. APPROVED CITY COUNCIL MINUTES: Regular and Adjourned Meetings July 27, 2010; : Special Meeting July 29, 2010 City Clerk. 2. APPROVED WARRANTS ISSUED: Warrant Nos. 251863 – 252254; Wire Nos. 30002197 – : 30002205 and 613 – 627; in the total amount of $7,606,110.62 Finance. 3. CASH CONTRACT NO. S.S. 593 – DOWNEY AVENUE PAVEMENT REHABILITATION TH PROJECT - 5 STREET TO GALLATIN ROAD – APPROVED PLANS AND SPECIFICATIONS AND GRANTED AUTHORITY TO ADVERTISE FOR BIDS: Public Works. 4. APPROVED AGREEMENT FOR PARTICIPATION IN LOS ANGELES REGION IMAGERY ACQUISITION CONSORTIUM PROJECT AND APPROPRIATED $43,120 FROM THE WATER FUND: Administration. 5. APPOINTMENT AND AGREEMENT FOR INTERIM CITY ATTORNEY AND GENERAL COUNSEL FOR THE COMMUNITY DEVELOPMENT COMMISSION: Administration. -2- City Council Minutes 08/10/10 A. ADOPTED RESOLUTION NO. 10-7214, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPOINTING CHARLES S. VOSE INTERIM CITY ATTORNEY, INTERIM GENERAL COUNSEL FOR THE COMMUNITY DEVELOPMENT COMMISSION AND APPROVING AN AGREEMENT. 6. ADOPTED ORDINANCE NO. 10-1263, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING AN OIL PIPELINE FRANCHISE TO PARAMOUNT PETROLEUM CORPORATION: Public Works. 7. ADOPTED ORDINANCE NO. 10-1264, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 4230 AND 10110, AND ADOPTING A NEW CHAPTER 3 IN ARTICLE X, ENTITLED DOG PARK AREAS, OF THE DOWNEY MUNICIPAL CODE TO PERMIT DOGS TO RUN OFF-LEASH IN CERTAIN PARK AREAS DESIGNATED BY THE CITY: Administration. ADMINISTRATIVE REPORTS: 8. RECEIVED AND FILED TRAFFIC CALMING PROGRAM UPDATE: Public Works. Public Works Director Oskoui explained that this program started approximately 2 years ago at the request of Council Member Gafin. Since that time several town hall meetings were held and surveys were conducted. On May 13, 2008 the Council adopted the policy for the program. He continued by noting that 66 surveys/requests were returned and after review 19 of them did not qualify for the program. The remaining 47 were divided amongst districts and reviewed with the Council Members. It was determined that 24 need immediate attention and Phase 1 measures have been implemented. He concluded that the grant for the speed signs with CalTrans can take up to 3- 4 months to get approval and then the construction phase can begin. Council Member Gafin asked for clarification that the other portions of Phase 1 are being conducted while awaiting the speed sign installation and was told that they were. Council Member Guerra noted that he feels that the residential streets could have Phase 2 speed bumps installed now instead of waiting. City Manager Caton responded that staff’s opinion is that speed bumps can create other unsafe conditions and would not suggest putting them around the City. Council Member Guerra then asked if the bumps recently installed at the Discovery Sports Complex can be extended to the sidewalks as it has created a new hazard with cars driving around them. Mayor Pro Tem Marquez requested that Public Works work closely with the Police Department on the identified areas and thoroughly review the situations and options available. It was moved by Council Member Gafin, seconded by Mayor Pro Tem Marquez and receive and file the report. unanimously carried to OTHER BUSINESS: 9. ADOPTED RESOLUTION NO. 10-7215, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING VOTING DELEGATE AND ALTERNATE(S) FOR LEAGUE OF CALIFORNIA CITIES CONFERENCE, SEPTEMBER 15–17: City Council. Mayor Bayer polled the Council for which members were planning on attending the conference and was told that Mayor Pro Tem Marquez and Council Member Guerra would be. -3- City Council Minutes 08/10/10 It was moved by Council Member Gafin, seconded by Council Member Guerra and unanimously adopt the Resolution appointing Mayor Pro Tem Marquez the voting delegate and carried to Council Member Guerra the alternate.
