SUBJECT: RESOLUTION AUTHORIZING THE SUBMITTAL OF APPLICATIONS
TO CALRECYCLE FOR ALL AVAILABLE GRANTS UNDER THE USED
OIL PAYMENT PROGRAM.
RECOMMENDATION:
That the City Council adopt:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE SUBMITTAL OF APPLICATIONS TO CALRECYCLE FOR ALL
AVAILABLE GRANTS UNDER THE USED OIL PAYMENT PROGRAM.
DISCUSSION:
The City has been receiving Used Oil Recycling Block Grants through the California
Integrated Waste Management Board since 1995. These grants, which support the
City’s used oil program, have also allowed the City to establish State Certified Collection
Centers for used motor oil and filters, and have funded valuable literature informing
residents about the environmental impacts of illegal dumping of toxic materials.
In December 2009, the State eliminated the California Integrated Waste Management
Board and in its place created the Department of Resources Recycling and Recovery
(CalRecycle). Beginning July 2010, CalRecycle will be eliminating the Used Oil Block
Grant Program and creating a new Used Oil Payment Program (OPP). Although the
City has a resolution in place that allows application submittals for the block grants, a
new resolution is required for the new OPP.
CalRecycle is allowing the new resolution to be open-ended, until rescinded by the City
Council. The adoption of this resolution would allow the City Manager or his designee
to submit applications for all available grants under the OPP. This resolution will
eliminate the need to request council authorization to submit a grant application each
year.
FINANCIAL IMPACT:
There will be a savings in staff time by not having to prepare and present a resolution to
the City Council authorizing OPP grant applications each year.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE SUBMITTAL OF APPLICATIONS TO CALRECYCLE
FOR ALL AVAILABLE GRANTS UNDER THE USED OIL PAYMENT PROGRAM.
WHEREAS
, pursuant to Public Resources Code § 48690 the Department of Resources
Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste
Management Board, has established the Used Oil Payment Program (OPP) to make payments
to qualifying jurisdictions for implementation of their used oil programs; and
WHEREAS
, in furtherance of this authority CalRecycle is required to establish
procedures governing the administration of the OPP; and
WHEREAS
, CalRecycle’s procedures for administering the OPP require, among other
things, an applicant’s governing body to declare by resolution certain authorizations related to
the administration of the OPP.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1.
Authorizes the submittal of OPP applications to CalRecycle.
SECTION 2.
The City Manager, or his designee, is hereby authorized and empowered
to execute in the name of the City of Downey all necessary documents, including but not limited
to, applications, agreements, annual reports including expenditure reports and amendments
necessary to secure said payments to support the City’s used oil program.
SECTION 3.
This authorization is effective until rescinded by the City Council of the City
of Downey.
SECTION 4.
The City Clerk shall certify to the adoption of this Resolution.
