APPROVED CLOSED SESSION MINUTES: April 13, 2010. It was moved by Council Member/Commissioner Brossmer, seconded by Council Member/Commissioner Guerra and was so ordered to approve the minutes, noting the absence of Mayor Pro Tem/Vice Chairperson Marquez. RECESSED TO CLOSED SESSION: Mayor/Chairperson Bayer announced the Council/Commission is recessing to Closed Session (6:31 p.m.) to discuss matters under the authority of the following sections of the Government Code: 1. Government Code Section 54956.8 – Conference with rea\ property negotiator Gerald Caton re: property at 1 1500 Brookshire Avenue; negotiating party: Downey Regional Medical Center; under negotiations: price and terms of payment. 2.Government Code Section 54957.6 – Conference with labor negotiator Gerald Caton re: direction for labor negotiations with City Employees Association – Miscellaneous and Maintenance; Public Safety Auxiliary; Executive Management, Middle Management and Confidential/Exempt; Firemen’s Association; Fire Management; Police Officers Association; Police Management. City Council/Community Dev. Comm. Minutes (adj.) 04/27/10 -1 - 3. RECONVENED: The meeting reconvened in Open Session at 7:31 p.m., noting the absence of Mayor Pro Tem/Vice-Chairperson Marquez. There were no actions to report. Council Member/Commissioner Guerra announced a potential conflict of interest regarding Item No. 1 and did not participate. Minutes (adj.) 04/27/10 -2- MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING APRIL 27, 2010 The City Council of the City of Downey held a Regular Meeting at 7:34 p.m., Aphl 27, 2010, in the Council Chamber of the Downey City Hall, 1 1111 Brookshire Avenue, Downey, California, Mayor Anne M. Doyle, Chief Deputy Clerk Other City Staff COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND CONFERENCE/MEETING REPORTS: Council Member Guerra noted that the Gallatin Elementary School “Grizzlies” collected over 12,000 plastic bags for Earth Day; mentioned True Lasting Connections (TLC) Softball game fundraiser; he attended the Gangs Out of Downey (GOOD) Luncheon and 2 Neighborhood Watch meetings last week; mentioned he and Assistant City Manager Livas recently met with Southern California Edison representatives regarding providing incentives to local businesses; stated Mbyor Pro Tem Marquez was in Sacramento regarding Tesla Motors; and requested that the City expand the Memorial Day activities. Council Member Gafin announced Kids Day Hall of Fame tomorrow at 7:00 p.m. in the Downey Theatre, annual Chamber of Commerce Street Faire this Saturday, annual Kids Day event at Furman Park on May 8th, and Concerts in the Park will begin in July. Mayor Bayer announced Calvary Chapel will be doing a railroad right-away cleanup on April 29th; and Keep Downey Beautiful will meet at 9:00 a.m. on My 15th at Ralph’s Market located at Gallatin Road and Lakewood Boulevard for a cleanup. City Council/CDC Agenda 04/27/1 0 1 PRESENTATIONS: Mayor Bayer presented a Proclamation declaring May 8 as Kids Day. Mayor Bayer presented a Proclamation declaring May as Building Safety Week. Mayer Bayer presented a Proclamation declaring April DMV/Donate Life California Month. Mayer Bayer presented a Certificate of Recognition to American Youth Soccer Organization (AYSO) Downey United, Region 24, Bow under 10 team for winning the State Championship. PUBLIC HEARINGS: 1.DEVELOPMENT AGREEMENT NO. 09-94 WITH AMUSEMENT INDUSTRY INC. DBA WESTLAND INDUSTRIES TO REDEVELOP THE 1.15 ACRE PARCEL AT THE SOUTHWEST CORNER OF FIRESTONE BOULEVARD AND DOWNEY AVENUE, 8236 – 8274 FIRESTONE BOULEVARD INTO A 26,232 SQUARE FOOT FOOD COURT/ RETAIL CENTER: Economic Development. A. INTRODUCED AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING A STATUTORY DEVELOPMENT AGREEMENT WITH AMUSEMENT INDUSTRY INC. DBA WESTLAND INDUSTRIES FOR PROPERTY LOCATED AT 8236 – 8274 FIRESTONE BOULEVARD. B. APPROVED AMENDMENT TO COMMUNITY DEVELOPMENT BLOCK GRANT RECOVERY ACTION PLAN INCREASING FUNDING FOR A PUBLIC IMPROVEMENT PROJECT Mayor Bayer opened the Public Hearing at 8:04 p.m. City Clerk Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Brossmer, seconded by Council Member Gafin and so ordered to receive and file. Economic Development Director Perfitt gave the staff report and Power Point presentation explaining the strategy to encourage redevelopment and recycling of existing properties in the downtown area through higher and better land uses, and complimenting the new Portos Bakery development. He explained this project will feature 26,000 square feet of restaurants and retail uses. This project creates approximately 100 additional parking spaces involving the conversion of Nance Avenue to an east and westbound vehicular traffic street. Director Perfitt added this project is within the Downtown Parking District allowing the parking requirements to be met using off-site and public parking spaces. The project provides for the construction of an 8-inch water main below Nance Avenue which will advance future projects in the City. The Development Agreement allows the property owner to pre-pay for the parking spaces necessary to facilitate redevelopment. It also contains a cost-sharing mechanism where the property owner pays for their fair share of the costs related to constructing the parking lot and right-of-way. He further noted this project is funded by federal stimulus monies. City Council/CDC Agenda 04/27/10 a Director Perfitt showed a site plan and conceptual design of the proposed project located on the southwest corner of Firestone Boulevard and Downey Avenue which is approximately a 50,000 square feet. He noted the names of several prospective tenants. There being no Council questions and no one coming k)rward to speak, it was moved by Council Member Gafin, seconded by Council Member Guerra, and so ordered to close the Public Hearing, the time being 8:15 p.m. Council Member Guerra said he as well as Council Member Brossmer, as members of the Downtown Subcommittee, have been studying the plans and designs for a long time for this development, and this project will bring new energy to the area and the additional parking is needed. He further added that this location has been landlocked and it is citical to be able to make a left turn when going northbound on Downey Avenue into the businesses. Prior to the vote, Council Member Gafin stated it was exciting to see new additional development in the area. Council Member Brossner said it was a great development and he also agreed with Council Member Guerra that vehicles must be able to make a left hand tum from northbound Downey Avenue into the businesses. It was moved by Council Member Brossmer, seconded by Council Member Guerra and unanimously carried, noting the absence of Mayor Pro Tem Marquez, to introduce the Ordinance and amend the Plan. 2.ISSUANCE OF RECOVERY ZONE FACILITY REVENUE BONDS FOR SUNEDISON TO FUND SOLAR ENERGY PANELS ON PROPERTY LOCATED AT 300 STONEWOOD CENTER (KOHL’S DEPARTMENT STORE): Community Development. A. ADOPTED RESOLUTION NO. 10-7184, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE ISSUANCE BY THE CALIFORNIA STATEWIDE COMMUNITIES DEVELOPMENT AUTHORITY OF RECOVERY ZONE FACILITY REVENUE BONDS FOR THE SUNEDISON CALIFORNIA PORTFOLIO (SOLAR ENERGY PANELS AT 300 STONEWOOD CENTER, KOHL'S DEPARTMENT STORE). Mayor Bayer opened the Public Hearing at 8:19 p.m. City Clerk Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Brossmer, seconded by Council Member Guerra, and so ordered to receive and file. Community Development Director Saeki gave the staff report noting Kohl’s Department Store in Stonewood Shopping Center recently entered into an agreement with SunEdison to install solar panels on the roof top of its store and at many other Kohl's Department Stores throughout the United States. He explained that SunEdison has installed many solar installations worldwide. It was noted that there is no City liability for the bonds. Council Member Guerra expressed that this is a cost effective way for the City to facilitate these types of projects. Council Member Gafin noted that the City needs to catch up in regards to going Green. Mayor Bayer stated that these t)pes of projects are always supported. It was moved by Council Member Gafin, seconded by Council Member Guerra and unanimously carried, noting the absence of Mayor Pro Tem Marquez, to adopt the Resolution. City Council/CDC Agenda 04/27/1 0 3 NON-AGENDA PUBLIC COMMENT: The following persons expressed concern about the relocation of the Farmers Market to Downey Avenue, recently approved by the City Council: David Llamas, owner of Mambo Grill; Bob Udoff, manager 1 1015 Downey Avenue Rosa Leguizamo, works Hair Studio Armando Duarte, Art Design John Lehman, Miller-Mies Mortuary John Rivera, owner Downey Hair Studio Daniel, owns One-Day Cleaners Bob Udoff submitted correspondence showing the results of a survey of the businesses.
