SUBJECT:ADOPTION OF ORDINANCE ESTABLISHING A NEW PUBLIC WORKS
COMMITTEE
RECOMMENDATION:
That the following attached Ordinance be adopted:
“AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING ARTICLE II ADMINISTRATION, OF CHAPTER 4 DEPARTMENTS BOARDS
AND COMMISSIONS BY DELETING PART 2 TRAFFIC COMMITTEE AND PART 7 WATER
BOARD AND ADDING A NEW PART ENTITLED PUBLIC WORKS COMMITTEE TO THE
DOWNEY MUNICIPAL CODE.”
DISCUSSION
:
At the April 13, 2010 City Council meeting, the above referenced Ordinance was
introduced with amendments naming it Public Works Committee and providing that the
appointments be made at large instead of by City Council districts. The amendments have
been incorporated.
BACKGROUND:
On March 9, 2010, the City Council directed staff to prepare an Ordinance deleting the Health
& Environmental Sanitation Committee, Traffic Committee, and Water Board and creating a
new Public Services Committee with ten (10) members.
The approved duties include review and making recommendations regarding:
Traffic and parking;
Solid waste and recycling;
Wastewater collection and disposal;
Air quality;
Hazardous waste;
Public Utilities;
Transportation and mobility;
Water supply;
Energy consumption and conservation;
Urban runoff and water quality;
Urban blight and streetscape;
Other matters affecting a health and safe environment; and
Any other matters specifically requested to be reviewed by the City Council.

ORDINANCE NO. 10-
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING ARTICLE II ADMINISTRATION, OF CHAPTER 4 DEPARTMENTS
BOARDS AND COMMISSIONS BY DELETING PART 2 TRAFFIC COMMITTEE
AND PART 7 WATER BOARD AND ADDING A NEW PART ENTITLED
PUBLIC WORKS COMMITTEE TO THE DOWNEY MUNICIPAL CODE.
WHEREAS,
the City Council reviewed the status and necessity of the Health and
Environmental Sanitation Committee, Traffic Committee and Water Board at its February 9,
2010 regular City Council meeting; and
WHEREAS
, many of the advisory duties of these Committees and Board have been
preempted by State laws, regulatory authorities, or are no longer relevant due to the passage of
time since their creation; and
WHEREAS,
the City Council desires to consolidate the three Public Works related
Committees and Board into one new Public Works Committee; and
WHEREAS
, the City Council by Ordinance No. 09-1249, adopted on July 28, 2009,
dissolved Vehicle Parking District No. 1 and disbanded the Commission and it still remains in
the Municipal Code as Part 6, entitled Parking Place Commission, of Article II, Administration
and this needs to be removed for clarity.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
ORDAIN AS FOLLOWS:
SECTION 1.
The Health and Environmental Sanitation Committee, formed by City
Council action in 1980, is hereby dissolved.
SECTION 2.
Part 2, Traffic Committee of Article II, Administration, of the Downey
Municipal Code, is hereby deleted in its entirety.
SECTION 3.
Part 6, Parking Place Commissioners of Article II, Administration, of the
Downey Municipal Code, is hereby deleted in its entirety.
SECTION 4.
Part 7, Water Board of Article II, Administration, of the Downey Municipal
Code, is hereby deleted in its entirety.
SECTION 5.
There is hereby created a new Part 2 under Article II, Administration, of
the Downey Municipal Code to read as follows:
“Part 2 - PUBLIC WORKS COMMITTEE
SECTION 2410. CREATION OF COMMITTEE.
There shall be and here is hereby
created a Public Works Committee which shall be responsible for recommendations made to
the City Council as requested by the City Council.
SECTION 2411. MEMBERS.
The Public Works Committee shall consist of ten (10)
members who shall be qualified electors of the City, two nominated by each Council Member,
subject to the approval of the entire City Council. Appointed members of the Committee shall
receive no compensation. A quorum shall consist of six (6) of the ten (10) members.

SECTION 2412. TERM.
Members shall have a term of four (4) years and serve until a
respective successor is appointed. The terms of the members of the first board appointed shall
coincide with the term of the Council Member making the initial appointments. The membership
shall be terminated automatically upon the missing of three consecutive meetings and which
absences are unexcused.
SECTION 2413. CHAIRPERSON.
The Committee shall elect its Chairperson and Vice-
Chairperson from its appointed members for a term of one (1) year.
SECTION 2414. MEETINGS.
The Committee shall meet at least once every month at a
date, time and place to be determined by adopted Bylaws.
SECTION 2415. RECORD.
The Committee shall keep an accurate record of all
documents presented, including agendas, minutes, notices, correspondence, proof of posting,
etc., which shall be a public record.
SECTION 2416BYLAWS.
.The Committee may adopt Bylaws setting the dates, time
and places of meetings and rules as it may deem advisable for the purpose of conducting its
meetings. Bylaws shall not conflict with any of these provisions and shall not be effective until
ratified by the City Council.
SECTION 2417. DUTIES.
The duties of said Public Works Committee shall be advisory
in nature, including review and making recommendations to the City Council regarding parking
and traffic; solid waste and recycling; wastewater collection and disposal; air quality; hazardous
waste; public utilities; transportation and mobility; water supply; energy consumption and
conservation; urban runoff and water quality; urban blight and streetscape; other matters
affecting a healthy and safe environment; and any other matters specifically requested to be

reviewed by the City Council.
SECTION 6.
If any provision, clause, sentence, or paragraph of this Ordinance or the
application thereof to any person or circumstances, shall be held invalid, such invalidity shall not
affect the other provisions or applications of the provisions of this Ordinance which can be given
effect without the invalid provisions or applications and, to this end, the provisions of this
Ordinance are hereby declared to be severable.
SECTION 7.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be published and posted in the manner required by law.
