Lehman Advocacy Services AGENDA MEMO DATE: February 23, 2010 TO: Mayor and Members of the City Council FROM: Office of the City Manager By: Desi Alvarez, Deputy City Manager SUBJECT: AGREEMENT WITH LEHMAN, LEVI, PAPPAS AND SADLER GENERAL ADVOCACY SERVICES IN SACRAMENTO RECOMMENDATION That the City Council approve an extension of the agreement with Lehman, Levi, Pappas and Sadler, from January 31, 2010 to January 31, 2011. DISCUSSION Many of the actions taken by both the state legislature and various state agencies such as CAL EPA, the State Water Board, and CALTRANS affect the City of Downey. Because many of their actions impact the City’s finances, Downey has an interest in influencing the actions taken by the legislature and state agencies. To effectively have influence on key issues and ensure its interests are not overlooked, the City needs to have a presence in Sacramento. Like most agencies which are based outside of Sacramento, it is difficult for the City to advocate its interest on a long distance basis, and since having a full time staff person in Sacramento is expensive and impractical, the next best thing is to contract with a firm based in Sacramento that can represent the City’s interest before legislature and state agencies. The City of Downey has retained the services of Mr. Rick Lehman since 1999 to represent its interests on a day to day basis before State Agencies and the Governor’s and Legislatative Offices in Sacramento. Mr. Lehman is the senior partner in Lehman, Levi, Pappas and Sadler, a partnership that provides representation for both public agencies and private companies in Sacramento. The City’s arrangement with Lehman, Levi, Pappas and Sadler is based on an annual agreement which runs through January 31, 2010. To continue to have adequate representation in Sacramento, an extension of the agreement between the City and the firm is necessary. Compensation under this agreement will remain at the current rate of $3,600 per month and includes a provision for reimbursements for travel and other actual expenses as authorized by the City. FISCAL IMPACT Funds for this are budgeted in Account No. 51-4-3550-0700. Attachments: Agreement CITY OF DOWNEY, CALIFORNIA AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH LEHMAN, LEVI, PAPPAS AND SADLER FOR GENERAL ADVOCACY SERVICE S THIS AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT (the “Amendment”) is entered into this day of January, 2010 by and between the City of Downey , a California municipal corporation and charter city with its principal place of business at 11111 Brookshire Avenue, Downey California 90241 ("City") and Lehman, Levi, Pappas and Sadler ("Consultant"). RECITALS WHEREAS, the City and Consultant entered into Professional Services Agreement (“Agreement”) for providing general advocacy services. WHEREAS, the City and Consultant desire to amend the Agreement. NOW, THEREFORE, in view of the above-recitals and mutual promises and covenants contained herein, the parties agree as follows: AGREEMENT Section 1. Validity of Agreement. Except as expressly amended in this Amendment, the Agreement shall remain in full force and effect. Other than the specific matters set forth in this Amendment, this Amendment is not intended to modify the responsibilities of the parties. Section 2. Amendment of Term of Agreement. City and Consultant hereby amend paragraph 3.1.2 on page 2 of the Agreement to state as follows: “3.1.2 This agreement shall be effective until January 31, 2011, unless otherwise terminated consistent with the terms of this Agreement.” Section 3. Fees and Payment. City and Consultant agree that there shall be no change in compensation.
