Ragland, Director of Public Works SUBJECTFY 2009/10 RESIDENTIAL STREET RESURFACING PROJECT : RECOMMENDATION: That the City Council authorize the Mayor to execute a sole source Professional Services Agreement with Leah A. Kabbara dba Kabbara Engineering for the preparation of plans, specifications, engineer’s estimate and bid documents for the FY 2009/10 Residential Street Resurfacing Project, for an amount not to exceed $52,840. DISCUSSION: In 2007, staff initiated Cash Contract No. S.S. 571 – The FY 2008/09 Residential Street Resurfacing Project. This project involved the rehabilitation of existing pavement and miscellaneous concrete improvements and repairs along 57 residential street segments within the City. Staff solicited proposals from qualified firms to prepare the plans, specifications and engineer’s estimate (PS&E) for the project. Based on the review of the proposals received, Kabbara Engineering (Kabbara) was identified as the most qualified based on their relevant experience, project understanding, demonstrated knowledge of the project scope-of-work and competitive professional services fee. At the January 8, 2009 meeting, the City Council authorized the Mayor to execute a Professional Services Agreement with Kabbara. During the construction of the street segments, unknown conditions related to the base material were encountered that resulted in quantity increases and, consequently, increases in project cost. Specifically, the subgrade material encountered consisted of large 1-1/2-inch to 2-inch rock rather than the normal ¾-inch rock that is normally utilized in the majority of the streets in the City. The grinding and removal activities included in the construction contract had to be modified resulting in a change in the construction activities and substantial increase in the project costs. In order to stay within project budget, the number of street segments completed under Cash Contract No. S.S. 571 were reduced by 36, from 57 to 21. The 36 street segments that were deleted from S.S. 571 are included in the FY 2009/2010 Residential Street Resurfacing Project. The original designs for these streets will be revised to address the work required to address the subgrade in these segments. In addition, two locations that were not included in Cash Contract No. S.S. 571 (Marbel Avenue between Nada Street and McCallum Street and McCallum Street between Marbel Avenue west and Marbel Avenue east) have been added to the proposed project for a total of 38 residential street segments. CITY OF DOWNEY, CALIFORNIA FY 2009/10 Residential Street Resurfacing Project February 23, 2010 Page 2 Initially, the services of an engineering consultant will be necessary to prepare the PS&E and bid documents suitable for bidding purposes for the FY 2009/10 Residential Street Resurfacing Project. The work will generally include the revision of all plan sheets to address the unknown conditions encountered during the construction of Cash Contract No. S.S. 571, preparing plans for the two new additional street segments, field survey for all concrete improvements, distribution of utility notices, revision of Cash Contract No. S.S. 571 project specifications and updating the construction cost estimate. Kabbara, having satisfactorily completed the PS&E for Cash Contract No. S.S. 571, and having the most familiarity with the design aspects of the street segments to be completed under the FY 2009/10 Residential Street Resurfacing Project, has been identified as the most qualified consultant to provide the same professional services for this project. Staff has found the man-hour rates included in the project fee to be reasonable and comparable to the rates charged by other consulting engineering firms. Therefore, staff requests the City Council to waive the professional services selection process and authorize a sole source Professional Services Agreement with Kabbara. The FY 2009/10 Residential Street Resurfacing Project will include pavement rehabilitation of 38 residential neighborhood street segments as mentioned previously. The proposed work will generally consist of upgrading existing pavement conditions to extend its useful life by a minimum of ten years and will specifically include the reconstruction of failed asphalt pavement areas, adjustment of manholes and utility valve covers to grade; construction of new curb and gutter where currently not provided; reconstruction of uplifted curb, gutter, sidewalk and driveway approaches and replacement of traffic striping and pavement markings. The locations of the 38 residential street segments are depicted on the attached Project Location Map (Exhibit “A”). FINANCIAL IMPACT: The FY 2009/2010 Capital Improvement Program Budget includes sufficient funds for the subject professional services agreement under Account No. 26-16622.
