Ragland, Director of Public Works SUBJECT: LIGHTING AND LANDSCAPING ASSESSMENT DISTRICT NO. 121 - FISCAL YEAR 2010 / 11 RECOMMENDATION: That the City Council adopt: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT ON ASSESSMENTS WITHIN LIGHTING AND LANDSCAPING ASSESSMENT DISTRICT NO. 121 FOR FISCAL YEAR 2010 / 11 DISCUSSION: The cost for maintaining and servicing many of the streetlights, traffic signals and parkway and median trees throughout the City is paid from a combination of assessments on individual parcels under the Landscaping and Lighting Act of 1972, as well as revenues from general property taxes. There are approximately 6,294 streetlights in the City of Downey which provide illumination for traffic and pedestrian safety. Of the total, approximately 1,502 streetlights are owned by the City of Downey, 57 are owned by the State, 33 are shared with other cities, and the remainder owned by the Southern California Edison Company (SCE). In addition, there are 107 traffic signals within the City that are included in the assessment district. Assessment District No. 121 (District) is made up of seven zones. Zones I through VI provide funding for the maintenance of streetlights and traffic signals. Zone L provides funds for tree trimming, tree removals and other landscaping maintenance along the parkways and medians of public streets in the City. The California Streets and Highways Code requires the City to prepare an Engineer’s Report every year to evaluate the assessment rates for the various zones within the District. The City Council will review the results of the Engineer’s Report and subsequently set a public hearing date. At the public hearing, the assessment rates will be confirmed and set for the various zones within the District for the ensuing year. Attachment: Resolution S:\AgendaMemosCC2010\02-9-10\LL Assess Dist AD121 RESOLUTION NO. _____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT ON ASSESSMENTS WITHIN LIGHTING AND LANDSCAPING ASSESSMENT DISTRICT NO. 121 FOR FISCAL YEAR 2010 / 11 WHEREAS, the Lighting and Landscaping Act of 1972 of the California Streets and Highways Code (Section 22605 et seq.) provides for the levy and assessment within Lighting and Landscaping Assessment District No. 121 for the purpose of maintaining landscaping and public lighting facilities within the City; and WHEREAS, the boundaries of Lighting and Landscaping Assessment District No. 121 are described and set forth on that certain map identified as A.D. 121-B on file in the office of the City Clerk, where it is available for public inspection; and WHEREAS, the 1989 legislative amendment to Section 22525 of the California Streets and Highways Code provides for the levy and assessment within Lighting and Landscaping District A.D. 121, for the purpose of providing, maintaining and operating public traffic signal equipment in the City; and WHEREAS, the Lighting and Landscaping Act of 1972 of the California Streets and Highways Code provides for the levy and assessment for the purpose of maintenance of on-street and public facility landscaping at the June 23, 2009 hearing the City Council passed Resolution 09-7137 upon all written and oral protests made in reference to the improvements. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council proposes to levy and collect assessments within Lighting and Landscaping Assessment District No. 121 for Fiscal Year 2009 / 10, pursuant to the Lighting and Landscaping Act of 1972 (Section 22605 et seq.), as amended by the 1989 legislative amendment to Section 22525 and the 1992 legislative amendments (S.B. 1977) of the California Streets and Highways Code. SECTION 2. The Engineer is ordered to prepare and file a report in accordance with the provisions of Section 22585 of the California Streets and Highways Code. RESOLUTION NO. ____ PAGE TWO SECTION 3.
