It was moved by Council Member/Commissioner Brossmer, seconded by Council Member/Commissioner Gafin and unanimously carried to approve. RECESSED TO CLOSED SESSION: Mayor/Chairperson Guerra announced the Council/Commission is ncessing to Closed Session (6:34p.m.) to discuss matters under the authority of the following sections of the Government Code: 1. Government Code Section 54956.8 – Conference with real property negotiator Gerald Caton re: property located at 12224 Lakewood Boulevard (Downey Studios); negotiating party: Stuart Lichter, Industrial Realty Group; under negotiations: price and terms of payment. 2. Government Code Section 54957.6 – Conference with labor negotiators Council Members Brossmer and Gafin re: direction for labor negotiations with City Manager. RECONVENED: City Council/Community Dev. Minutes (adj.) 11/24/09 -2- MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING NOVEMBER 24, 2009 The City Council of the City of Downey held a Regular Meeting at 7:43 p.m., November 24, 2009, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor Mario A. Pomrehn, Assistant Deputy City Manager Roy Campos, Police Chief John Michicoff, Finance Director Thad Phillips, Community Services Director Brian Ragland, Public Works Director Jeff Turner, Fire Chief Susan Domen, Deputy City Clerk Other Staff COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND CONFERENCE/MEETING REPORTS: Council Member Brossmer noted he attended the Porto’s Bakery groundbreaking ceremony and played in the Police department softball tournament last week and he congratulated the Fire Department for winning the tournament; he attended a Columbia Memorial Space Science Learning Center subcommittee meeting with Council Member Gafin; and announced the annual Tree Lighting Ceremony will be held Monday. Council Member Gafin stated he attended several Neighborhood Watch meetings; the Veteran’s Day ceremony at the Civic Theatre; the Keep Downey Beautiful clean-up last Saturday; and the Gangs Out of Downey meeting on Tuesday morning; he announced the Chamber of Commerce will be hosting the Annual Holiday Lane Parade on December 6th; recognized Robert Zavala and Patti Coates from the Chamber of Commerce in the audience; and wished everyone a Happy Thanksgiving Mayor Pro Tem Bayer noted there will be snow in Downey on Monday at the Annual Tree Lighting Ceremony; and announced the Police Chief Transition will take place at 10:30 a.m. on December 1 ;t in the Council Chamber. City Council Minutes 1 1/24/09 -1- Council Member Marquez recognized former Council Member Cartozian and Commissioner Janet Molinaro in the audience; complimented staff and Council Member Brossmer for the Veterans Day event; noted he attended the Porto’s groundbreaking ceremony yesterday; and reported on recent Orangeline Authority activities noting that funds have been allocated towards the project from State Measure R. Mayor Guerra reported he attended the Mayor’s Prayer Breakfast hosted by the Downey Christian Businessmen’s Association, and the Warren High School/Downey High School rivalry football game; recognized his wife and son in the audience; announced his daughter was named captain of her water polo team; he attended the 5th Annual Thanksgiving Interfaith service, Chief Campos’ retirement luncheon, the City Employees dinner, and several Neighborhood Watch meetings last week; he noted that Downey has one of lowest unemployment rates at 10.2 % and has created over 4000 jobs in the past year; and announced Coca Cola has a new system to clean bottles that will save 14,000 gallons of water per year. PRESENTATIONS: Mayor Guerra presented the Mayor’s Diakonia (servant) award to William T. Coomes. Mayor Guerra narrated a video presentation of “Most Business Friendly City”. PUBLIC HEARINGS: None Mayor Guerra asked Deputy City Manager Sauter to provide an update on the flu shot clinic. Deputy Sauter mentioned that the last HINI Flu Shot Clinic to be held in Downey this year will take place on Saturday, December 5th at the Downey Adult School located on Woodruff Avenue and Imperial Highway. The target priority groups remain the same. NON-AGENDA PUBLIC COMMENT: Kirk Cartozian, Downey business owner, complimented the City Council, City Manager and staff on all of the recent and future accomplishments in the City noting that this is an unprecedented time for economic development. John Lacey, resident of Downey, thanked Mayor Guerra for his efforts in improving the City during his term as Mayor. CONSENT ITEMS REMOVED: 3. 5. CONSENT CALENDAR: It was moved by Council Member Gafin, seconded by Council Member Brossmer and unanimously carried to approve the remainder of the Consent Calendar items as recommended: City Council Minutes 1 1/24/09 -2- 1.APPROVED CITY COUNCIL MINUTES: Regular and Adjourned Meetings November 10, 2009: City Clerk. 2.APPROVED WARRANTS ISSUED: Warrant Nos. 245369 – 245661 ; Wire Nos. 524 – 528 and 30002024 – 30002032; in the total amount of $3,268,802.40: Finance. 4.CASH CONTRACT NO. 650 – DISCOVERY SPORTS COMPLEX (12400 Columbia Way) – APPROPRIATED $21,258 1N STATE RECREATION GRANT FUNDS: Administration. 6.APPROVED AMENDMENT TO AGREEMENT WITH RMC WATER AND ENVIRONMENT INCREASING THE CITY’S FUNDING OBLIGATION BY $25,000 TO COMPLETE ADDITIONAL ACTIVITIES ASSOCIATED WITH THE SEWER MASTER PLAN : Public Works 7.ADOPTED RESOLUTION NO. 09-7168, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING PATTON ROAD AS A THROUGH STREET AT ITS INTERSECTION WITH BOYNE STREET AND APPROVING THE INSTALLATION OF A STOP SIGN ON THE BOYNE STREET APPROACH: Public Works. 8.UNDERGROUND UTILITY DISTRICT ON BELLFLOWER BOULEVARD FROM THE 1-105 FREEWAY TO APPROXIMATELY 900 FEET NORTH OF IMPERIAL HIGHWAY (DISTRICT NO. 22): Public Works. A. ADOPTED RESOLUTION NO. 09-7169, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ESTABLISH AN UNDERGROUND UTILITY DISTRICT ALONG THE WEST SIDE OF BELLFLOWER BOULEVARD FROM THE 1-105 FREEWAY TO APPROXIMATELY 900 FEET NORTH OF IMPERIAL HIGHWAY (DISTRICT NO. 22) AND CAUSING ALL SPECIFIED UTILITIES THEREIN TO BE RELOCATED UNDERGROUND. B. SET JANUARY 12, 2010 AS THE PUBLIC HEARING DATE IN ACCORDANCE WITH SECTIONS 7501 AND 7502 OF THE DOWNEY MUNICIPAL CODE AND DIRECTED THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND FILE AN ENGINEERS REPORT ON THE ESTABLISHMENT OF SUCH DISTRICT. ADMINISTRATIVE REPORTS: 9.RECEIVED AND FILED REPORT ON GIRLS BASKETBALL PROGRAM: Community Services Recreation Supervisor Ellis presented a Power Point presentation outlining the history of the basketball program. He explained that partnerships were obtained with the NBA, LA Sparks and LA Clippers organizations and there are currently 12 teams in 3 divisions, ages 7-14 years old. The program promotes physical activity while teaching fundamental skills and promoting Character Counts core values. He concluded by noting that the practices are run by professional athletic trainers Mayor Guerra explained he had asked for this report because he did not know about the program until recently and was very impressed with how it is run. City Council Minutes 1 1/24/09 -3- OTHER BUSINESS: ITEMS REMOVED: 3.RECEIVED AND FILED REPORT RE: COUNCIL SUBCOMM11-FEE REVIEW OF FOOD AND BEVERAGE OPERATION AT RIO HONDO EVENT CENTER: Community Services. Council Member Brossmer made a point of clarification that he is not on this subcommittee and requested more information on Item #2. Council Member Gafin noted that concerns regarding the current food contractor were received and investigated. He explained that two surveys were sent out; one to Golf Tournament groups and one to groups the regularly use the facilities. Comment cards were also placed throughout the facility. After analyzing the responses, it was determined that there were a few areas that needed improvement but overall the responses were good. Council Member Marquez noted that the subcommittee took six months in gathering the information to insure as much information as possible was received. Council Member Gafin noted that the other concessionaires at the facility were also interviewed and it has been stressed that there needs to be more communication between them for booking of events. He concluded that a letter was sent to the contractor listing the items that need improvement and the facility will be reviewed in another six months. It was moved by Council Member Gafin, seconded by Council Member Brossmer and so ordered by the Mayor to receive and file the report. 5.CASH CONTRACT NO. 668 – TREASURE ISLAND PARK LIGHTING – REJECTED ALL BIDS: Public Works. Council Member Brossmer clarified that upon further review of this project there are other steps to be taken first. Once the existing lights are upgraded then the remaining spots will have solar lighting installed. The new estimate for the project is $25,000. It was moved by Council Member Brossmer, seconded by Council Member Gafin and so ordered by the Mayor to reject all bids. Mayor Guerra announced that the meeting will be recessing to Closed Session to finish discussion of those items. Prior to recessing, it was moved by Mayor Guerra, seconded by Council Member Brossmer and unanimously carried to adjourn the City Council meeting to November 25, 2009 at 2:00 p.m. for the purpose of discussion of a Memorandum of Understanding with Industrial Realty Group The meeting recessed to Closed Session at 8:36 p.m. and reconvened with all Council Members present at 9:05 p.m. STAFF COMMENTS: None.
