The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:30 p.m., September8, 2009, in the Council Chamber of the Downey
City Hall, 11111 Brookshire Avenue, Downey, California, Mayor/Chairperson Mario A. Guerra
presiding.

APPROVED CLOSED SESSION MINUTES: August 1 1 and 25, 2009.
It was moved by Council Member/Commissioner Brossmer, seconded by Council
Member/Commissioner Marquez, and so ordered to approve.
RECESSED TO CLOSED SESSION:
Mayor/Chairperson Guerra announced the Council/Commission is ncessing to Closed
Session (6:31 p.m.) to discuss matters under the authority of the following sections of the
Government Code:
1. Government Code Section 54957 – Public employee performance evaluation: City
Attorney.
2. Government Code Section 54957.6 – Conference with labor negotiator Lee Powell re:
direction for labor negotiations with Downey Firemen’s Association.

3. Government Code Section 54956.8 – Conference with real property negotiator Gilbert
Livas re: property located at 8250 Firestone Boulevard; negotiating party: Yanki

4. Government Code Section 54956.8 – Conference with real property negotiator Gerald
Caton re: property located at 12224 Lakewood Boulevard (Downey Studios); negotiating
party: Stuart Lichter, Industrial Realty Group; under negotiations: price and terms of
payment.
RECONVENED:
The meeting reconvened in Open Session at 7:31 p.m. Qth all Council
Members/Commissioners present. There were no reportable actions taken

The City Council of the City of Downey held a Regular Meeting at 7:33 p.m., September8,
2009, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California,

COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND
CONFERENCE/MEETING REPORTS:
Mayor Pro Tem Bayer announced that Citi Ins for Downey is back from summer break and
will be meeting tomorrow morning at 7:30 a.m. at Rio Hondo Country Club with guest speaker Marsha
Moode from the Downey Civic Light Opera; and that there will be a ribbon cutting at the new Medicine
Store Pharmacy on Florence Avenue tomorrow.
Council Member Brossmer reported that the Branding subcommittee met for the first time
today and will be working on a Request for Proposals; noted that he had taken a tour of the new
Kaiser Perrnanente Hospital and facilities recently; and requested that the next agenda have a report
on the Treasure Island park lighting whose funding was approved in FY 2009-10 budget.
Mayor Guerra reported that he attended the graduation of sixteen young mothers from La
Casita drug and alcohol rehabilitation facility; noted that the Green Task Force met last week and will
be soon recommending guidelines for City Council adoption; acknowledged a letter from the City of
Rolling Hills thanking the City of Downey for providing fire and police mutual aid in response to their
recent fire; mentioned that he had attended a hnd raiser bowling marathon hosted by Bowling for the
Blind which raised over $25,000; and noted the recent press coverage regarding the potential move of
Tesla Motors to the City of Downey.

PRESENTATIONS:
Deputy City Manager/Emergency Services Sauter accepted the Proclamation for National
Preparedness Month.
Jacqueline Wilander and Diana Halsey accepted the Proclamation for Literacy Month.
Andrew Godoy and Claudia Hernandez accepted the Proclamation for National Alcohol and
Drug Addiction Recovery Month.
Police Chief Campos announced Police Department promotions: Captain Stephen Garza,
Lieutenant Dean Milligan, Lieutenant Randy Wells, Sergeant Kevin McCaster and Sergeant David
Zimmerman .
Council Member Marquez presented a Certificate of Appointment to Ale>under Lopez, Traffic
Committee, District 5.
Beth Trombley, Director of Public Affairs for Kaiser Perrnanente, gave an oral report on the
preparations for the opening of the new 352 bed hospital in Downey on September 1 5th
NON-AGENDA PUBLIC COMMENT:
Alfredo and Estela Garcia, residents of Downey, spoke regarding their Claim for Damages
resulting from a City tree falling on their garage and car and the City’s subsequent denial of the claim.
They submitted documents and pictures to the Council.
CITY COUNCIL CONSENT CALENDAR:
It was moved by Mayor Pro Tem Bayer, seconded by Council Member Marquez, and
unanimously carried, noting the absence of Council Member GaIn, to approve the Consent
Calendar items as recommended:
1.APPROVED CITY COUNCIL MINUTES: Regular and Adjourned Meetings August 25, 2009:
City Clerk.
2.APPROVED WARRANTS ISSUED: Warrant Nos. 243545 – 243880; Wire Nos. 493 – 499
and 30001979 – 30001987; in the total amount of $3,872,175.96: Finance.
3.APPROVED AGREEMENT WITH GRAFFITI TRACKER, INC. IN THE AMOUNT OF $18,000
FOR A ONE YEAR PERIOD TO CAPTURE, ANALYZE AND PROVIDE INTELLIGENCE FOR
THE PURPOSES OF REDUCING GR/FFITI VANDALISM: Police.
4.APPROVED AGREEMENT WITH CHAMBER OF COMMERCE FOR $24,500 TO PROMOTE
THE WELFARE AND GROWTH OF THE CITY FOR FISCAL YEAR 2009-10: Community
Development
5.ACCEPTED THE NEW STREET IMPROVEMENTS AND MAINTENANCE RESPONSIBILITY
FOR THE CONTINUATION OF CONGRESSMAN STEVE HORN WAY CONSTRUCTED BY
KAISER PERMANENTE BETWEEN IMPERIAL HIGHWAY AND BELLFLOWER

6.ADOPTED ORDINANCE NO. 09-1252, AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF DOWNEY AMENDING ARTICLE V “SANITATION” OF THE
DOWNEY MUNICIPAL CODE BY AMENDING CHAPTER 8 – “CONSTRUCTION
AND DEMOLITION WASTE MANAGEMENT”: Public Works
ADMINISTRATIVE REPORTS :
7.APPROVED AMENDMENT TO AGREEMENT WITH DELPHI PRODUCTIONS IN THE
AMOUNT OF $218,951 FOR SERVICES RELATED TO COLUMBIA MEMORIAL SPACE
SCIENCE LEARNING CENTER: Administration.
A staff report was presented by Columbia Memorial Space Science Learning Center
Executive Director Betthauser noting that this is for the completion of Phase II and Ill for the Space
Center and is in the budget. He noted that the #bbon cutting will be on Friday October 23 and
Saturday October 24 will be the opening to the public. Director Betthauser thanked the Public Works
Department and crews for their assistance.
Mayor Guerra inquired when the historical elements will be completed and was told that it
should be within the next couple of months. Council Mbrnber Brossmer expressed that the Learning
Center needs to be completed and opened as soon as possible.
It was moved by Council Member Brossmer, seconded by Council Member Marquez, and
carried unanimously, noting the absence of Council Member Gafin, to approve the amendment.
8.RECEIVED AND FILED STATUS REPORT ON FLU SEASON PREPAREDNESS:
Administration .
A staff report was presented by Deputy City Manager/Emergency Services Sauter who noted
that there has been a lot of media attention regarding the changing science in regards to the
upcoming flu season. The City is planning to have flu clinics for both the seasonal flu and the HINI
flu, which will require 2 shots. Tbey will be available to both the City employees and the public. This
year the seasonal public flu shots will be given on September 26 at the Downey Theatre and drive-up
service will be available. Dates have not been confirmed yet for the two HINI shots.
The status report was received and filed, so ordered by Mayor Guerra.
OTHER BUSINESS;
9.APPOINTMENTS TO CITY COUNCIL TEMPORARY AD HOC SUBCOMMITrEE RE:
DOWNEY THEATRE OPERATIONS AND USAGE: Community Services.
Council Members Brossmer and Gafin were appointed to the subcommittee, so ordered
by Mayor Guerra.
STAFF MEMBER COMMENTS:
City Manager Caton noted that the performance evaluation of the City Attorney has been on
the last few agendas, but has not been able to be completed due to otherpressing matters.
