HomeMy WebLinkAboutResolution No. 09-7165 - Employment Agreement with Jeffrey Turner as Interim Fire ChiefRESOLUTION NO. 09-7165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING AN EMPLOYMENT AGREEMENT BETWEEN THE CITY OF DOWNEY AND JEFFREY TURNER. (AS INTERIM FIRE CHIEF)r WHEREAS, Mr. Jeffrey Turner currently serves as Fire Chief in the City of Downey; and WHEREAS, Mr. Turner has indicated that he will retire on December 30, 2009; and WHEREAS, the City wishes to retain the service of Mr. Turner to manage the Fire Department until a new Fire Chief is hired in late 2010; and WHEREAS, the City wishes to continue to use the knowledge and experience of Mr. Turner to insure a smooth transition in leadership within the Fire Department; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Employment Agreement Between the City of Downey and Mr. Jeffrey Turner, attached hereto as Exhibit “A”, is hereby approved as to form and content. SECTION 2. The City Manager is authorized to execute the Employment Agreement on behalf of the City. SECTION 3. The City Clerk shall certify the adoption of this Resolution. MIDSTOKKE, City Clerk RESOLUTION NO. 09–7165 PAGE THREE EXHIBIT A EMPLOYMENT AGREEMENT BETWEEN THE CITY OF DOWNEY AND MR. JEFFREY TURNER Whereas, Mr. Jeffrey Turner (“Mr. Turner”) is retiring from the City of Downey (the “City”), effective December 30, 2009, and Whereas, the City wishes to retain the services of Mr. Turner to manage the Fire Department until a new Fire Chief is hired, and Whereas, the City wishes to continue to use the knowledge and experience of Mr. Turner to insure a smooth transition in leadership within the Fire Department, Now, Therefore, the undersigned parties hereby agree that Mr. Turner shall be employed commencing on January 2, 2010 as a consultant to act in the role of Interim Fire Chief of the City of Downey under the following terms and conditions: 1. Mr. Turner will serve as Interim Fire Chief of the Downey Fire Department with all the authority, rights and obligations of the Fire Chief. 2. Mr. Turner will manage the Department working under the direction of the City Manager or his designee 3. Mr. Turner will continue to attend City Council meetings and respond to requests from the City Council for information related to fire safety issues in the City 4. Mr. Turner will help provide for a smooth transition with the new Fire Chief when that person is employed by the City. 5. Mr. Turner will work with the Downey Firemen’s Association and the Safety Auxiliary Association to maintain good labor relations. 6. Mr. Turner will be paid an hourly rate of $91.96 per hour as the basis for total compensation under this Agreement and shall not be otherwise entitled to or accrue any other fringe benefits provided to full-time employees of the City. 7. In accordance with regulations of the Public Employee Retirement System, Mr Turner will work no more than 960 hours per fiscal year (defined as the twelve month period commencing on July 1 and ending on June 30 of the following year) under this contract 8. This agreement will expire no later than December 31, 2010. Furthermore, either party may terminate this agreement without cause by providing ten (10) days written notice to the other party. #:K{Z4:-{##'be?Ge
