HomeMy WebLinkAboutResolution No. 09-7135 - Declaring intent to adopt Ord. dissolving Vehicle Parking District No. 1RESOLUTION NO. 09-7135 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ADOPT AN ORDINANCE DISSOLVING VEHICLE PARKING DISTRICT NO. 1. WHEREAS, by adoption of Ordinance No. 162 (adopted March 20, 1961), Ordinance No. 164 (adopted March 28, 1961), Ordinance No. 165 (adopted March 28, 1961), and Ordinance No. 171 (adopted May 23, 1961) (as further amended by Ordinance No. 198 on March 27, 1962), the City Council of the City of Downey (the "City") established Vehicle Parking District No. 1 (the "District"), declared the District’s boundaries, formed the Parking Place Commission for the District, and authorized the acquisition of land and construction of improvements for the District’s purpose in providing public parking; all in accordance with applicable notice, hearing and protest requirements of the Parking District Law of 1943, as amended (Section 31500 and following of the Streets and Highways Code of the State of California) (the "Act"); and WHEREAS, by adoption of Ordinance No. 165 (adopted March 28, 1961 ) and Resolution No. 759 (adopted January 31, 1961 ), the City Council of the City authorized the levy of a special tax assessment ("Special Tax") on all non-exempt real property and improvements within the boundaries of the District; and authorized the issuance of 19-year term revenue bonds (the "Bonds") to finance operations, maintenance and capital improvements to serve the District, payable from the proceeds of the Special Tax, all in accordance with applicable requirements of the Act; and f WHEREAS, the Bonds were issued on June 16, 1964 and were fully paid and retired on January 2, 1984. ("Bond Retirement Date"). At the same time, the District’s authority to collect the Special Tax ceased; and WHEREAS, since the Bond Retirement Date, the District has not issued bonds or any other public financial obligation, and has not collected the Special Tax or any other tax or assessment; and WHEREAS, over the last several years, the District’s operations have been very limited and the Parking Place Commission has met only sporadically; and WHEREAS, the City Council of the City of Downey believes that the District has fulfilled its purpose under the Act and now wishes to declare its intent to adopt an ordinance formally dissolving the District. NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF DOWNEY, acting as the legislative body of Vehicle Parking District No. 1, as follows: SECTION 1. Findings. The City Council of the City of Downey finds that the foregoing recitals are true and correct. SECTION 2. Declaration of Intention and Hearing. The City Council declares its intent to adopt an ordinance which will dissolve the District, after a public hearing. The time and place of the public hearing concerning the proposed dissolution of the District, is set for 7:30 p.m. on July 14, 2009 at the Downey City Council Chamber, located at 1 1111 Brookshire Avenue, Downey, California 90241. RESOLUTION NO. 09-7135 PAGE TWO SECTION 3. That the Mayor shall sign this Resolution and the City Clerk shall attest and certify to the passage and adoption thereof. SECTION 4.
