REPORT SUMMARY
On July 11, 2024, business owner, Gleydis Rodriguez, operating “Sexy & Sweet Exotic Bakery”,
filed an appeal of the Community Development Director’s Interpretation of Regulations which was
made on June 26, 2024, pursuant to Downey Municipal Code (DMC) 9116. The determination
letter states that despite the business owner’s application for a “Bakery Coffee Shop”, the
business operating as “Sexy & Sweet Exotic Bakery” located at 13117 Lakewood Boulevard, is
classified as an “Adult Business” under DMC 9402 and is not permitted at the subject location
pursuant to DMC 9314.04.
Based on the analysis contained in this report, staff is recommending the Planning Commission
adopt the following titled resolution:

CODE SECTION 9402
BACKGROUND
The business is located in a multi-tenant commercial retail building, on the southwest corner of
Lakewood Boulevard and Gardendale Street, which is comprised of three (3) tenants: 1) eating
establishment 2) beauty salon: and, 3) the subject business “Sexy & Sweet Exotic Bakery”. The

property is located within the General Commercial (C-2) zone and has a General Plan Land Use
designation of Mixed Use (MU). The surrounding properties to the north are zoned C-2 with
commercial retail uses, and properties to the west and south are zoned R-1 and are developed
with single-family homes. The property borders the City of Bellflower to the east with a gas station
development underway and additional residential properties further to the east.

On September 23, 2022, the business owner submitted a business license application, with
“Bakery Coffee Shop” as a business description and without any specific description of the types
of bakery items that would be sold at the establishment (Attachment B). Following inspections
related to occupancy by the Building and Safety Division and Fire Department, a business license
was issued on July 25, 2023. The land use classification for a “bakery coffee shop” is be
categorized as a “Bakery” in the C-2 zone per Downey Municipal Code Section (DMC) 9314.04.
DISCUSSION
Per DMC Section 9116, Interpretation and Regulations, the City Planner has the authority to
interpret the City’s land use regulation in cases of ambiguity. According to this section, “If
ambiguity arises concerning the content or application of this article, it shall be the duty of the City
Planner to ascertain all pertinent facts and set forth the finding and interpretation”. The Director
of Community Development may act in place of the City Planner to make such interpretations.
On January 25, 2024, Code Enforcement was anonymously informed of the adult-oriented nature
of the goods being sold and also displayed in the business storefront.

On January 25, 2024, upon inspection of the business on January 25, 2024, the Code
Enforcement Division staff observed that baked goods for sale were in the shape of human
genitalia. Code Enforcement staff advised the business owner that the ‘Adult Use’ was not allowed
and that they would need to work with Planning Division to gain compliance.
On February 26, 2024, the applicant contacted the Planning Division to learn about the process
for obtaining an “Adult Use Permit”. After thorough research and consideration of the applicant’s
request, and based on communication with the applicant, staff determined that the business
operation focuses on the preparation and sale of baked goods in shapes and configurations
resembling anatomical genitalia along with other accessory retail sales.
On February 28, 2024, the applicant was emailed development standards, indicating that DMC
Section 9402.06 restricts the location of adult-use businesses near sensitive uses and, more
specifically, prohibits ‘Adult Uses’ from locating within 500 feet from a residential zone or other
property used for residential purposes (Attachment C).
On March 29, 2024, the Code Enforcement Division issued a Notice of Violation (Attachment D)
to immediately cease all ‘Adult Business’ activities and directed the business owner to work with
the Planning Division for compliance.
On April 9, 2024, City staff and the applicant met to discuss the applicant’s request. City staff
explained the DMC code requirements which prohibit ‘Adult Uses’ from being located within 500-
feet from a residential zone or other property uses for residential purposes. The applicant
indicated disagreement with the information provided by staff during the meeting and previously
via email. Staff informed the applicant that they could request an appeal of staff’s determination
to the Planning Commission.
Interpretation of Regulations
On June 26, 2024, staff issued a determination letter per DMC Section 9116, stating the reasons
for the code interpretation by the Community Development Director (Attachment E). The letter
indicates that upon review of the request, it has been determined that the business is not a “bakery
coffee shop” as originally proposed by the owner but rather an Adult Business as defined by DMC.
Nor can the business be approved for operation at the address in question because of the
development standards cited below.
The baked goods offered by this business align with the definition provided in DMC Section
9402.04, “Adult Specialty Shop: Any commercial establishment having as 20% or more of its stock
in trade, material on display or available for sale or rent or for viewing on the premises which is
distinguished or characterized by its emphasis on matter depicting, describing, or relating to
specified sexual activities or specified anatomical areas.”
According to this definition, any business providing more than 20 percent of its stock in trade, and
material on display depicting or relating to specified anatomical areas is defined as an Adult
Specialty Shop. Based on repeated observation and visits to the business and the evidence
gathered, the business operation, “Sweet & Exotic Bakery”, has baked goods on display and
provides substantially more than 20 percent of its stock and trade in selling these items.
Additionally, DMC Section 9314.04, conditionally permits ‘Adult Businesses’ in the C-2 Zone but
they must adhere to the development standards for such businesses, here listed in pertinent part
in DMC Section 9402.06 as follows:

(f) The requested use at the proposed location will not be located within a 500 foot radius
to any residential zone or other property used for residential purposes (hereinafter
"residential zone"). The distance between a requested use and a residential zone shall be
measured between the nearest property line or lease line of the requested use and the
nearest lot line included within the residential zone, along a straight line extended between
the two points.
(g) The requested use at the proposed location will not be located within a 1,000 foot
radius of any other adult business or any other premises holding an on-sale license issued
by the Department of Alcoholic Beverage Control ("licensed premises"). The distance
between a requested use and any other adult business or any other licensed premises
shall be measured between the nearest property line or lease line of the requested use
and the nearest property line or lease line of the other adult business or the other licensed
premises along a straight line extended between the two points.
Various Code Enforcement photos taken of the establishment are provided in Attachment F.
In sum, this business constitutes an Adult Business as defined by the DMC and cannot be
conditionally approved in its current location as detailed in the development standards because it
is located within 500 feet of residential properties south of the subject site (refer to Figure A). DMC
9402.04 restricts the location of adult-use businesses near sensitive uses and, more specifically,
prohibits “Adult Businesses” within 500 feet of a residential zone or other property used for
residential purposes. The subject property is located immediately adjacent to a residentially zoned
parcel that is developed and used for residential purposes. The subject business is not located
within 1,000 feet of another adult business, nor does it appear that it is located within 1,000 feet
of a premise holding an on-sale alcohol license.
Appeal by Applicant
On June 26, 2024, staff issued a determination letter per DMC Section 9116, stating the reasons
for the code interpretation by the Community Development Director and provided the appeal
process as outlined in DMC Section 9806 (Attachment D).
On July 11, 2024, the applicant filed an appeal with the City Clerk (Attachment G). The applicant’s
appeal does not provide any information that challenges staff’s determination that the baked
goods sold at the business establishment fall under the definition of an Adult Specialty Shop /
Adult Business. Furthermore, the applicant provides a proposal to create a “secret menu” of adult
oriented merchandise. This proposal would not be consistent with the DMC definition of an Adult
Specialty Shop as the DMC does not distinguish between merchandise that is visible to public or
hidden away. The DMC specifically includes wording that references merchandise that would be
“…available for sale or rent or for viewing…”. Specifically, the DMC Section 9402.04 reads:
Adult Specialty Shop: Any commercial establishment having as 20% or more of its stock
in trade, material on display or available for sale or rent or for viewing on the premises
which is distinguished or characterized by its emphasis on matter depicting, describing, or
relating to specified sexual activities or specified anatomical areas.

CONCLUSION
Based on the analysis in this report, staff recommends that the Planning Commission adopt a
resolution denying the appeal by Sexy Sweet & Exotic Bakery and affirming the decision of the
Community Development Director determining the business located at 13117 Lakewood Blvd. to
be an ‘Adult Business’ under Downey Municipal Code 9402.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
DOWNEY DENYING THE APPEAL BY SEXY & SWEET EXOTIC BAKERY AND
AFFIRMING THE DECISION OF THE COMMUNITY DEVELOPMENT
DIRECTOR DETERMINING THE BUSINESS LOCATED AT 13117 LAKEWOOD
BOULEVARD TO BE AN ‘ADULT BUSINESS’ UNDER DOWNEY MUNICIPAL
CODE SECTION 9402
THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The Planning Commission of the City of Downey does hereby find,
determine, and declare that:
A. On September 23, 2022, the business owner submitted a business license application,
with “Bakery Coffee Shop” as a business description and without any specific description
of the types of bakery items that would be sold at the establishment.
B. On January 25, 2024, the City received an anonymous complaint that the business known
as ‘Sexy & Sweet Exotic Bakery’ was selling adult-oriented types of baked goods along
with storefront display of these items visible to the general public.
C. On January 25, 2024, upon inspection of the business on January 25, 2024, the Code
Enforcement Division staff observed that baked goods for sale were in the shape of human
genitalia and provided verbal warning to the business operator that “adult use” was not
allowed and that they would need to work with the Planning Division for compliance.
D. On February 26, 2024, the applicant contacted the Planning Division to learn about the
process for obtaining an “Adult Use Permit”. After thorough research and consideration of
the applicant’s request, and based on communication with the applicant, staff determined
that the business operation focuses on the preparation and sale of baked goods in shapes
and configurations resembling anatomical genitalia along with other accessory retail sales.
E. On February 28, 2024, the applicant was emailed development standards indicating that
the DMC Section 9402.06 restricts the location of adult-use businesses near sensitive
uses and, more specifically, prohibits ‘Adult Uses’ from locating within 500 feet from a
residential zone or other property used for residential purposes.
F. On March 29, 2024, the Code Enforcement Division staff conducted a follow-up inspection
of the premise and visually observed the displays and sales of baked goods in the form of
specified anatomical areas. A Notice of Violation was issued and the business operator
was advised to immediately cease all ‘Adult Business’ activities and directed the business
owner to work with the Planning Division for compliance. A copy of the Notice was also
provided to the property owner.
G. On April 9, 2024, City staff and the applicant met to discuss the applicant’s request. City
staff explained the DMC code requirements which prohibit Adult Uses from being located
within 500-feet from a residential zone or other property uses for residential purposes.

meeting and previously via email. Staff informed the applicant that they could request an
appeal of staff’s determination to the Planning Commission pursuant to DMC Section
9806.
H. On June 26, 2024, staff issued a determination letter per DMC Section 9116, stating the
reasons for the code interpretation by the Community Development Director and provided
the appeal process as outlined in DMC Section 9806.
I. On July 11, 2024, the applicant filed an appeal with the City Clerk. The appeal letter
provided by the applicant does not provide any information that challenges staff’s
determination that the baked goods sold at the business establishment fall under the
definition of an ‘Adult Specialty Shop / Adult Business’. Furthermore, the applicant
provides a proposal to create a “secret menu” of adult oriented merchandise.
J. On August 8, 2024, a notice of a public hearing by the Planning Commission scheduled
for August 21, 2024 on the pending appeal was published in the Downey Patriot and
mailed to all property owners within 500 feet of the subject site.
SECTION 2. On August 21, 2024, the Planning Commission conducted a duly noticed hearing
on this appeal and found that:
A. It has been determined that the business is not a “bakery coffee shop” as originally
proposed by the owner but rather an ‘Adult Business’ as defined by DMC. Nor can the
business be approved for operation at the address in question because of the
development standards cited below.
B. The baked goods offered by this business align with the definition provided in DMC
Section 9402.04, “Adult Specialty Shop: Any commercial establishment having as 20%
or more of its stock in trade, material on display or available for sale or rent or for
viewing on the premises which is distinguished or characterized by its emphasis on
matter depicting, describing, or relating to specified sexual activities or specified
anatomical areas.”

defined as an Adult Specialty Shop. Based on repeated observation and visits to the

nearest property line or lease line of the requested use and the nearest

E. In sum, this business constitutes an Adult Business as defined by the DMC and cannot
be conditionally approved in its current location as detailed in the development
standards because it is located within 500 feet of residential properties south of the
subject site. DMC 9402.04 restricts the location of adult-use businesses near sensitive
uses and, more specifically, prohibits ‘Adult Businesses’ within 500 feet of a residential
zone or other property used for residential purposes. The subject property is located
immediately adjacent to a residentially zoned parcel that is developed and used for
residential purposes.
SECTION 3. The Planning Commission hereby finds and determines that the
Community Development Director’s decision determining that the above-referenced business is
an ‘adult business’ was not made in error.
SECTION 4. Having considered all of the oral and written evidence presented at said
public hearing, the Planning Commission hereby denies the appeal filed by Sexy & Sweet Exotic
Bakery and affirms the determination of the Community Development Director determining that
the business located at 13117 Lakewood Blvd. is an ‘adult business’ consistent with DMC Section
9402. This decision is based on the evidence submitted at the hearing, which includes but is not
limited to: the Staff Report dated August 21, 2024, and exhibits attached thereto, and the public
testimony, written and oral, all of which are incorporated herein by this reference.
SECTION 5. The Secretary shall certify the adoption of this Resolution.

Dear Ms. Rodriquez,
This letter is prepared to address the use classification of the current business of "Sexy & Sweet
Exotic Bakery" located at the above referenced address. Pursuant to the City of Downey
Municipal Code (DMC) Section 9116, Interpretation of Regulations, the City Planner has the
authority to interpret the City's land use regulations (found in Article IX) in cases of ambiguity.
According to this section, "If ambiguity arises concerning the content or application of this article,
it shall be the duty of the City Planner to ascertain all pertinent facts and set forth the finding and
interpretation". The Director of Community Development can act on behalf of the City Planner to
make such interpretations.
The business is located at 13117 Lakewood Boulevard and within the General Commercial "C-
2" zone. In accordance with the DMC Section 9314.02, Intent and Purpose, the intent of the "C-
2" zone is" ... Provide appropriately located areas consistent with the General Plan for a full range
of office, retail commercial, and service commercial uses needed by residents and businesses
of, and visitors to, the City and region"
Based on observations by the Code Enforcement Division and meetings with the applicant, the
business operations focuses on the preparation and sale of baked goods in shapes and
configurations resembling anatomical genitalia along with other accessory retail sales. The
business license application (Attachment A) submitted to the City, dated September 23, 2022,
provides a business description of "Bakery coffee shop" providing no reference to the type of
baked goods offered. For reference, a bakery coffee shop would be categorized as a "Bakery"
land use in the C-2 zone per DMC Section 9314.04.
On January 25, 2024, the City responded to an anonymous complaint regarding the adult
oriented nature of the good being sold at the business storefront. After conducting an inspection
of the premises (January 25, 2024), and based on visual observations of baked goods for sale
in the shape of human genitalia, the Code Enforcement Division issued a notice to cease all

adult business activities immediately and directed the applicant to work with the Planning
Division to apply for an Adult Use Permit (Attachment B). On February 26, 2024, the applicant
contacted the Planning Division to learn about the process for obtaining an "Adult Use Permit".
After thorough research and consideration at the applicant's request, the applicant was emailed
development standards on February 28, 2024, indicating that the DMC Section 9402.06 restricts
the location of adult-use businesses near sensitive uses and, more specifically, does not allow
Adult Uses from locating within 500 feet from a residential zone or other property used for
residential purposes (Attachment C). On April 9, 2024, City staff and the applicant met to discuss
the applicant's request. City staff explained the DMC code requirements restricting adult users
from being located in residential uses and furthermore explained that the applicant could request
an appeal of staff's determination to the Planning Commission as described in this letter.
Upon further review and consideration of the request, it has been determined that the business
in question is not a "bakery coffee shop" as originally proposed by the applicant but rather an
Adult Business as that term is defined in the Downey Municipal Code. Nor can the business be
approved for operation at the address in question because of the development standards cited
below.
The baked goods offered at this business align with the definition provided in DMC Section 9402.
Adult Businesses, "Adult Specialty Shop: Any commercial establishment having as 20% or more
of its stock in trade, material on display or available for sale or rent or for viewing on the premises
which is distinguished or characterized by its emphasis on matter depicting, describing, or
relating to specified sexual activities or specified anatomical areas."
According to this definition, any business providing more than 20 percent of its stock in trade,
and material on display depicting or relating to specified anatomical areas is defined as an Adult
Specialty Shop. Based on repeated observation and visits to the business and the evidence
gathered, the current business operations has baked goods on display and provides
substantially more than 20 percent of its stock and trade in selling these items.
Additionally, DMC Section 9314.04, conditionally permits Adult Businesses in the C-2 Zone but
they must adhere to the development standards for such businesses, here listed in pertinent part
in DMC Section 9402.06 as follows:
"(f) The requested use at the proposed location will not be located within a five hundred (500)
foot radius to any residential zone or other property used for residential purposes (hereinafter
"residential zone'?. The distance between a requested use and a residential zone shall be
measured between the nearest property line or lease line of the requested use and the nearest
lot line included within the residential zone, along a straight line extended between the two (2)
points.
(g)The requested use at the proposed location will not be located within a one thousand (1,000)
foot radius of any other adult business or any other premises holding an on-sale license issued
by the Department of Alcoholic Beverage Control ("licensed premises'?. The distance between
a requested use and any other adult business or any other licensed premises shall be measured

Re: Appeal of interpretation of business operating in the City of Downey located at 13117
Lakewood Blvd.
This letter is intended to appeal the permit concerning the pastries we sell at Sexy & Sweet
Exotic Bakery, located at 13117 Lakewood Blvd, Downey, CA 90242. The letter we received on
June 26th alleges that my business is violating codes D.M,C 9402,04(F) and D.M.C, 9402.06(a).
Our decision to open a second business in the vibrant city of Downey was driven by the goal of
promoting the success of Latina women and entrepreneurs determined to build the American
dream, By doing so, we provide jobs that support families, including mine, as I am the
breadwinner for my family.
As an entrepreneur and permanent resident of this beautiful country, mother, daughter, and wife,
I have the responsibility to create a business that uplifts the lives of others. My goal is to
continue generating wholesome experiences and happy moments for everyone who visits our
business.
Each customer who visits our store has a unique experience that keeps them returning weekly.
Attached are screenshots of some of the many positive reviews we have received on our social
media (Attachment A).
In 2024, we have received so many satisfied customers that we haven't had time to notice
anyone wanting to file a complaint about our business regarding the appearance of our sweets.
We understand and respect each person's opinion, as we are all different and think differently.
The 1 % of complaints is nothing compared to the satisfaction shown by the residents of our
area and the entire city of Downey, We know there are all kinds of opinions, but we always focus
on the positive ones, which are the overwhelming majority. We are immensely grateful for the
acceptance and satisfaction shown by the residents of Downey and other cities. Therefore, I
emphasize the importance of seizing this opportunity to continue attracting visitors to our city of
Downey with a variety of products and services. I am fully prepared to engage with the Planning
Department in negotiating the creation of a "secret menu" highlighting our most exotic products

menu.

labeled as an "Exotic Bakery" since its inception when applying for the permit.

Wonderful service from the proprietor! Her name is on the
card as pictured and she is very friendly. The atmosphere
is outstanding -music is lively and upbeat, the decor is
beautiful -carefully chosen and placed -so you're
guaranteed to enjoy yourself here.
I had the coffee bombom and it is excellent. Strong hit of
espresso with a gentle undertone of condensed milk. I
was absolutely pleased and energized for the day.

Tried the" Lola" pastry ... the one shaped like a boob and it
was very yummy. Obviously they're not going to be
layered with the colors perfectly because they make em
fresh right in front of u. No such thing as a perfect nipple !
Loi. They're fluffy and better than donuts ... 10/10
I also tried the cuban sandwhich and to my surprise it was
pretty tasty. The salsa that it comes with is spicy with great
flavor ... I should've got two because they're a little small
in packaging. 8/10
My thought coming into this place was that it was just
instagram looking food but it exceeded my expectations.
I will be coming back!
