REPORT SUMMARY
The proposed Conditional Use Permit (PLN-24-00011) application is a request to construct and
operate a 38-foot stand-alone wireless communication facility (WCF) stealth tower. The WCF
encompasses a 676-square-foot lease area enclosed at the ground level by a new seven (7)-foot
split face block wall. The proposed stealth designed WCF would contain twelve (12) paneling
antennas, two (2) parabolic antennas, one (1) GPS antenna, twelve (12) remote radio units
(RRU), and three (3) tower- mounted junction boxes. The antennas, RRUs, and junction boxes
would be screened by a tower with decorative clad paneling and roofing material to match the
existing buildings. The 7-foot split face block wall would screen the ancillary ground-mounted
equipment.
Based on the analysis contained in this report, staff is recommending that the Planning
Commission adopt the following titled resolution:

APPROVAL AUTHORITY
Pursuant to Downey Municipal Code (DMC) 9312.06, a Conditional Use Permit (CUP) is required
for WCF, subject to review and approval by the Planning Commission, in compliance with the
regulation in DMC 9426.
REQUEST
On February 7, 2024, the applicant, Victor Flores on behalf of Verizon Communications (Verizon),
applied for a Conditional Use Permit (CUP), requesting to construct and operate a stealth 38-foot
stand-alone WCF. Per DMC Section 9312.06, any new WCF may be located within an R-1 zone
when located on non-residentially improved property and is subject to the review and approval of
a CUP by the Planning Commission. The proposal of the WCF is located on a property improved
with a nonresidential use, and operates as a religious organization as identified in the DMC,
occupied by "The New Season LA Church" (Church). The applicant has submitted propagation
maps, showing signal strength at different distances from the proposed WCF, indicating that the
proposed WCF would improve the wireless coverage for the immediate and surrounding area.
BACKGROUND
The subject property, located at the northwestern corner of the intersection of Gallatin Road and
Paramount Boulevard, is part of the Single-Family Residential District (R-1) with a General Plan
Land Use designation of Low-Density Residential (LDR). In 1974, the Planning Commission
approved Zoning Exception No. 1160, which allowed the conversion of a former elementary
school into a church known as Landmark Temple. The following year, the Commission amended
Condition #2 of Zoning Exception No. 1160 to permit the facility’s use as a weekday pre-school
nursery school. More recently, in 2009, the Planning Commission approved PLN-09-7535 for the
construction and operation of a new WCF on the site. This facility, operated by SBA
Communications, features a design that stealth’s the antennas as a 38-foot sculpture of a cross,
integrating seamlessly with the surrounding environment while providing essential wireless
coverage. Currently the site is occupied and own by Cornerstone Christian Worship Church which
operates under the name “The New Season LA – Downey Church”.

DISCUSSION
Per the Downey Municipal Code (DMC), regulations governing WCFs aim to establish criteria for
placement, design, and screening of these facilities to ensure the responsible establishment
WCFs. This effort is geared towards protecting public health, safety, general welfare, and the
overall quality of life within the City while simultaneously allowing for essential flexibility for
wireless communication providers. Moreover, these regulations strive to maintain the visual
harmony of the community by promoting the use of stealth techniques that seamlessly integrate
or conceal cellular facilities within their surroundings.
Additionally, Downey Municipal Code Section 9426.04 prioritizes collocating antennas on existing
wireless base stations or tower sites. However, the results of an initial assessment of the
possibility to collocate with an existing off-site WCF was deemed impractical due to the
predominance of single-family residential zones and the lack of nearby WCFs.
Due to the presence of another WCF on the subject property, Staff examined the potential of
collocating the proposed WCF to the existing facility. It was determined that any attempt to modify
the existing WCF would require substantial redesign of the existing concealment by increasing
the height or adding equipment. The existing WCF is concealed within a religious cross sculpture
and was designed to only house one WCF.
The next hierarchal priority is to mount antennas on the side, roof, or penthouse of an existing
building that does not already host WCFs. In this case, an analysis of the current buildings on-
site, as well as other potential structures off-site, found that buildings were generally below 24
feet in height, with the tallest structure on the project site being only 15 feet high. The limited

height of the existing structures would present issues related to adequate aesthetic screening,
and would not achieve the cellular coverage needed to service the nearby area. Consequently,
the proposed location for the WCF, emerges as the only viable location to meet optimal cellular
coverage.
WCFs owned by individual wireless carriers, such as Verizon, AT&T, Sprint, etc., are necessary
to provide cellular service to their customers. As cellular technology advances, the demand for
bandwidth increases, prompting updates to existing WCFs, new facilities for better coverage, and
new antennas to expand coverage areas. The proposed WCF would be constructed in a grass
area located on the southwest portion of the lot in a lease area of 676 square feet. The proposed
stealth designed tower would include the installation of twelve (12) antennas, twelve (12) remote
radio units (RRUs), and three (3) tower-mounted junction boxes. The enclosed 626 square foot
(26' width x 26' length) equipment facility would house a thirty kilo-watt (30KW) generator with
one-hundred and sixty-eight (168) gallon diesel fuel tank and three (3) equipment cabinets on a
concrete platform, all to be concealed at ground level by a proposed seven (7)-foot split face block
wall enclosure. The proposed panel antennas, parabolic antennas, and the RRUs would be within
the proposed tower enclosure, and one (1) GPS antenna would be ground-mounted on the
cabinet equipment to be screened by the split face block wall enclosure.

The proposed WCF has been carefully designed to minimize noise and visual impact and the
layout and design ensure it integrates seamlessly with the surrounding residential areas. It will be
located approximately 150 feet from residential properties to the south along Gallatin and about
180 feet from those on Kristin Street, the facility's operational components-including generators
and equipment are strategically placed and enclosed within the structure to control noise levels.
These measures are intended to keep noise levels at the property boundary well below the
regulatory limit of 45 dBA, effectively mitigating any potential disturbance to nearby residents.
Enclosing the WCF tower with a seven (7)-foot high split-face block wall is crucial for maintaining
the visual harmony of the site and its surroundings. This design solution shields all mechanical
apparatus-including generators, fuel tanks, piping, and equipment cabinets, from public view,
thereby safeguarding the aesthetic integrity of the area. Additionally, this approach not only
preserves the site's overall visual appeal but also protects these components from potential
damage, ensuring their longevity.
Design
Staff worked closely with the applicant to ensure compatibility, screening, and architectural
integration. The design objective was to enhance the design's quality and blend harmoniously
with its surroundings. Initially, higher-quality perspective images and detailed elevation renderings
were requested to visualize the tower's design comprehensively. Staff measured and documented
distances from the facility to the nearest residences, existing buildings, and property lines. The
results of the collaboration resulted in a proposal that incorporates a stealth tower with a green
standing seam roof to match the roof of the main church structure. In addition, the tower
incorporates three posts forming a triangle and a three-panel enclosure to house the proposed
antennas. Each of the three sides of the tower panels will be a decorated with a religious cross
configuration. The green standing seam roof, posts, and panels and cross are illustrated below in
Figure D.

The tower's green standing seam roof structure is proposed to align with the existing primary
building aesthetically. This choice aimed to integrate the facility architecturally and effectively
camouflage the facility within the environment. The 38-foot high tower complies with the maximum
height allowed by the zone of 38 feet, with ground-mounted equipment screened by the seven
(7)-foot high split face block wall that matches existing perimeter walls.
Additionally, the proposed WCF tower is strategically positioned west of the
driveway entrance to the Church off Gallatin Road. This careful placement effectively tucks the
WCF tower into the site, ensuring it is well-buffered from view and minimizes its visual impact on
the surrounding area. The lease area for the WCF tower is set back approximately 65 feet from
the southwest property line, 88 feet from the northwest property line, 284 feet from the southeast
property line, and 500 feet from the northeast property line. The WCF tower will be situated about
20 feet from the nearest existing building.
Based on the proposed WCF design, the project’s compliance with development regulations in
Section 9426.04, is evident through a collaborative effort with the applicant’s team in designing a
WCF stealth tower that matches the finishes and roofing material of the existing buildings on the
project site. Staff guided and emphasized the importance of aesthetics by integrating existing
elements and colors into the screening, resulting in a final proposal featuring an "Aged Patina"
metal standing seam roof to match other structures. The paneling of the tower would incorporate
"Blown White Stucco" to match the faces of different buildings on the property. Particular attention
is given to the three crosses made of FRP (Fiber Reinforced Plastic) material. These crosses will
seamlessly integrate into the aesthetic of the church environment, ensuring minimal visual impact
while respecting the site's religious significance and architectural harmony. This design is aligned
with the DMC requirements for a stealth design and preserves the site's overall harmony and
appearance. Overall, the project aligns with DMC’s development regulations, meets height
restrictions and stealth concealment standards, and has visual compatibility with the building
located on the property and is compatible with its surroundings.
Lastly, in addition to the proposed WCF stealth concealment by the tower, the WCF tower would
blend in with its surroundings due to the existing on-site landscaping. The site is benefits from the
mature palm trees, standing approximately 30 feet tall, and large canopy trees, combined with
dense shrubbery along the property boundary, which creates a substantial visual buffer. This
existing vegetation obscures the WCF tower from direct view, reducing its prominence in the
landscaped setting. The height and density of the palm trees, along with the layered screening
effect of the other vegetation, effectively diminishes the visual impact of the WCF on nearby
residential areas. The landscaping in relations to the proposed WCF is illustrated below in Figure
E.

Network Coverage
The applicant has identified a need for additional coverage and a lack of network capacity in this
area. This necessity is identified from a thorough analysis revealing significant gaps in network
coverage, as depicted in map shown in Figure F. The map vividly illustrates areas surrounding
the subject site, highlighted in yellow, experiencing poor coverage, highlighting the critical need
for WCF infrastructure enhancements. The applicant is addressing these coverage deficiencies
by proposing the WCF which also fulfills the applicant’s operational requirements and serves the
broader community by improving wireless connectivity and access to telecommunications
services.

The star on the map above (Figure F) shows the location of the proposed WCF. As shown, the
coverage provided by the center cell site is less than that of others throughout the city, resulting
in a coverage gap. The construction of the proposed WCF is predicted to improve the specific
site's surrounding areas and provide additional coverage. Figure G, illustrates the projected new
coverage area with the proposed additional of the stealth tower WCF.

DEVELOPMENT REVIEW COMMITTEE
The Development Review Committee (DRC) reviewed the project, which comprises the Building
& Safety Division, Police Department, Fire Department, Public Works Department, and the
Planning Division. The departments expressed no concerns or opposition to the project and
issued standard conditions of approval. Recommended conditions of approval have been
included in the attached Resolution, Exhibit B.
ENVIRONMENTAL ANALYSIS
Staff has reviewed the proposed conditional use permit for a WCF to ensure compliance with the
California Environmental Quality Act (CEQA). Upon completion of this review, it was determined
that this request is categorically exempt from CEQA, pursuant to Guideline Section 15303 (Class
3 - New Construction or Conversion of Small Structures). Categorical Exemptions are projects
that have been determined not to have a significant effect on the environment and have been
exempted from the California Environmental Quality Act requirements. Class 3 exemptions
consist of the installation of small new equipment and facilities in small structures.
PUBLIC OUTREACH & CORRESPONDENCE
On August 8, 2024, a Notice of the Public Hearing was mailed to all property owners within 500
feet of the subject property and published in the Downey Patriot.
As of the time of publishing this report, staff has not received any written correspondence
regarding this application. However, staff received two phone calls from concerned residents who
inquired about potential radiation produced from the proposed WCF. Staff shared with the callers
that the Federal Communications Commission (FCC) establishes allowable thresholds for
radiation, and all WCF will adhere to these federal regulations and limits.
CONCLUSION
Based on the analysis contained within this report, staff has concluded that all required findings
to approve the Conditional Use Permit can be made in a positive manner (Exhibit B - Findings).
As such, staff recommends that the Planning Commission approve the application (PLN-24-
00011) for a new stealth tower wireless telecommunication facility.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
DOWNEY APPROVING CONDITIONAL USE PERMIT (PLN-24-00011),
THEREBY ALLOWING A 38-FOOT STAND-ALONE STEALTH WIRELESS
COMMUNICATION FACILITY WITHIN A 676 SQUARE FEET ENCLOSED
AREA LOCATED AT 9001 PARAMOUNT BOULEVARD IN THE R-1 7,500
(SINGLE-FAMILY RESIDENTIAL ZONE).
THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission of the City of Downey does hereby find, determine
and declare that:
A.On February 7, 2024, the application was filed by Victor Flores, Verizon
Communications representative, (hereinafter referred to as the “applicant”) a
request for Conditional Use Permit (PLN-24-00011) for a new stealth wireless
communication facility, within a property zoned Single-Family Residential (R-1));
and,
B.On March 8, 2024, after a careful review of the submitted information, staff deemed
the application incomplete; and
C.On May 29, the applicant resubmitted required documents and materials for
review; and,
D.On June 7, 2024, after a careful review of the submitted information, staff deemed
the application incomplete; and
E.On June 26, 2024, the applicant resubmitted required documents and materials
for review; and,
F.On June 27, 2024, after careful review of the submitted information, staff deemed
the application complete; and
G.On August 8, 2024, a notice of the public hearing was sent to all property owners
within 500-feet of the subject site and the notice was published in Downey Patriot;
and,
H.The Planning Commission held a duly noticed public hearing on August 21, 2024
and after fully considering all oral and written testimony, facts, and opinions offered
at the aforesaid public hearing adopted this resolution.
SECTION 2. The Planning Commission further finds, determines and declares that the
proposed project was reviewed for compliance with the California Environmental Quality Act
(CEQA), and is categorially exempt from CEQA, pursuant to Guideline Section No. 15303
(Class 3) – New Construction or Conversion of Small Structures. Categorical Exemptions are
projects, which have been determined not to have a significant effect on the environment and
have been exempted from the requirements of the California Environmental Quality Act. Class 3
exemptions consist of installation of small new equipment and facilities in small structures.

SECTION 3. Having considered all of the oral and written evidence presented to it at said
public hearings regarding the Conditional Use Permit, the Planning Commission further finds,
determines and declares that:
1.The requested Conditional Use Permit will not adversely affect the purpose and intent of
the Zoning Code or the City’s General Plan or the public convenience or general welfare
of persons residing or working in the neighborhood thereof. The purpose of the Zoning
Code is to regulate the use of land in order to promote the public’s health, safety, and the
general welfare. The Conditional Use Permit authorizes the installation of wireless
communication facilities, subject to specific standards outlined in Subsection 9426.04(b)
of the Downey Municipal Code. Since the proposed project adheres to these development
standards applicable to wireless communication facilities, it is deemed not to impede the
purpose and intent of the Zoning Code.
In accordance to General Plan Policy 2.7.1, the General Plan aims to "Provide adequate
utility and communications infrastructure." Furthermore, General Plan Program 2.7.1.2
emphasizes the necessity to "Promote the expansion of communication networks to meet
the needs of city residents, businesses, and other land uses." The proposed project aligns
with these policies by enhancing the communication network through the addition of a new
facility, thereby fulfilling the program's objectives. Therefore, the Conditional Use Permit
is deemed compatible with the City's General Plan.
Both the Zoning Code and the General Plan are designed to advance the public
convenience and the general welfare of individuals residing or working within the City. As
the Conditional Use Permit aligns with the provisions of both the Zoning Code and the
General Plan, it is determined not to adversely impact the public convenience or the
general welfare of individuals in the surrounding neighborhood.
2.The requested use will not adversely affect the adjoining land uses and the growth and
development of the area in which it is proposed to be located. Both the existing uses and
structures on the site and those on nearby properties will remain unaffected and
undisturbed by the installation of the wireless facility. Staff anticipates no adverse
consequences stemming from the proposal primarily because the wireless site conforms
to the prescribed development regulations outlined in Section 9426. In addition, the
proposed facility requires licensing by the FCC, which regulates the frequency of
emissions from cell sites to ensure they operate at specific levels.
Moreover, the placement of wireless facilities within stealth facilities, such as a tower, is
commonplace within non-residentially improved properties in close proximity to residential
uses. The design of the proposed facility is tailored to harmonize with existing structures
on the site and its surroundings. Lastly, the installation of the wireless facility will not hinder
the current or future utilization of the property or buildings located on the site.
3.The size and shape of the site proposed for the use is adequate to allow the full
development of the proposed use in a manner not detrimental to the particular area. The
site is approximately 230,400 square feet. The installation of the wireless communication
facility and ancillary equipment will occur within a stand-alone stealth designed tower
facility of 676 square feet, which is 0.02 % of total lot size. There is an abundance of
existing landscaping within and along the perimeter of the site, such as palm trees and

bushes. Moreover, the integration of a stealth WCF tower enclosed by a seven (7)-foot
split-face block wall serves as component in preserving the aesthetic and visual harmony
of the current site and its neighboring environs. This design solution screens the
mechanical apparatus—including generators, fuel tanks, piping, and equipment
cabinets—from public view, thereby safeguarding the aesthetic integrity of the area. The
wireless communication facility will not interfere with the potential future expansion of the
existing church site. Therefore, the size and shape of the site is adequate to allow the
proposed project without being detrimental to the area.
4.The traffic generated by the proposed use will not impose an undue burden upon the
streets and highways in the area. The proposed wireless communication facility will
generate limited visits to the site for maintenance purposes only. The wireless
communication facility operates autonomously without the presence of a working crew. The
limited maintenance visits will not impose an undue burden upon the streets and highways
in the area as the capacity of the surrounding streets and highways can accommodate the
trips generated by the maintenance of the facility.
SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution,
the Planning Commission of the City of Downey hereby approves Conditional Use Permit PLN-
24-00011, subject to conditions of approval attached hereto as Exhibit ‘A’, which are necessary
to preserve the health, safety and general welfare of the community and enable the Planning
Commission to make the findings set forth in the previous sections. The conditions are fair and
reasonable for the accomplishment of these purposes.
SECTION 5. The Secretary shall certify the adoption of this Resolution.

EXHIBIT A – CONDITIONS OF APPROVAL
PLANNING DIVISION
1.The approval of this Conditional Use Permit (PLN-24-00011) allows for the new 38-foot
high, wireless communication facility stealth tower to include the following:
•A 676-square foot lease area includes: new stealth designed WCF with (12) panel
antennas, (2) parabolic antennas, (1) proposed GPS antenna, twelve (12) remote
radio units (RRU), and three (3) tower mounted junction boxes screened by the
tower with decorative clad paneling and roofing material to match the existing
buildings. Ancillary ground mounted equipment includes cabinets and a 30kw
generator with a 168-gallon diesel fuel enclosed by a seven (7)-foot split face block
wall. The project site is located at 9001 Paramount Boulevard.
2.Approval of the Conditional Use Permit (PLN-24-00011) shall not be construed to mean
any waiver of applicable and appropriate zoning regulations, or any Federal, State,
County, and City laws and regulations. Unless otherwise expressly specified, all other
requirements of the City of Downey Municipal Code shall apply.
3.The applicant and the property owner shall sign and return an affidavit of Acceptance of
Conditions, as provided by the City of Downey.
4.The Owner/Applicant agrees, as a condition of approval of this resolution, to indemnify,
defend and hold harmless, at Applicant's expense, City and City's agents, officers and
employees from and against any claim, action or proceeding commenced within the time
period provided in Government Code Section 66499.37 to attack, review, set aside, void
or annul the approval of this resolution, to challenge the determination made by City under
the California Environmental Quality Act or to challenge the reasonableness, legality or
validity of any condition attached hereto. City shall promptly notify Applicant of any such
claim, action or proceeding to which City receives notice, and City will cooperate fully with
Applicant in the defense thereof. Applicant shall reimburse the City for any court costs and
attorney's fees that the City may be required to pay as a result of any such claim, action
or proceeding. City may, in its sole discretion, participate in the defense of any such claim,
action or proceeding, but such participation shall not relieve Applicant of the obligations of
this condition.
5.The project shall be constructed and maintained in strict compliance with the approved
plans.
6.The Community Development Director is authorized to make minor modifications to the
approved preliminary plans or any of the conditions if such modifications shall achieve
substantially the same results as would strict compliance with said plans and conditions.
7.Any relocation of the flagpole must be submitted for review to ensure structural integrity
and obtain a building permit (if required by the Building Division).
8.The proposed screening as shown on the approved plans shall be maintained
throughout the life on the Wireless Communications Facility to ensure complete
screening of the antennas and all other associated equipment is not visible from the

public view.
9.Any ground-mounted equipment shall not exceed the height of the proposed seven (7_-
foot high split face block wall enclosure.
10.The walls of the equipment enclosure shall be split face block material to match perimeter
of property. Prior to the issuance of building permits, the applicant shall demonstrate to
the satisfaction of the Community Development Director, that the finished materials will
comply with this requirement.
11.Any graffiti applied to the site shall be removed within 48 hours.
12.A landscaping plan prepared by a licensed landscape architect shall be provided at the
time of plan check submittal.
13.All utilities servicing the facility shall be installed underground.
14.The project must satisfy all necessary standards, requirements, licenses and registrations
from the Federal Communications Commission (FCC) and any other applicable regulatory
bodies prior to initiating the operation of the Wireless Communication Facility.
15.The applicant shall file, receive, and maintain all necessary licenses and registrations from
the Federal Communications Commission (FCC) and any other applicable regulatory
bodies prior to initiating the operation of the wireless telecommunication facility. The
applicant shall supply the Community Development Director with the documentation of
these licenses and registrations.
16.Within 30 days following the activation of the Wireless Communications Facility, the
applicant shall provide a radio frequency emissions compliance report to the Community
Development Director certifying that the unit has been inspected and tested in compliance
with FCC standards.
17.Every five years following the date of the building permit final, the applicant shall, at their
own expense, prepare and submit to the Community Development Director an
independently prepared updated radio frequency emissions compliance report and
certification in compliance with all applicable FCC standards.
18.If any radio frequency emissions compliance report and certification, required by the
Downey Municipal Code or these Conditions of Approval, demonstrates that the
cumulative levels of radio frequency emissions exceed or may exceed FCC standards,
the Community Development Director may require the applicant to modify the location or
design of the facility and/or implement other mitigation measures to ensure compliance
with FCC standards. The Director may require additional independent technical evaluation
of the facility, at the applicant’s expense, to ensure compliance with FCC standards.
19.In the case of discontinuation, within 30 days after discontinuation of use, the facility’s
operator shall notify the Community Development Director in writing that use of the facility
has been discontinued. Within 180 days after discontinuation of use, the facility must be
completely removed.

20.All construction shall comply with the most recent version of the California Building Code,
as adopted by the City of Downey.
21.Prior to the commencement of construction, the applicant shall obtain all required permits.
Additionally, the applicant shall obtain all necessary inspections and permit final prior to
beginning operation of the site.
FIRE
22.The following comments pertain to a limited fire review of a design review plan submittal.
The comments contained herein shall not be construed as complete or encompassing all
fire-life safety code requirements set forth in local, State, and/or National local codes.
23.The establishment shall comply with all current code requirements for the occupancy use
and type.
24.Both ground level enclosures shall be properly identified with operator information,
emergency phone numbers, location address, etc. Required hazardous identification and
warning signage shall be provided. Should the 16 VRLA batteries contain corrosive
electrolyte equal to or in excess of 55-gallons, the business shall be required to establish,
implement, and submit a Hazardous Materials Business Plan (HMBP) to Statewide
Environmental Reporting System (CERS) [HSC 25507; 25508].
25.Access to the wireless communication facility shall be maintained. Any antenna, or other
obstruction, shall not obstruct or render egress or access hazardous in the event of fire
other emergency [CA Fire Code §504.4]. New antenna locations with FRP screens shall
not obstruct fire department roof access.
PUBLIC WORKS
26.If any work is done in the public right-of-way, obtain permits from the Public Works
Department for all improvements within the public right-of-way at least two weeks prior to
commencing work. Contact Brian Aleman, Assistant Civil Engineer, at (562) 904-7110 for
information.
27.Any new public utilities shall be installed underground.
28.Submit public improvement plan(s) for review and approval by Public Works Department.
29.All or any proposed public improvements shall comply with the latest edition of Standard
Plans and Specifications for Public Works Construction, City of Downey standards, and
the Americans with Disabilities Act (ADA).
30.Remove all Underground Service Alert (USA) temporary pavement markings immediately
following the completion of the work / Final permit inspection.
31.Any utilities that are in conflict with the development shall be relocated at the
owner/applicant's expense
