B. PLN-24-00113 (CODE INTERPRETATION) Location: 13117 Lakewood Boulevard Request: Appeal of the Community Development Director’s interpretation of regulations classifying the business ‘Sexy & Sweet Exotic Bakery’ as an ‘adult business’ CEQA: Exemption – Section No. 15061(b)(3) (Common-sense Exemption) Staff: Associate Planner, Abraham Luna Recommendation: That the Planning Commission: ADOPT PLANNING COMMISSION RESOLUTION NO. 24-4033 DENYING THE APPEAL BY SEXY & SWEET EXOTIC BAKERY AND AFFIRMING THE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR DETERMINING THE BUSINESS LOCATED AT 13117 LAKEWOOD BOULEVARD TO BE AN ‘ADULT BUSINESS’ UNDER DOWNEY MUNICIPAL CODE SECTION 9402 PLANNING COMMISSION AGENDA AUGUST 21, 2024 C. PLN-23-00166 (CONDITIONAL USE PERMIT) Location: 11531 Downey Avenue Request: A request to relocate an existing roof-mounted wireless communication facility atop of an existing YMCA building on to the roof of an existing YMCA gymnasium on the same lot. CEQA: Categorical Exemption – Section 15303 (Class 3 – New Construction or Conversion of Small Structures) Staff: Principal Planner, Alfonso Hernandez Recommendation: That the Planning Commission: ADOPT PLANNING COMMISSION RESOLUTION NO. 24-4034 APPROVING A CONDITIONAL USE PERMIT (PLN-23-00166), THEREBY ALLOWING THE CONSTRUCTION OF A NEW ROOF MOUNTED WIRELESS COMMUNICATION FACILITY CONSISTING OF TWELVE (12) ANTENNAS, SIX (6) RRUS, AND FOUR (4) EQUIPMENT CABINETS, WITH A NEW 4’ (FOOT), 11” (INCH) TALL ROOF SCREENING ON AN EXISTING 25’ (FOOT), 10” (INCH) BUILDING ON A PROPERTY LOCATED AT 11531 DOWNEY AVENUE, ZONED OPEN SPACE (O-S). D. PLN-23-00168 (ZONE CHANGE, SITE PLAN REVIEW, CONDITIONAL USE PERMIT, VARIANCE, AN D LOT MERGER) Location: 11521 Downey Avenue, 11531 Downey Avenue, and 8268 Arnett Street Request: A request for: (1) A Site Plan Review to construct a new 18,718 square foot YMCA facility; (2) Conditional Use Permit to operate a private parks and recreation facility; (3) Variance proposing to maintain a non-conforming rear setback and height for an existing gymnasium building; (4) Zone Change to modify 11531 Downey Avenue (APN: 6255-013-032) from the Open Space (O-S) zone to the Commercial Office (C-P) zone and; (5) Lot Merger to consolidate three (3) separate lots into one new lot at the properties located at 11521 Downey Avenue and 8268 Arnett Street (C-P zone), and at 11531 Downey Avenue (O-S zone)(APNs: 6255-013-032, 6255-013-033, and 6255-013-034) CEQA: Categorical Exemption – Section 15332 (Class 32 – In-fill Development Projects) Staff: Principal Planner, Alfonso Hernandez Recommendation: That the Planning Commission: 1. ADOPT PLANNING COMMISSION RESOLUTION NO. 24-4035 RECOMMENDING THAT THE CITY COUNCIL APPROVE A ZONE CHANGE FOR 11531 DOWNEY AVENUE, THEREBY CHANGING THE ZONING DESIGNATION FROM THE OPEN SPACE (OS) ZONE TO THE COMMERCIAL OFFICE (CP) ZONE (APN: 6255-013-032). 2. ADOPT PLANNING COMMISSION RESOLUTION NO. 24-4036 RECOMMENDING THAT THE CITY COUNCIL APPROVE A SITE PLAN REVIEW, CONDITIONAL USE PERMIT, AND VARIANCE, THEREBY ALLOWING THE CONSTRUCTION OF A 18,718 SQUARE FOOT YMCA RECREATION USE FACILITY. A VARIANCE REQUEST IS INCLUDED TO DEVIATE FROM DOWNEY MUNICIPAL CODE SECTION 9410.12(C) MAINTAINING A REAR SETBACK OF 13’ 4” AND HEIGHT OF 25’ 10” FOR AN EXISITNG GYMNASIUM BUILDING. ADOPT PLANNING COMMISSION RESOLUTION NO. 24-4037 RECOMMENDING THAT THE CITY COUNCIL APPROVE A LOT MERGER FOR THE CONSOLIDATION OF THREE SEPARATE PARCELS (APNs: 6255- 013-032, 6255-013-033, AND 6255-013-034), LOCATED AT 11521 DOWNEY AVENUE, 11531 DOWNEY AVENUE, AND 8268 ARNETT STREET. 8. NOTICE: SECTION 9806 – APPEALS Any person aggrieved or affected by any final determinations of the Commission concerning an application for action of an administrative nature, including a variance or a permit, or any condition or requirement thereon, or upon the failure of the Commission to make its findings and determinations within thirty (30) days after the closure of the hearing thereon, no later than fifteen (15) calendar days, (Exception: subdivisions. no later than ten (10) calendar days) after the date of the decision or of the Commission’s failure to make a determination, may file with the City Planner a written notice of appeal there from to the Council.
