HomeMy WebLinkAboutResolution No. 24-8256 - Approving a three percent (3%) Increase of Assessments Levied on Parcels in Downtown Downey Community Benefit DistrictRESOLUTION NO. 24-8256 A 'RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING A THREE PERCENT INCREASE OF THE ASSESSMENTS LEVIED ON PARCELS IN THE DOWNTOWN DOWNEY COMMUNITY BENEFIT DISTRICT WHEREAS, on October 27, 2015, the City Council of the City of Downey adopted Ordinance No.-15-1346, the Downey Community Benefit District Procedural Ordinance, authorizing` the City to establish a Community Benefit District (CBD) to enhance the security, safety, appearance, and economic viability within such districts; and WHEREAS, Ordinance No. 15-1346 authorizes the City to levy and collect assessments on real property within such districts for the purpose of providing improvements and promoting activities that specially benefit real property within such districts; and WHEREAS, Ordinance No. 15-1346 authorizes the City to use the procedures set forth in the Property and Business Improvement District Law of 1994 (Streets & Highways Code sections 36600, et seq.) (PBiD Law); as incorporated and modified by Ordinance No. 15-1346, for purposes of forming an assessment district; and WHEREAS, on July 24, 2018, after a duly noticed public hearing and balloting procedure, the City Council adopted Resolution 18-7829 forming the Downtown Downey CBD to facilitate and encourage additional growth and revitalization in the Downtown Downey area and approving the Downtown Downey Community Benefit District 2018 Management District Plan (Management Plan) for the proposed CBD; and WHEREAS, Resolution 18-7829 constituted the levy of the annual assessment for a total of approximately $232,385 in CBD funds; and WHEREAS, the Downtown 'Downey Improvement Association (DDIA), the designated CBD nonprofit management corporation, was formed to administer funds and activities of the CBD in accordance with the Management Plan, including special events, private- security, beautification, marketing, promotional activities, public space development, enhancement for property owners, street sweeping, steam cleaning, public art and administration of the services, and an appropriate contingency/ reserve; and WHEREAS, the Management Plan permits the DDIA to determine annual assessment increases on parcels within the Downtown Downey CBD, not to exceed 5% per year; and WHEREAS, the DDIA has not increased the annual assessment since the formation of the Downtown Downey CBD and is now proposing a 3% increase on parcels within the CBD beginning in Fiscal Year 2024-2025;;and WHEREAS, the DDIA has solicited feedback on the proposed increase from impacted property owners within the CBD and provided the City with a summary of feedback received; and WHEREAS, the DDIA will invest the proposed assessment increase in accordance with the Management Plan; and i WHEREAS, on July 23, 2024, at 6:30 pm or as soon thereafter was practicable, the City Council held a duly noticed public hearing concerning the proposed assessment increase, at which it heard and considered oral and written testimony from all interested persons. RESOLUTION NO. 24-8256 PAGE 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The above recitals are true and correct, are incorporated herein, and by this reference made an operative part hereof. SECTION 2. The City Council approves the proposed assessment increase of 3% on parcels within the Downtown -Downey Community Benefit District beginning in Fiscal Year 2024- 2025. The total annual amount to be levied will increase to approximately $239,356. SECTION 3. The City Manager, or his designee, is hereby authorized to modify and execute any and all appropriate instruments, agreements, contracts, and documents related to the implementation and administration of a three percent increase of the assessments levied on parcels in the Downtown Downey Community Benefit District.: SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
