Director of Community Dev. /City Planner William Davis, Business Development Manager Christina Vogel, Assistant to the City Manager Shirley Conte, Executive Secretary 013948 Stephanie Klasky- Gamer, Director of Planning and Development for the Los Angeles Community Design Center, presented to the City, the Southern California Association of Non - Profit Housing's (SCANPH) "Project of the Year Award," noting the Los Angeles Community Design Center was the developer of the winning project "Heritage Court Senior Apartments." She explained SCANPH is the trade organization in Southern California that represents over 5,000 organizations committed to the development of affordable housing. She noted Heritage Court Senior Apartments was one of 17 projects nominated. She noted Heritage Court is 31 new units of housing for seniors located at Third Street and La Reina Avenue. She recognized the City for its participation and commitment to the project and thanked Darrell George and Ed Velasco for their leadership and dedication. Mayor Winningham stated he is very proud of this project, which is the first senior project completed by the City. He advised that over 90 of the 120 applicants for the apartments were Downey residents. He commended Los Angeles Community Design for an excellent job. 0131 4 HEARINGS Mayor Winningham opened the Public Hearing to CONSIDER THE APPLICATION OF SOUTHERN EXPRESS TAXI FOR A PERMIT TO CONDUCT TAXICAB SERVICE IN THE CITY OF DOWNEY. Ms. Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Perkins, seconded by Council Member McCarthy, and so ordered to receive and file. Ms. Vogel advised the applicant, Southern Express Taxi, owner Antonio Ordaz, submitted the required documents for a permit to conduct taxicab service in the City. The Police Department conducted an investigation to insure the company and each of its drivers are of good moral character and will provide service in a responsible manner that is beneficial to the citizens of Downey. She advised Southern Express Taxi anticipates providing nine taxicabs, with seven drivers, and noted this would be the sixth taxi company to obtain a permit to operate in the City of Downey. Council Member Cartozian inquired if the City had a cap on the number of taxicab services in the City and was informed there is no cap, the applicant only has to meet the City's qualifications. Council Member McCarthy advised that applications in the past have included insurance forms, rates, and financial statements, noting they were not included in the Council's packet. He was informed these items were found to be in good order. Council Member Trejo inquired how often the taxi applications are reviewed and was informed they are reviewed annually. There was no correspondence received regarding this matter. Mayor Winningham asked if the representative of Southern Express Taxi wished to come forward and address the Council and no one came forward to speak. There being no one to speak in favor or in opposition to the proposed application, it was moved by Council Member McCarthy, seconded by Council Member Perkins, and so ordered to close the public hearing. It was moved by Council Member Perkins, seconded by Council Member Cartozian, and unanimously carried to approve the application for permit by Southern Express Taxi to conduct taxicab service in the City of Downey. Mayor Winningham opened the public hearing on PROPOSED DOWNEY MUNICIPAL CODE AMENDMENT RELATED TO DELETING CERTAIN SUB -ZONES AND USES IN THE OS (OPEN SPACE) ZONE, which was continued from the Council Meeting of September 25, 2001. Council Minutes 10/23/01 -2- 01390 • Prior to opening the hearing, Mayor Winningham announced a letter was received on October 19th from the Law Offices of Steven Sheldon requesting a continuance of the scheduled October 23rd City Council Hearings, Agenda Items IV -B and IV -C, to the November 27, 2001, Council Meeting. He advised the applicants are currently working with City staff and the City Attorney on various issues. Mr. Vose advised he has been discussing this matter with Mr. Sheldon and recommended staff continue the public hearings to the November 27th Meeting. He stated the hearing should be opened and continued, if this is the desire of the Council. Ms. Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Perkins, seconded by Council Member Trejo, and so ordered to receive and file. Ms. Midstokke referenced the letter mentioned by Mayor Winningham from Steven Sheldon, dated October 19th, wherein he requested a continuance to November 27, 2001, and also a letter received today, dated October 23rd, from Claude and Teri Bilodeau, urging the Council to support the project. Mayor Winningham asked if anyone present, who cannot attend the Council Meeting on November 27, 2001, wished to speak to the proposed Code Amendment. There being no one to speak, it was moved by Council Member Perkins, seconded by Council Member Trejo, and unanimously carried to continue the public hearing to 7:30 p.m., November 27, 2001, in the Council Chamber of Downey City Hall. Thomas Mullen stated he works with the Law Office of Stephen Sheldon and thanked the Council for continuing this matter. Mayor Winningham opened the public hearing on CERTIFICATION OF ENVIRONMENTAL IMPACT REPORT (ENVIRONMENTAL ASSESSMENT NO. 01-66); ZONE CHANGE NO. 01 -64; APPEAL, GENERAL PLAN AMENDMENT NO. 00 -06; APPEAL, ZONE CHANGE NO. 00 -07; APPEAL, CONDITIONAL USE PERMIT NO. 00-08; AND APPEAL, ZONE VARIANCE NO. 01-65, all of which were continued from the Council Meeting of September 25, 2001. Ms. Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Perkins, seconded by Council Member Trejo, and so ordered to receive and file. Ms. Midstolke again referenced the letter previously mentioned from Steven Sheldon, dated October 19th, wherein he requested a continuance of the public hearing to the November 27, 2001, Council Meeting, and the letter received today, dated October 23rd, from Claude and Teri Bilodeau urging the Council to support this project. The proposed speed limit maintains the existing limit of 40 miles per hour for the segment from Florence Avenue to Firestone Boulevard and reduces the speed limit along the remainder of the street from 40 miles per hour to 30 miles per hour. Council Member Cartozian referred to background materials, which state the California Vehicle Code has three methods for establishing speed limits. He was informed three methods are listed but the one applicable to this case is for radar enforcement and requires an engineering survey. 013351 Mayor Winningham noted his agreement with the reduced speed limit on Old River School Road, noting this has been a problem area for collisions. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3186 OF THE DOWNEY MUNICIPAL CODE RELATING TO SPEED LIMITS FOR OLD RIVER SCHOOL ROAD The Ordinance was read by title only. It was moved by Council Member Perkins, seconded by Council Member McCarthy, and unanimously carried to waive further reading and introduce. RESOLUTIONS: None ADMINISTRATIVE REPORTS PROPOSITION 12: WATERSHED, WILDLIFE AND PARKS IMPROVEMENT BOND ACT OF 2000, URBAN FORESTRY GRANT PROGRAM Mr. Alvarez pointed out the citizens of California approved the Watershed, Wildlife and Parks Improvement Bond Act in the year 2000, which made available monies for the improvement of parks in the urban environment. One of the designated improvements was the acquisition of trees for planting along medians, parks, parkways, and other public properties. The program is administered by the Department of Forestry and Fire Protection, who is soliciting grant applications from communities throughout California and Staff has prepared an application for Council's approval. He noted grants up to $50,000 are available and the City has requested the maximum amount. He pointed out trees benefit the environment by improving air quality and producing oxygen; providing shade; creating energy savings; functioning as a windscreen; reducing dust and noise; and most importantly improving the visual landscape. The $50,000 grant request would facilitate the purchase and installation of 770 trees, with $44,400 in matching funds to be provided by the City, for a total project cost of $94,400. He responded to comments from the Council. Council Member Cartozian commended Mr. Alvarez and his staff for identifying and researching this grant. Council Member Trejo requested a brief explanation of the public education program and was informed staff will be speaking to children at local schools about the importance of trees and will also solicit volunteers to assist with the program. He felt it was a wonderful program and was in support. Richard B. Pridham, 10402 Bellman Avenue, stated he felt this was a wonderful opportunity to improve Downey. He noted the City has planted many trees in the past but some were not taken care of and died, creating depressions in the sidewalks where people can stumble and fall. He suggested filling these depressions with the new trees. He also noted some trees do a great job of growing while others are high in maintenance and do not grow well. He suggested selecting trees that are presently doing well, which will enhance the City's appearance and will result in a good investment. Council Minutes 10/23/01 -6- Mr. Alvarez noted the majority of the trees will be placed in parkways and medians. RESOLUTION NO. 6517 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE WATERSHED, WILDLIFE AND PARK IMPROVEMENT BOND ACT OF 2000, URBAN FORESTRY GRANT PROGRAM The Resolution was read by title only. It was moved by Council Member Perkins, seconded by Council Member McCarthy, and unanimously carried to waive further reading and adopt, and authorize the City Manager to execute any agreements and requests for payments as necessary for the program. WASTE TIRE PLAYGROUND COVER GRANT APPLICATION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE WASTE TIRE PLAYGROUND GRANT PROGRAM FY 2001/2002 THROUGH THE INTEGRATED WASTE MANAGEMENT BOARD OF THE CALIFORNIA ENVIRONMENTAL PROTECTION AGENCY RESOLUTION NO. 6518 The Resolution was read by title only. It was moved by Council Member Perkins, seconded by Council Member McCarthy, and unanimously carried to waive further reading and adopt, and authorize the City Manager to execute any agreements and requests for payments as necessary for the program. Council Minutes 10/23/01 -7- Mr. Alvarez noted this is another grant application, explaining the California Integrated Waste Management Board (CIWMB) receives an annual appropriation from the California Tire Recycling Management Fund to administer the Tire Recycling Act. Various programs are funded by this money and one program is for the purchase of rubberized surfaces for use at playground areas. This year $800,000 is available for playground cover grants, with applications accepted for amounts up to $25,000. Staff is proposing to submit an application for the installation of rubberized surface covering under the playground equipment at Furman Park that currently utilizes sand. He reviewed the benefits of the rubberized surface, noting it creates an accessible play area for handicapped children and diverts waste tires from local landfills. He advised the City is required to provide matching funds, which will be brought back to the Council for inclusion in the next fiscal year budget cycle. He responded to comments from the Council. Mayor Winningham noted the tire recycling material was installed at Golden Park, Rio San Gabriel Park and now Furman Park, and inquired how the product was holding up. Mr. Jarrett advised the product to be utilized at Furman Park is a better, improved product than that used at Rio San Gabriel Park. #954/ 01.3 `' 53 CITY EMPLOYEES ORDERED TO ACTIVE MILITARY DUTY Mr. Powell explained the Resolution for Council's consideration to extend pay and benefits to employees called to active military duty. He noted State law currently requires all public agencies to pay full benefits to employees for a maximum of 30 days per fiscal year. If an employee remains on active military duty beyond the 30 days, the employee would no longer receive salary and benefits. He advised that State law does authorize the City to pass a Resolution extending pay and benefits to employees while they are on active duty. He referred to the current military action known as "Enduring Freedom," noting a Resolution has been prepared to authorize paying the salary and benefits to employees on active military duty. He advised that one City employee has been called to active duty and there is a possibility of two additional employees being called. Council Member Perkins was in favor of the Resolution and felt it was an excellent program. He noted the three potential employees consist of two police officers and one fireman. Council Member Cartozian inquired why a Resolution like this was not already in place and was informed no employee has been called to active military duty and now there has been an employee called. He asked what other cities have done and was informed some cities have also initiated similar Resolutions. He inquired if the Resolution would become inactive after a certain period of time and was informed it only applies to the current military operation, "Enduring Freedom." The Council would consider any future situations on their own merit. Council Member McCarthy requested, as there is no foreseeable end to the current military situation, that the Resolution be brought back as a reminder in a year from now. Lennie Whittington, 8542 Manatee Street, spoke in favor of the Resolution and inquired if it would also apply to employees in departments other than police and fire. He was informed it applies to all full -time employees. Council Minutes 10/23/01 -8- RESOLUTION NO. 6519 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXTENDING THE PAY OF CITY EMPLOYEES ON TEMPORARY MILITARY LEAVE DUE TO OPERATION ENDURING FREEDOM The Resolution was read by title only. It was moved by Council Member Perkins, seconded by Council Member Trejo, and unanimously carried to waive further reading and adopt. Mayor Winningham acknowledged former Mayor Hazel Scotto in the audience, noting she still attends many I -5 Freeway Consortium Meetings regarding the widening of the Santa Ana Freeway and meetings regarding water quality issues and thanked her for her participation and input. OTHER BUSINESS - Consent Calendar - Items removed by Council Approval CASH CONTRACT NO. S.S. 514 AND 515 — TRAFFIC SIGNAL MODIFICATIONS AT THE INTERSECTIONS OF FLORENCE AVENUE/WOODRUFF AVENUE AND FLORENCE AVENUEBROOKSHIRE AVENUE Council Member Trejo stated he felt this was a good project to enhance traffic flow in the City. He requested the intersection at Florence Avenue/Downey Avenue be reviewed for future consideration, noting it is presently a potential hazard, with many people running the red light. Mr. Alvarez noted staff is currently in the process of evaluating all City traffic signals and is moving forward with the installation of protective permissive left -turn signals, as funding becomes available. RESOLUTION NO. 6514 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING PROGRAM SUPPLEMENTS NOS. M009 AND MO10 TO CITY OF DOWNEY -STATE MASTER AGREEMENT NO. 07 -5334, FOR THE CONSTRUCTION OF TRAFFIC SIGNAL MODIFICATIONS ON FLORENCE AVENUE AT WOODRUFF AVENUE AND BROOKSHIRE AVENUE, RESPECTIVELY The Resolution was read by title only. It was moved by Council Member Cartozian, seconded by Council Member Trejo, and unanimously carried to waive further reading and adopt, and award a lump sum contract totaling $66,920 to L. A. Signal, Inc., for traffic signal modifications at the intersections of Florence Avenue/Woodruff Avenue and at Florence Avenue/Brookshire Avenue. DOWNTOWN PUBLIC PARKING LOTS Council Member Cartozian referred to discussions at the last Parking Place Commission Meeting, stating, in addition to the designated permit parking being altered and being changed to two -hour parking, there was also discussion about changing two -hour parking spaces to one -hour parking. It was pointed out the alteration of 20 of the existing 24 designated permit parking spaces was brought before the Council because a specific decision was made. The decision on whether to proceed with changing two -hour parking to one -hour parking is an item for continual discussion and will be brought up at the Parking Place Commission's next meeting. It was moved by Council Member Cartozian, seconded by Council Member McCarthy, and unanimously carried to approve the alteration of 20 of the existing 24 designated permit parking spaces to two -hour parking, for City parking lot No. 4, located at the southeast corner of Second Street and La Reina Avenue, and approve the change of 6 of the existing 10 designated permit parking spaces to two -hour parking, and the placement of the remaining 4 permit parking spaces to the middle of the aisle, for City parking lot No. 13, located east of Downey Avenue, between Second Street and Third Street. Council Minutes 10/23/01 -9- 1X961 DEPARTMENT OF JUSTICE /OFFICE OF EMERGENCY SERVICES COUNTER - TERRORISM GRANT Richard B. Pridham, 10402 Bellman Avenue, inquired as to what decontamination is being referred to and what the quantities are. Chief Sauter advised the equipment will serve to protect firefighters as they decontaminate members of the fire service and public from biological or chemical agents. Most of the decontamination is done with water. He noted fire turnouts are currently utilized, which offer a certain level of protection, along with the self - contained breathing apparatus (SCBA). He stated the new equipment will improve the Departments' ability to decontaminate more people. He advised that most people are decontaminating with water, which is the drug of choice at this time. Mayor Winningham mentioned water is part of the decontamination process for anthrax, noting warm water and soap are the first steps in decontamination. He stated the $23,850 will not come out of the City's budget and will limit the number of suits, which are definitely not for the public but are for the Fire Department for first -in response. It was moved by Council Member McCarthy, seconded by Council Member Cartozian and unanimously carried to appropriate $23,850 for the purchase of decontamination equipment for use by the Fire Department. Council Member McCarthy suggested a demonstration of this equipment be provided during the next Fire Service Day. ORAL COMMUNICATIONS Hazel Scotto, 9203 Cord Avenue, and Ruth White,12066 Paramount Boulevard, representing the Downey League of Women Voters, referenced a letter from the League requesting an item on the next Council Agenda. Ms. Scotto noted it has been 30 years since the Downey League of Women Voters toured City Hall and received briefings by the City department heads. She stated many changes have come about and the League is proposing to set up two "Know Your City" public forums to better understand how the City is coping with today's services and needs. Mayor Winningham advised the Council has been advised of the League's request and looks forward to the events. He noted Ms. Vogel is working with a committee now on events celebrating the City's 45th Year of Incorporation. He also referred to the League of Women Voters candidate forums tomorrow night. Ms. White advised the forums will be held at the Downey City Library at 6:30 p.m. for candidates for Downey Unified School Board and Cerritos College Board. Ken Tonkovich, 12337 Brock Avenue, presented a short Power Point presentation regarding a motor home that is always parked next to his home, blocking his street view when backing out of his driveway and causing a dangerous situation for his son. He requested the City's assistance in resolving this situation. Council Minutes 10/23/01 -10- Mayor Winningham advised that Public Works and the Police Department are reviewing this situation. He noted the City of Brea does not allow nighttime parking on City streets in an effort to eliminate these situations. Lennie Whittington, 8542 Manatee Street, thanked staff for removing the obsolete signs at La Reina Avenue and Firestone Boulevard; for the left turn arrows on Firestone Boulevard at Downey Avenue and at Brookshire Avenue; and he referred to the 7 or 8 non - profit groups that sell fireworks but have not submitted the required financial information and felt the City should enforce this requirement. OTHER BUSINESS - Council Members Council Member Trejo urged everyone to vote on November 6th for Downey Unified School Board members and Cerritos College Board members. Council Member Trejo wished everyone a happy and safe Halloween. Council Member Cartozian mentioned he enjoyed attending the closing matinee performance of the play "Annie Get Your Gun" on Sunday at the Downey Civic Theatre along with the Mayor Winningham. Council Member Cartozian echoed Council Member Trejo's remarks and urged citizens to exercise their right to vote on November 6th for School District and College Board members and also in March 2002 on the fireworks issue. Council Member McCarthy commented he enjoyed the Theatre performance of Annie Get Your Gun, especially since Annie Oakley and he are both from Ohio. Council Member McCarthy announced the December 2nd Chamber of Commerce Holiday Lane Parade was approved on tonight's agenda under the Consent Calendar and requested notice also be placed on the City's Web site. Council Member McCarthy announced the Downey Symphonic Society is conducting programs for students tomorrow at the Downey Civic Theatre. Council Member McCarthy advised he enjoyed attending the Library's dedication of a selection of the Carpenter's works, with Richard Carpenter in attendance. He noted the Carpenter family is a great part of the community's history. Council Member Perkins announced that the SEAACA (Southeast Area Animal Control Authority) remodeling project is running on schedule and within budget. The facility should be completed some time next year. He noted he sits on the SEAACA Board. Council Member Perkins mentioned he had the pleasure of attending the Daughter's of the American Revolutions' (DAR's) 50th Anniversary celebration on Saturday. He noted Anita Tuttle, mother of Police Officer Tuttle, received a pin for being involved with this organization for 50 years. He noted Cathy Tribe was also there and she was a charter member of the group. Council Minutes 10/23/01 -11- 013958 a 01 Mayor Winningham noted the luncheon tomorrow honoring Downey City employees with service awards for 5, 10, and 15, years of service at Rio Hondo Country Club. Mayor Winningham announced tomorrow evening the YMCA will kick off its annual fundraising campaign and reminded people to also support local charities. Mayor Winningham mentioned the League of Women Voters forum tomorrow evening at the Downey City Library for College and School Board candidates. Mayor Winningham noted the Chamber of Commerce business of the year luncheon will be held on Friday. Mayor Winningham advised the YMCA/Rotary annual pancake breakfast will be held on Saturday. He stated this is the 52nd or 53rd year for this annual event. Mayor Winningham mentioned the rededication of the Seventh Day Adventist Church on Lakewood Boulevard. They will be celebrating 89 years of history. Mayor Winningham announced on Wednesday, October 31st, the annual "Pumpkin Patch" event sponsored by the Downey Optimist and Soroptimist Clubs will be held at Furman Park from 4:00 to 9:00 p.m. and encouraged everyone to attend.
