The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:30 p.m., April 22, 2003, in the Council Chamber of the Downey

APPROVAL OF CLOSED SESSION MINUTES
It was moved by Council Member/Commissioner Cartozian, seconded by Council Member/-
Commissioner Perkins, and unanimously carried (4/0) to approve the Closed Session Minutes of
April 8, 2003.
RECESS TO CLOSED SESSION
Mayor/Chairman Trejo announced the Council/Commission is recessing to Closed Session
(6:31 p.m.) to discuss matters under the authority of the following Sections of the Government Code:
1 SECTION 54956.9(a) – Conference with legal counsel – existing litigation: Martinez
vs. City of Downey, et al., Los Angeles County Superior Court, Case # BC 277402.
2.SECTION 54956.9(b) – Conference with legal counsel – anticipated litigation
(exposure to litigation) (one potential case).
Council Member/Commissioner McCarthy arrived at 6:38 p.m.
The meeting reconvened in open session at 7:39 p.m. with all Council Members/-
Commissioners present. Mayor Trejo announced there were no Closed Session actions to report, but
that they will be reconvening at the end of the City Council meeting.

The City Council of the City of Downey held a Regular Meeting at 7:41 p.m., April 22, 2003,
in the Council Chamber of the Downey City Hall, Mayor Rick Trejo presiding.

PRESENTATIONS
Mayor Trejo presented to Jason Wen, Utilities Superintendent, a Proclamation declaring
May, 2003 as Water Awareness Month in the City of Downey. Public Works Director Alvarez
announced several events that will be occurring this month related to water. A booth at the Street
Faire; a special event as part of Kids Day; and classes at the Library starting in May about Downey’s
water system, conservation and water issues in general.
Mayor Trejo presented to West Middle School Builders Club & Teachers a Proclamation
declaring April, 2003 as Keep Downey Beautiful Month in the City of Downey. Carol Rowland,
Keep Downey Beautiful coordinator thanked the group for their participation all year and especially
the teachers for securing the Saturday helpers.

Mayor Trejo opened the Public Hearing at 7:53 p.m. City Clerk Midstokke indicated no
correspondence had been received.
A staff report including a Power Point presentation was presented by Assistant Director of
Community & Economic Development/City Planner Yostaki. He indicated that this item was
continued from two weeks ago with direction to staff to look at deleting some of the areas initially
presented, specifically the C-M (Commercial Manufacturing) areas. Self-storage would then be
allowed, subject to the Conditional Use Permit (CUP) process, in the Industrial areas of the City
which are M- 1 (Light Manufacturing) and M-2 (General Manufacturing). He then reviewed the sites
that potentially would be removed and their current developments. He further noted that if the
Commercial Manufacturing areas were deleted, Section 6 of the Ordinance would need revision.
Council Member McCarthy indicated he has listened to the audio tape of the last meeting
from which this item was continued and also commended staff for adding recreational vehicle
storage. He then inquired regarding height limitation and Mr. Yoshiki responded that height is
limited by zone as well as light angle.
In response to Council Member McCarthy’s question, Mr. Yoshiki indicated that there are 2
parking scenarios, one for exterior units which creates a parallel parking area in front of the units, and
another for interior units requiring parking in proximity to the opening at a ratio of 1 for 3 units. A 2
car garage is being required for the caretakers unit as well as 5 spaces for the office visitors.
Council Member McCarthy pointed out that there are locations in the City such as near
freeways and riverbeds that might not be zoned for this use, but should be looked at in the near future.
He further indicated that we might want to specifically clarify that no residential use, except for the
caretakers unit, is allowed.
Council Member Perkins pointed out that surrounding cities such as Bellflower, Bell Gardens,
Norwalk, Santa Fe Springs and South Gate allow these types of uses only in their Manufacturing
zones. He further mentioned that this type of development brings very little return to the City yet is a
very profitable business for developers.
Mayor Trejo asked if anyone from the audience wished to address this item.
Lennie Whittington, resident of Downey, inquired whether the Fu-Lyons property was
included and the response was no.
There being no further speakers, it was moved by Council Member Perkins, seconded by
Mayor Pro Tempore Cartozian, and so ordered to close the Public Hearing at 8:08 p.m.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE, ARTICLE IX, CHAPTER 1,
RELATED TO CERTAIN SECTIONS PERTAINING TO SELF-STORAGE/ MINI-
WAREHOUSE AND RECREATIONAL VEHICLE STORAGE USES. (CODE
AMENDMENT NO. 01-57).

The Ordinance was read by title only and Section 6 was amended to read: “Upon the effective
date of this Ordinance, subsection (15) of Section 9127.06 of Article IX, Chapter 1 of the Downey
Municipal Code shall be deleted in its entirety.“
It was moved by Mayor Pro Tempore Cartozian, seconded by Council Member Perkins and
unanimously carried to waive further reading and introduce.
2.AN AMENDMENT TO THE DOWNEY MUNICIPAL CODE, ARTICLE IX,
CHAPTER 1, SECTION 9110 RELATING TO THE SINGLE-FAMILY
RESIDENTIAL (R-1) ZONE, SECTION 9112, RELATING TO THE TWO-FAMILY
RESIDENTIAL (R-2) ZONE, AND SECTION 9158, RELATING TO SECOND UNIT
DEVELOPMENTS. (CODE AMENDMENT NO. 03-01).
Mayor Trejo opened the Public Hearing at 8:12 p.m. City Clerk Midstokke affirmed receipt
of the Proof of Publication. It was moved by Council Member McCarthy, seconded by Council
Member Perkins, and unanimously carried to receive and file. There was no correspondence
received on this item.
A staff report including a Power Point presentation was presented by Assistant Director of
Community & Economic Development/City Planner Yoshiki. He explained that the proposed Code
Amendment is precipitated by AB 1866, which went into effect in September of last year. It requires
cities to use a ministerial process for consideration of second unit development applications.
Proposed tonight are language revisions and adding some standards to second unit development.
Mr. Yoshiki indicated that this type of development has been allowed since the City’s
incorporation and there are roughly 20 areas in the City where this development pattern exists. The
current Code allows Public Hearings with notification to neighbors and a Design Review Board
process. AB 1866 eliminates the Public Hearing process and takes it back to a staff/department
review level of a particular project.
Mr. Yoshiki fUrther indicated that the proposed standards include: only one kitchen per unit;
no accessory living quarters allowed; Design Review Board review to assure compatibility between
residences; and requiring one unit to be owner occupied.
Mayor Trejo asked if anyone present wished to speak on the proposed amendment.
Guy Sterner, resident of Downey, requested the Council to accept the fact that this is
mandated by the State, that it may decrease the number of illegal garage conversions and that it may
decrease the crowded conditions of multi-families living in the same dwelling.
There being no further speakers, it was moved by Council Member Perkins, seconded by
Mayor Pro Tempore Cartozian and so ordered to close the Public Hearing at 8:30 p.m.

Mayor Pro Tempore Cartozian noted that parking could be further impacted in already dense
areas as 2nd dwelling units are allowed and this needs to be kept in mind and addressed.

Council Member McCarthy requested that the City send a letter to residents and property
owners in each of these second unit development areas making them aware of the fact that they are
in such an area, what those circumstances are, what this change is, and what the consequences are.
This would educate them about what is taking place. Mayor Trejo concurred with this notification.
City Manager Caton indicated that the residents could be notified that they are in a second unit
development area, the change in the State law and what can be happening in their neighborhood.
ORDINANCE NO.

AMENDING THE DOWNEY MUNICIPAL CODE, ARTICLE IX, CHAPTER 1,
SECTION 9110 RELATING TO THE SINGLE-FAMILY RESIDENTIAL (R-1) ZONE,
SECTION 9112, RELATING TO THE TWO-FAMILY RESIDENTIAL (R-2) ZONE,
AND SECTION 9158, RELATING TO SECOND UNIT DEVELOPMENTS.
The title of the Ordinance was read. It was moved by Mayor Pro Tempore Cartozian,
seconded by Council Member Bayer and unanimously carried, to waive further reading and
introduce.
ORAL COMMUNICATIONS
John McDonald, resident of Downey, requesting that the City Council issue a Proclamation
that May is Motorcycle Awareness Month, making the rest of the motorist aware of motorcycles.
Lennie Whittington, resident of Downey, referred to a recent Los Angeles Times article
regarding Juvenile Hall in Downey which indicated the children are being abused such as over
medicated, restrained and beaten; and thinks the City should do something.

ADMINISTRATIVE REPORTS
13.SUBORDINATION AGREEMENT BETWEEN CARDONO SQUARE LTD., AND
KRIKORIAN PREMIERE THEATERS.
A staff report was presented by Business Development Manager Davis indicating that Angelo
Cardono, president ofCardono Square Ltd. property located at 8233-8255 Firestone Blvd., has asked
for the City’s help in resolving a problem caused by the shared parking lease agreement with
KHkorian Theaters and his attempt to refinance the subject property.

He gave a brief history of the shared parking lease agreement which was originally executed
in 1995 to provide 189 parking spaces for the theaters for specific hours of the day on the Cardono
Square Ltd. property. These spaces are leased by Kdkorian Theaters at the rate of $2,000 per month.
Mr. Davis stated that Mr. Cardono is attempting to refinance the loan on his property and the
bank is requesting that the shared parking lease agreement by subordinated to the new bank loan.
Assistant City Attorney Ed Lee has determined that the City of Downey is not a party to the lease and
has no legal right to dictate any resolution on this issue, however, he has suggested several different
actions that the City could take to help address this issue. They include requiring an in-lieu parking
fee for each space; the parking structure could provide substitute parking for Kdkorian; the City could
assist in referring other banks to Cardono; or the City could approve an amended lease between
Cardono and Krikorian which subordinates Krikorian’s interest to a bank loan. Staff is
recommending the 1 st scenario wherein an in-lieu parking fee be established.
City Attorney Vose clarified that this recommendation really only comes into play if there is a
subordination and the bank forecloses and uses the property for another use. The recommendation is
only a back-up position if in fa8t the City consents to the subordination aid in the event there is an
actual foreclosure of the property by the bank and the bank takes it over and extinguishes the Lease
on the property and develops it in a way that does not allow parking.
Mr. Vose referred to the copy of City Council Resolution No. 5903 (attachment 1 to the staff
report), page 2, Section 2, subparagraph d. that says upon expiration, termination, cancellation, etc. of
the Parking Lease for any reason whatsoever then they (Kdkorian) are required to comply with the
Code in regards to off-street parking. The recommendation is consistent with this subsection.
He further clarified that the City does not have to consent to the subordination in order for the
subordination to become effective. However, the City can, and there is no problem in doing so.
City Manager Caton expressed that Mr. KHkorian wants to be assured that it is okay with the
City to subordinate by the City taking some type of action.
Council Member Perkins questioned why staff was recommending option No. 1. Mr. Davis
responded that it seemed to be the easiest alternative to pursue because it was consistent with the
City’s development standards and it was also a way of stimulating pedestrian traffic in the downtown
area
Council Member Perkins indicated that it seemed the easiest option was No. 4, wherein the
City would approve an amended lease, which would allow Mr. Cardona to continue to collect the
$2,000 per month from the theaters. Mr. Vose indicated that this option is the primary request and
the in-lieu fees are a backup position that only comes into play in the event of a foreclosure.
Angelo Cardono, resident of Downey, and President ofCardono Development Corp. stated
that he felt the situation has been stated quick clearly. He noted the history as KHkorian wanting to
build a theater, the City wanted it, they needed the parking and he was all too happy to help out. They

indicated the matter can be resolved immediately if the City will satisfy Kdkorian as the City
Attorney has mentioned.

Council Member McCarthy inquired if the Council were to approve option # 4, if that would
satisfy both parties. Mr. Cardono indicated it would.
Mayor Pro Tempore Cartozian questioned whether the in-lieu fee would affect Mr. Cardono.
Mr. Cardono responded that he is only interested in the subordination, which the bank wants.
Guy Sterner, resident of Downey, clarified that although the original lease was for 15 years,
the tenant has an option to extend for 5 additional 5 year terms, which would actually be 25 years past
the original agreement. His concerns include the past financial incentives already given to Mr.
Cardono and whether the interests of the entire downtown business community are being considered.
Mayor Pro Tempore Cartozian requested a clarification of option # 4 and staffs
recommendation. Mr. Vose responded that staffs recommendation only goes into effect if there is a
default, so it does not provide any potential City revenue unless that occurs. He further clarified that
the option of in-lieu fees would still be available in the event of a default, even if the Council only
approved option # 4 at this time.
Mr. Vose stated that the suggestion motion based upon Council comments would be that the
City Council indicate its consent to the subordination and direct the City Manager to draft a
letter so indicating their consent.
The above motion was moved by Council Member Perkins, seconded by Council Member
McCarthy and unanimously carried.
OTHER BUSINESS - Consent Calendar - Items removed by Council Approval:

Council Member Perkins indicated he had pulled this item to clarify that there has been a
request from the operators of the Rio Hondo Clubhouse that their contract be terminated, effective
July 3 1, 2003, which came in the way of a letter from their attorney. He wanted to make sure the
audience realized that this termination was not initiated by the City.
It was moved by Council Member Perkins, seconded by Council Member McCarthy and
unanimously caITied to approve the Revised Fifth Amendment to the License Agreement with
Rio Hondo Food and Beverage Licensee, Joan Wynne, that temporally suspends rent payment
to City and ensures continued food and beverage services during construction (with License
Agreement terminating on July 31, 2003).
OTHER BUSINESS - Council Members Comments
Council Member McCarthy referred to the Community Development Commission’s approval
tonight of an appropriation of $113,142, referred to as the ERAF shift, and questioned if we knew the
formula used by the State to calculate the amount. City Manager Caton responded that the total
for the entire State of California was $75 Million. Finance Director Michicoff stated that we were

told this was our “fair share” and that the State had sent an excerpt of a large worksheet that they used
to compute the amount. Mr. Michicoff indicated that he did a comparison of other Redevelopment
Agencies of equal size and the amounts are equivalent relatively speaking.
Council Member McCarthy indicated that he would like to support the request that we
declare a Proclamation for May being Motorcycle Safety Awareness Month.
Council Member McCarthy announced that he had participated in the Keep Downey
Beautiful clean up on April 12 and also the Emergency Preparedness Fair on the same day.
commended the Fire Department, the Emergency Preparedness Committee and all of the other
organizations that participated. He mentioned that the Public Works staff present was very
complementary about the new Utilities Superintendent, Dr. Jason Wen.

Council Member McCarthy commended the Police Department for their Annual Report
released at the beginning of April which included crime statistics as well as Personnel changes.
Mayor Pro Tempor6 Cartozian mentioned that at the last Council Meeting the new
Community Services Director Bonnie Kehoe had been recognized and since that meeting Thad
Phillips has been appointed the new City Librarian. He also noted that the new quarterly
magazine from the Community Services Department is very colorful, informative and has a great
number of excellent classes.
Mayor Pro Tempore Cartozian announced that he had attended a meet and greet event at
Assembly Member Firebaugh’s office along with Council Member McCarthy and other local
Council Members.
He further announced there will be an opportunity to meet a former Downey alumni when the
Council will be honoring and recognizing the achievements of a Division 1 NCAA Football
Coach, Jeff Tedford who attended Warren High School, at the May 13 City Council Meeting.
Members of the High Schools local football teams will also be invited.
Council Member Bayer thanked Council Member McCarthy for bringing the group from
a local church who participated in the recent Keep Downey Beautiful cleanup.
Council Member Bayer announced a fundraiser at Frantone’s on April 29 to support our
Fire Department and the CERT emergency supply bins.
Council Member Perkins announced the Street Faire on May 3 and encouraged everyone to
attend
Mayor Trejo announced that he attended the Hindu Temple’s celebration for their
anniversary which was a very enlightening and exciting event.
He further announced that there will be a free seminar this Friday, April 25 from 9:.0Q to 10:30
'a.m. at the Barbara Riley Community Center, the Senior Scam Stoppers with a panel of experts on
home improvements and repairs, auto repairs, seniors and patient rights, predatory lending, identity
theR and current scams and encouraged everyone to attend.

OTHER BUSINESS - Staff Members Comments
Fire Chief Sauter announced that the L. A. County Board of Supervisors today had officially
recognized the Downey fire stations as Safe Havens for the surrendering of newborn babies.
City Manager Caton mentioned that although most of the time oral staff reports at the City
Council meetings are given by either the Division Managers or the Department Heads, tonight
William Davis gave an excellent presentation and earlier Carol Rowland gave a presentation, which
makes the point that this City is really blessed with outstanding employees.
