HomeMy WebLinkAboutResolution No. 13-7457 - Approving Summary Vacation of Surplus Property & Alley Adjoining 11101 Lakewood Boulevard & 8767 Firestone Boulevard, Zoned Lakewood/Firestone Specific Plan (SP-01-2)RESOLUTION NO. 13-7457 [ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE SUMMARY VACATION OF SURPLUS PROPERTY ON THE WEST SIDE OF LAKEWOOD BOULEVARD AND EXISTING ALLEY ADJOINING 11101 LAKEWOOD BOULEVARD AND 8767 FIRESTONE BOULEVARD NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Regarding the portion of Lakewood Boulevard and public alley adjoining 11101 Lakewood Boulevard and 8767 Firestone Boulevard as described in Exhibit “A”, the City Council finds the following from all evidence submitted: (1) the surplus property and public alley have been impassive for vehicular travel for a period of five consecutive years, (2) that no public money has been expanded for the maintenance of the surplus property and alley during that period, and (3) that there are no in-place public utilities that are in use and that would be affected by the vacation SECTION 2. The vacation of said surplus portion of Lakewood Boulevard and public alley as described in Exhibit “A”, were found consistent and unnecessary for present or prospective public use with adopted Lakewood Boulevard Plan; and pursuant to Government Code Section 65402 SECTION 3. The City Council further finds that the City Planning Commission has reported that the vacation of the portion of Lakewood Boulevard and alley adjoining Lakewood Boulevard as described in Exhibit “A”, are in conformity with the adopted General Plan, and the City Council confirms that said vacation conforms to the adopted City’s General Plan [ SECTION 4. The City Council herby orders that said portion Lakewood Boulevard and alley described in Exhibit “A, shall be vacated, pursuant to the provisions of Chapter 4 (Summary Vacation) of Public Streets, Highways, and Service Easements Vacation Law. SECTION 5. This Resolution shall take effect from and after its adoption by the City Council. Recordation is contingent upon the sale transfer of the property at 1 1101 Lakewood Boulevard and the merger with 8767 Firestone Boulevard is recorded. And that from and after the date of the resolution is recorded, the surplus property and public alley vacated no longer constitutes a public service easement SECTION 6.
